Sexual harassment is unwelcome sexual- or gender-based verbal, written, online, and/or physical conduct. “Sexual harassment in education includes any unwanted and unwelcome sexual behavior that significantly interferes with a student’s access to educational opportunities. The Supreme Court has confirmed that schools have an obligation under Title IX to prevent and address harassment against students, regardless of whether the harassment is perpetrated by peers, teachers, or other school officials” (Title IX, 1972). RETALIATION Retaliation is defined as any adverse action taken against a person participating in a protected activity because of their participation in that protected activity. Retaliation against an individual for alleging a violation of their civil rights, supporting a complainant, or for assisting in providing information relevant to a claim, is a serious violation of the this policy. Acts of alleged retaliation should be reported immediately to the Title IX Officer or Deputy Coordinators. WHY SHOULD YOU TELL SOMEONE? You may not be the only person who is being harassed by this individual. Report sexual harassment so it will stop. Report incidences of harassment to the Dean of Students or the Assistant Dean of Students or a trusted faculty or staff member. Persistent requests for a date. Continued expression of sexual interest after being informed that the interest is unwelcome. Posters, photos, cartoons, or graffiti that are demeaning or offensive. Sexual language and/or jokes of a sexual nature. Unwelcome visual contact, such as leering or staring at another person. Comments or statements that are demeaning, humiliating, suggestive, insulting, vulgar, crude or lewd. Preferential treatment or promise of preferential treatment for submitting to sexual conduct. Retaliation, retribution, or reprisals in any form or manner for complaints about harassment, or for requests that harassing conduct stop, or for assisting a person with a complaint of harassment. Do not run or walk alone, use the buddy system. Do not give out personal information such as your phone number, or address to strangers or someone you are newly acquainted with. Be aware of your surroundings when you are walking across campus, to and from your vehicle, and in remote areas. Do not meet up with someone in a remote location to study. Any student can be the victim of sexual harassment. TITLE IX Title IX of the Education Amendments of 1972 prohibits sexual discrimination in any form; to include any form of sexual harassment and gender discrimination. Federal law states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any educational program or activity receiving Federal financial assistance.” Behaviors such as sexual harassment, unwanted sexual advances, or stalking should be taken seriously. This brochure will provide you with the necessary information to assist you in reporting any unwanted sexual advances or harassment and to offer support to victims of sexual harassment and misconduct.
