Replacement for page 94 AGENDA ITEM BACKGROUND TO: GOVERNING BOARD DATE FROM: PRESIDENT June 10, 2013 SUBJECT: Negotiated Agreement for 2013-16: CCFT and District REASON FOR BOARD CONSIDERATION ACTION ENCLOSURE(S) Page 1 of 2 ITEM NUMBER F.3 BACKGROUND: In May, 2013, the District reached tentative agreement with CCFT regarding a contract for 2013-16. The District has been notified that CCFT unanimously ratified the tentative agreement. The following presents the major provisions of the CCFT/District agreement: Total Compensation (Salary and Benefits) CCFT and the District have reached tentative agreement on a total compensation package for 201314. Total compensation includes the costs of salaries and benefits. The overall package is a 4% increase in total compensation for faculty in 2013-14; a combination of one-time and ongoing increase to salaries and benefits. The ongoing increase is the equivalent of the 1.57% projected COLA for 2013-14 and the balance of the increase is one-time. Continued next page FISCAL IMPACT: Ongoing general fund allocation of approximately $414,000 and one-time general fund allocation of $642,000 RECOMMENDATION: It is recommended that the Governing Board approve the 2013-16 agreement between CCFT and the District. Administrator Initiating Item: Victoria Lewis Academic and Professional Matter If yes, Faculty Senate Agreement Senate President Signature Yes No Yes No Final Disposition Further contingency for ongoing funds In addition, the teams agree that if the college can capture restoration/growth funds for 2013-14 by increasing the number of full-time equivalent students served, an additional amount of the yearly (not ongoing) raise will be made permanent. Article 11 Counselor Work Year CCFT and the District agreed to eliminate per diem for counselors. Counselors will participate in a onetime opt out provision that requires most counselors to increase their work year from 175 days to 185 days per year. The additional ten days will be scheduled flexibly. Article 8: Safety and Work Environment: The District has agreed to maintain updated online resources for faculty regarding college policies and procedures for a safe work environment and to send notification of such resources to faculty electronically. The District has also confirmed that that CCFT will have representation on various college committees related to safety (no additional contract language on this last one). Other Tentative Agreements: Health benefits for long-term adjunct faculty: The District has agreed to extend the health benefits stipend to adjunct faculty who fell below 12 units for the 2012-13 academic year if they are scheduled for at least 12 units in the 2013-14 academic year. Agreement to be approved in a Side Letter. One adjunct faculty member is impacted by the side letter. Appendix GG, Faculty Evaluation of Program Chair: updated to protect faculty confidentiality. Re-openers CCFT and the District plan to reopen the meet and negotiate process in the following areas: Article 10: Leaves: To be reopened in 2013-14 to incorporate the side letter of agreement on State Disability Insurance for Adjunct Faculty (2011-12.6). Article 11: Workload: To be reopened in 2013-14 to address the following (most of these items relate to possible statewide changes or mandates): o 11.2.2.14 Distance Education will be reopened if state mandates require a change in Distance Education o 11.2.2.15 Interdisciplinary Classes, Linked Courses o 11.2.2.16 Interdisciplinary Classes o 11.5.2 Counseling will be reopened as necessary to address issues related to implementation of the Student Success Initiative o Compensation: Article 13: Salary and Article 14: Health and Welfare Benefits for 2014-15 and 2015-16. Article 16.16: Ancillary Activities Fund: Teams agree that we should further engage our adjunct faculty in relation to shared governance and professional work at the college. In the fall of 2013 a subcommittee will meet to develop ideas regarding funding of significant ancillary activities (process and amount of funding to be determined). Article 17: Evaluation and Tenure: A thorough review to will take place in 2014-15.
