PETE SCANLON: Yes, we received eight 6 letters in support of our proposal and no letters in 7 opposition. 8 would like to submit for your consideration today. Actually we have an additional one we 9 JOHN ROMANO: 10 11 Okay. PETE SCANLON: This is from a residential abutter adjacent to our proposal. 12 JOHN ROMANO: Okay. Very good, thank 13 you. 14 to get a variance to the zoning on that and I do have 15 that singed off by the City of Boston, Laura Morita 16 from the BRE. 17 want to point out that -- and Chris will cover this 18 that there is a non-conformity on spacing and that 19 there was a exemption issued by the Acting Secretary 20 Depaola on this. 21 bit more. 22 will do his presentation on the inspection. 23 CHRIS CHAVES: 24 We will review that. So we know that you needed So we have that in our files. I do So we will talk about that a little SO with that I am going to ask Chris if he Yes sir. This is again, a proposed new build digital one sided board. ATM, INC. C ourt Reporting Services 33 9-674-9100 It is 11 Office of Outdoor Advertising March 12, 2014 1 proposed to be affixed to the façade of the Lansdowne 2 garage to face Lansdowne Street. 3 mentioned there was a spacing issue according to the 4 CMR. 5 110-feet from permit number 23290 and approximately 6 156-feet form permit number 201109007. As Mr. Director The sign would be proposed to be approximately As he mentioned there is an exemption 7 8 letter from the former Acting Secretary of 9 Transportation exempting this site from the 711CMR 10 spacing which would be 500-feet. 11 federal spacing does still apply at 100-feet. 12 we can see by the numbers and the measurements here it 13 exceeds the 100-foot requirement for federal statute. 14 There is no other issues with this site regardless of 15 the spacing. 16 All though the So as With that it is a conforming site. JOHN ROMANO: Okay, great, thank you. 17 So I just want to reiterate that all of the other 18 requirements for electronic permits are in play here. 19 The exemption is only on the spacing and for no other 20 aspect of the electronic requirements in the CMR. 21 animation and all that stuff still applies here. 22 CHRIS QUINN: So So it is different from 23 your existing board at the end of the street that has 24 the full video of the animation and the flashing and ATM, INC. C ourt Reporting Services 33 9-674-9100 12 Office of Outdoor Advertising March 12, 2014 1 everything else. PETE SCANLON: 2 Yes, our only request 3 for exemption is spacing exemption, no request for 4 animation exemption. 5 CHRIS QUINN: 6 CHRIS CHAVES: 7 Okay, great. I would just like to add one thing. 8 JOHN ROMANO: 9 CHRIS CHAVES: Yes sure. It is my understanding 10 as well that this sign won’t be viewed from the Mass 11 Pike. 12 won’t be viewed. So I just want to have it on record that is JOHN ROMANO: 13 The other thing that I 14 want to point out in the Secretary’s letter was as 15 Chris said that this needs to be screened so that it 16 can’t be seen from the Mass Pike and that also one of 17 the benefits from the sign will be that you will be 18 working with the MBTA to get real time train data up 19 there for the commuter rail station and the transit 20 station that is specifically stated in the Secretary’s 21 letter. PETE SCANLON: 22 Yes sir we have a 23 commitment to screen it so it will not be visible from 24 the Pike. It is substantially screened or will be ATM, INC. C ourt Reporting Services 33 9-674-9100 13 Office of Outdoor Advertising March 12, 2014 1 already from the existing anti-gun board on the pike. 2 We also have a commitment to work with the community 3 on those local content issues like the real-time 4 sharing and also community issues with the city. 5 JOHN ROMANO: Just to be clear the 6 real-time stuff comes from the MBTA. 7 specific requirement. 8 the Secretary has issued his letter for the exemption 9 we still do that in consultation with FHWA. I know 10 that Lindsey is here today, or she was here. So we 11 will continue to consult with them before we make a 12 final decision on this. 13 have any other questions or concerns or anything? 14 sir. 15 So that is a Okay, please note that while Does anybody else in the room STEVEN ROSS: Yes Steven Ross, Clear 16 Channel Outdoor. 17 we actually have a board that is 110-feet away. 18 question is, if we were to seek a digital permit for 19 that location would we get the exemption as well and 20 would you permit that? 21 My question on exemption spacing is CHRIS QUINN: We don’t know. My You would 22 have to ask. It comes from the Secretary not from us. 23 Certainly, I would -- obviously we can’t promise you 24 it would happen but if you are in the same zoning ATM, INC. C ourt Reporting Services 33 9-674-9100 14 Office of Outdoor Advertising March 12, 2014 1 overlay district, I think you are, I am not sure where 2 it is delineated. 3 I would think at least zoning wise you would be on the 4 same footing as this applicant. 5 through the same local process that this applicant 6 went through as well. 7 probably be in fairly good step but we couldn’t 8 promise you would get it. I think it is at Brookline Avenue. You would have to go All I can tell you is you will 9 STEVEN ROSS: Thank you. 10 CHRIS QUINN: Yup. 11 JOHN ROMANO: Note that there is a new 12 secretary, so we can’t speak for the new secretary. 13 You would have to go through the city first. 14 other questions, concerns, comments? 15 your end Pete? PETE SCANLON: 16 17 18 Any Anything else on No, thank you for your consideration. JOHN ROMANO: Okay, we will take this 19 under advisement and we will let you know in the near 20 future how we rule on it. Thank you very much. 21 PETE SCANLON: 22 JOHN ROMANO: Thank you.
