MEASURE D CITIZEN’S OVERSIGHT COMMITTEE February 7, 2006 Minutes The meeting of the Measure D Citizen’s Oversight Committee was held at the Sesnon House, 6500 Soquel Drive, Aptos, CA on Tuesday February 7, 2006. Present: Kris Reyes, Jack Baskin, Rodney Brooks, Harriet Duzet, Tila Guerrero, Nicole Moreno, Luis Tuosto Cabrillo College staff members in attendance: Pegi Ard, Doug Deaver, Paul Anderson, Rob Ingram, Brian King, Dave Rowan The meeting was called to order at 10:05 by Kris. I. Introduction of New Members Pegi introduced Paul Anderson and Rob Ingram from the Facilities Development Office. Dave Rowan has accepted another position working with the state. II. Agenda Modifications None. III. Approval of Minutes There was a motion to approve the minutes of the meeting of November 9, 2005 (Deaver/Duzet). The minutes were approved with one abstention (Guerrero). IV. Project Status Update Pegi distributed a packet of information detailing fund expenditures on each of the major construction projects including changes pending review. Contingency budgets and balances to date were reviewed for each project.
· Allied Health Parking Structure and site work: After some deliberation, it was determined to add back in the fourth tier parking. No additional fees are associated with the redesign, but the contingency balance is $15,000 over budget. No change orders are pending or under review. Staff is hopeful to recover the $15,000 in soft costs. The project is currently 2 weeks ahead of schedule and should open in November. The contingency will be reallocated.
· Arts Education Classrooms: There were several unforeseen impacts on the project, including a city street and some utilities that needed to be rerouted that were not previously identified. Project credits include dirt from the Health and Wellness site. Some additional value engineering was also needed. Committed changes total approximately $1,334,000. Currently the fire sprinkler package is being re­bid. Once it is moved to the committed column, the contingency balance will be $1,000,000.
· Bogard + Kitchell fee adjustment: An agreement was signed with B + K for construction management services for both the Student Services Center (SSC) and the Arts Education Classrooms (AEC) projects. The fee increase for B + K is due to a longer project duration on the SSC project and double the number of bid packages which translates into more staff time required to manage the project. The original construction manager, Swinerton, projected their fee to be 8% of the total construction costs while B+K fees are in the 5% range, below Swinerton’s original bid even with the fee adjustment. Staff feels that B+K is being very fair and are only asking for incremental direct costs. The reasonable fee adjustment requested by B + K demonstrates the benefit of having a local construction management firm. Contracts over $65,000 are always presented to the Governing Board; and changes over 10% go back to the Board. These construction contract fee adjustments will go to the Board in March.
· Student Activities Center: Project changes include 1) going from PVC pipe to cast iron; 2) credits for the elimination of the kiosk and 3) a small B + K fee adjustment for same scenario as with the AEC. Committed contract changes total $258,000 with a couple items still pending. There will be approximately $300,000 in the contingency balance. The soil on the site required 190 caissons to be installed for stability. The soil nail wall in the back of the site has 60’ nails going into the wall; the caisson work had no impact on them—they were well mapped. The change from PVC pipe to cast iron was unforeseen, but will be reviewed with the architect since California Building Code doesn’t allow for PVC to be used for drain waste and vent lines. The entrance to park will be to the left of the buildings; parking behind the buildings along the soil nail wall and an exit to the right of the building in a one way fashion.
· Zolman Synergy update: 40% of the caissons were installed incorrectly; the project started slipping from the timeline in October. A letter was sent January 9 th to the surety to get schedule on track or Cabrillo would pull their $3.2 million performance bond. The performance bond ensures that Cabrillo has the right to terminate the contract if performance is unacceptable. A 7 day notice was issued to Zolman Synergy in January, but they met the deadline and appear to be off the critical path. Steel will be delivered next week and the contractor has promised to expedite their work. Staff is making every effort to keep contractors on schedule. The project is currently approximately 4 months behind. By the time the Citizens’ Oversight Committee meets again there will be a recovery schedule. Jack Baskin commented that once a contractor goes broke, it’s disaster all around.
· Status of Watsonville Library: The new library will be finished in December; March move in date. Cabrillo has the right of first refusal. The property was appraised at $3.1 million. Kris commented that a key component of the Bond
campaign was classroom expansion in Watsonville, he encourages keeping that project as a priority.
· Economic Development Grant: Tony Campos contacted Cabrillo to collaborate on technical training in Watsonville, with possible funding from a $2­3 million Economic Development Grant. If the City of Watsonville does not lose the retirement tax, they could also make a contribution to the partnership. Pegi stated that the State Capital Outlay Bond could come through, and that would help the Allied Health facility. The 3 main facilities will get built within the 1­1.5% contingencies. The West Soquel Overcrossing project is on hold given construction cost increases. The state average increase in construction costs is 30%. V. The next meeting will be May 9, 2006 at 10:00 am in the Sesnon House. The meeting was adjourned by Tila at 10:55am. The committee proceeded to tour the campus.
