UCL Philanthropy Month Crossword competition terms and conditions UCL Development and Alumni Relations Office (“UCL DARO”) is running a „Philanthropy Month Crossword competition‟ during February 2016. (“Competition”). By submitting an entry (“Submission”) to the Competition, you agree to be bound by these Terms and Conditions. There is no requirement to pay to participate in the Competition. 1 Eligibility 1.1 The Competition is open to everyone. 2 Competition 2.1 To enter a Submission into the Competition, you must email the Submission to philanthropymonth@ucl.ac.uk or post it to Maria Menicou, Development and Alumni Relations Office, Central House, 14 Upper Woburn Place, London, WC1H 0NN. 2.2 The competition period will commence on 1 February 2016 and will end at 11:59pm on 28 February. Submissions received outside this time period will not be considered. 2.3 Any Submission that you enter into the Competition must not: contain any material which is defamatory of any person; contain any material which is obscene, offensive, hateful or inflammatory; promote sexually explicit material; promote violence; promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; infringe any copyright, database right or trade mark of any other person; be likely to deceive any person; be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; promote any illegal activity; be threatening, abuse or invade another‟s privacy, or cause annoyance, inconvenience or needless anxiety; be likely to harass, upset, embarrass, alarm or annoy any other person; be used to impersonate any person, or to misrepresent your identity or affiliation with any person; give the impression that they emanate from us, if this is not the case; advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse. 2.4 UCL DARO may publish any Submission on all or any of e-newsletters, the official DARO Facebook page, the official DARO Instagram page, the official DARO Twitter page, DARO websites, Portico magazine, other UCL websites, other UCL social media channels, and in UCL printed and online publications. 2.5 Two winners will be chosen from a random draw of entries received in accordance with these Terms and Conditions. The draw will be performed by a random computer process. The draw will take place on 1 March 2016. 2.6 The UCL DARO Communications Team will notify the winners of the Competition on or before Friday 4 March 2016. 2.7 UCL DARO accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt by UCL DARO 3 The Prize 3.1 The two winners will each receive a Kindle Paperwhite. 3.2 The winners will be notified by email on or before 4 March 2016 and must provide a postal address to claim their prize. If a winner does not respond to UCL DARO within 14 days of being notified by UCL DARO, then the winner's prize will be forfeited and UCL DARO shall be entitled to select another winner in accordance with the process described above (and that winner will have to respond to notification of their win within 14 days or else they will also forfeit their prize). If a winner rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the winner's prize will be forfeited and UCL DARO shall be entitled to select another winner. 3.3 The prize will be sent to the winners by UCL DARO by post. 3.4 The prize is non-exchangeable, non-transferable, and is not redeemable for cash or other prizes. 3.5 UCL DARO retains the right to substitute the prize with another prize of similar value in the event the original prize offered is not available. 4 Intellectual Property 4.1 You acknowledge and agree that by entering a Submission for the Competition other users of the internet will be able to view the Submission. 4.2 You warrant that you and any co-entrants are the sole authors and owners of your Submission, that the Submission is your own original work and it does not infringe any copyright, trade marks or other rights (including intellectual property rights) of any third party. 4.3 You agree to indemnify UCL DARO and hold UCL DARO harmless against any and all loss, costs, claims, damages, demands, liabilities, actions and expenses arising out of a breach of paragraph 4.3. This means you will be responsible for any of the above that UCL suffers as a result of this paragraph 3.3. 4.4 You grant to UCL DARO a royalty-free, non-exclusive, worldwide, sub-licensable right to use, reproduce, modify, publish, create derivative works from and display (together with the right to incorporate into any other works in any form, media or technology know or later developed) any Submission submitted by you for the Competitions for the purposes of: 5 4.4.1 the Competition; 4.4.2 marketing and promotion of the Competitions and subsequent or other competitions run by UCL or its affiliated organisations; and 4.4.3 any other purpose anticipated by these Terms and Conditions; whether in digital or print media. Data Protection 5.1 You acknowledge that, in connection with the Competition, you will provide personal data to UCL DARO. UCL DARO will store and otherwise process that personal data only in connection with the administration and running of the Competition and for the marketing and sending of information relating to the Competition or future competitions run by UCL DARO. Your data will be handled in accordance with UCL‟s obligations under the Data Protection Act 1998 and the UCL privacy policy. 5.2 In entering a Submission to the Competition, you give UCL DARO and its affiliated organisations the right to use your name, likeness, photograph, voice and/or opinions for promotional purposes in any media, worldwide, without further payment or consideration. 6 UCL DARO Liability 6.1 UCL DARO may at any time in its absolute discretion and without notice change the details of or cancel any or all Competitions, vary these Terms and Conditions or alter the prizes available or their value. 6.2 UCL DARO and its agents and representatives hereby expressly exclude any liability whether in contract, tort, criminal law, breach of statutory duty or otherwise for any direct, indirect or consequential loss, damage, injury or disappointment (including without limitation any pure economic loss) suffered or incurred by you and whether foreseeable or not in connection with the Competitions. 6.3 UCL DARO will not have any liability to you if you are unable to enter a Competition for any reason including, without limitation, a failure in computer systems or unavailability of any website. 6.4 All conditions, warranties and other terms which might otherwise be implied by statute or common law are expressly excluded from these Terms and Conditions. 6.5 Nothing in these Terms and Conditions will limit or exclude UCL DARO‟s liability for death or personal injury caused by its negligence or for fraud or for any other liability which cannot be limited or excluded at law. 7 Disqualification 7.1 UCL DARO may disqualify either you or a Submission from any or all Competitions (and remove any Submission from the Competitions) if: 7.1.1 you or the Submission does not, at any time, comply with these Terms and Conditions. 7.1.2 any information provide by you is invalid, incorrect, or misleading; 7.1.3 a Submission is entered out of time or is faulty; 7.1.4 the Submission considers that it does or may harm UCL DARO, its reputation and/or that of any staff or pupils at UCL. 7.2 It is not permitted to use an automated system to enter Submissions. If you use an automated system to enter a Submission for the Competition or a Submission is entered as a result of an automated system, you and/or the Submission may be disqualified. 8 General 8.1 Decisions of UCL DARO and, in particular, the UCL DARO Communications Team will be final and binding and there will be no discussion or negotiation regarding the decision and/or selection and/or the process used by UCL. 8.2 If you wish to contact UCL DARO about the Competition, including to make a complaint, please send an email to: alumni@ucl.ac.uk , including “Philanthropy Month Crossword competition” in the title. 8.3 UCL DARO may revise these Terms and Conditions at any time by amending this page. You must check this page from time to time to take notice of any changes UCL DARO makes. 8.4 No failure or delay by a party to exercise any right or remedy provided under these Terms and Conditions shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. 8.5 These Terms and Conditions will be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
