Dear Alumni and Friends of the Texas Tech Law School:
At this time last year, I reported on alumni support and its relationship to the program of
academic excellence at the Texas Tech School of Law. Our alumni support was outstanding.
This creates new stewardship responsibilities for the School of Law - a challenge to continue
and expand our past success. In this Cornerstone we report on Moot Court and Negotiations
teams which won their regional competitions and advanced to national finals. There is an
article noting that Texas Tech Law School graduates had the highest bar passage rate on both
the February and July bar examinations. There is also a faculty profile on Professor Bill Piatt.
As the article notes, his 1990 book, Only English? Law and Language in the United States
continues to be a seminal work in our national language rights debate. Clearly your support
has enabled us to expand on our previous achievements.
But Law School was never exclusively dedicated to academics. I hope you will enjoy the
articles relating to the 20th Anniversary Celebration for the Law Review and the First Annual
Malpractice Bowl. The Texas Tech School of Law continues to be a very special place for both
its faculty and its students. The brief vignettes contained in our Cornerstone issues allow us to
provide a view of life here at the Law School.
The cycle which begins with alumni support has been renewed this year. Once again your
support establishes a baseline 'to challenge the faculty and students here at the Law School.
While our figures are not yet complete, well over half of the alumni contacted pledged gifts
this year. The total pledged amount is over $100,000. Once again, you have set a new record in
alumni support for the Texas Tech School of Law. One special gift is highlighted in this issue.
Tom Hall of Fort Worth, Texas completed an Endowed Presidential Scholarship. This
Coleman-Hall Scholarship provides stipend support for a scholarship student who graduated
from Austin College. Such a special gift is a fitting highlight to this report which lists our
major contributors. We depend on your continued contributions and support.

Law School Teams Win
Regional Competitions

Continuing the tradition established by past
teams, two Texas Tech Law School teams won
regional competitions this fall. (Cover Photo)
The Negotiation Competition Team
composed of Tom Shute ('91) and Glenn Shook
('91) repeated their win of last year and captured
the regional win in Houston.
The problem for the competition involved an
employment discrimination suit based upon the
sexual harassment of a cocktail waitress.
Winning first place at the regional Moot
Court Competition in Fayetteville, Arkansas was
the team of Robert lenevein (,91), Brian
Heinrich (,91), and Lane Odom ('91). In addition
to the team title, the group won the regional
award for best brief, and Robert lenevein was
named best oral applicant in the competition.
This year's regional and national
competitions involve hypothetical cases involving
two issues: the right of a homeless person to
solicit funds in a public airport and the right of
police officers to require mandatory HIV / AIDS
testing for a homeless person who resists arrest.
Coleman/Hall Presidential
Scholarship Completed
Dean Frank Newton has announced the
completion of the Coleman/Hall Presidential
Scholarship. The scholarship is funded with an
endowment of $25 ,000 contributed by law school
graduate Tom G. Hall of Fort Worth, Texas.
Mr. Hall, of the class of 1981, is a trustee of the
Texas Tech Law School Foundation.
"The law school provided me with an
excellent education. I am pleased to set up this
scholarship for Texas Tech law students," said
Mr. Hall.
"Support from alumni is the key to building
upon our program. Tom's generosity is making a
wonderful contribution to our scholarship
program," said Dean Newton.

Law Review Celebrates
20th Anniversary
Texas Tech Leads State
in Bar Passage Rate
Texas Tech University School of Law
students ranked first on both the February '90
Texas Bar Examination and the July '90 Bar
Exam.
The February exam takers led the seven
other public and private law schools in the state
with a 94% pass rate. Achieving a 970/0 passage
rate in July, 120 of the 124 test-taking Texas
Tech students passed the exam .

Texas Tech Law Review celebrated twenty
years of excellence in legal writing at its 1990
banquet held at the Lubbock Women's Club
Building. Mahon Professor Reed Quilliam and
Professor Richard Maxwell were specially
recognized for their contributions to the Law
Review and the Texas Tech School of Law.
Speaker for the banquet was Justice
Reynaldo Garza of the 5th Circuit Court of
Appeals.

Shatters Records
The Fall 1990 entering class at the Texas
Tech Law School has set records in several ways.
First, a record number of completed applications
(l,550) were received. The entering class
contained 211 students.
Second, this year's class of entering students
has the highest LSAT and GP A average of any
class in the history of the law school. The
median LSAT is 36.48; the median GPA is 3.267.
One hundred fifty-nine students have an LSAT
score between 40-48; 197 students have an
undergraduate GPA between 3.5-4.0.
The number of minority applications
increased with a total minority enrollment in the
fall 1990 class of 31 students, also a record for
the law school.

1st Annual Malpractice
Bowl Held ·

Saturday morning, November 17, 1990 was
the date for the 1st Annual Malpractice Bowl
flag football game. Teams of future attorneys
and future doctors met in a hotly-contested
game which ended with the law school team (aka
Lawdogs) victorious over the Witch Doctors,
16-14. The victorious team received the traveling
trophy, a bedpan/scales of justice work of art,
and lunch paid for by the losing dean.
The excitement of the game was exceeded
only by the pre-game rhetoric. School of Law
Dean Frank Newton opened the verbal assault
by stating, "We are convinced the wanna-be
M.D.'s will be unable to catch us in our
Brandeis briefs."
Faculty Spotlight
Dean Darryl M. Williams of the School of
Medicine responded, "Of course, our group is
not only up to the challenge, but I think our
team will wipe clean the opponents in the spirit
of the bowl." Williams additionally added that
the medical students had been preparing
incantations to make sure the game ended in
their favor.
Led by former Texas Tech quarterback, Jim
Hart, the Lawdogs used multiple offensive plays
and a tough defensive game plan to contain the
Witch Doctors.

Building upon previous scholarship which
has earned national recognition, Professor Bill
Piatt's new book "Only English? Law and
Language Policy in the United States" is
attracting very favorable attention. The book,
published in April, 1990 by the University of
New Mexico Press, is an analysis of the
important historical, legal, political, and
philosophical interests involved in the current
debate over the nation's language policy. It
considers two crucial issues: 1) To what extent
and for what reasons do we now have the right
to express ourselves and receive communications
in languages other than English? 2) How can we
accommodate legitimate language interests and
still maintain national cohesiveness?
One review, published in The Texas Bar
Journal concludes that, "Piatt writes with a
deliberately non-confrontational style ... " that
offers a " ... rational, scholarly, almost gentle
analysis which demonstrates that many important
interests are at stake beyond mere administrative
convenience and jingoistic pride in the
overwhelming and exclusion of foreign cultures".
The book has received many other favorable
reviews and has already been cited in the
Cincinnati Law Review, the Minnesota Law
Review, and has been noted as "Worth Reading"
by the National Law Journal. The book has been
nominated for a national award, and Piatt
continues to travel and lecture to regional and
national organizational meetings.
Professor Piatt's previous scholarship in the
area of law and language rights has been well
received. A 1984 article published in the La Raza
Law Journal concerned foreign language
broadcasting. Publication of that article was
offered by several law reviews and was selected
as "Worth Reading" by The National Law
Journal. In 1986, Piatt published an article in the
Houston Law Review. That article was selected
as the outstanding article in the 1986 Houston
Law Review. It was republished as the lead
article in the September-October 1986 edition of
Callaghan's Law Review Digest. It has been cited
by many scholars in articles published in the
Harvard Law Review, Minnesota Law Review,
The Journal of Law Reform, and many others. It
was also cited repeatedly in a landmark language
rights case: Gutierrez v. Municipal Court, 838
F.2d 1031 (9th Cir. 1988). In 1990, Piatt
published an article in the New Mexico Law
Review exploring the harm to client, counsel and
the administration of justice when bilingual
counsel is required to serve as an interpreter for
a client in litigation. Among many other
publications by Professor Piatt is a Notre Dame
Law Review article and a chapter in a book to be
published this spring by the University of
Chicago Press.
As an Hispanic, and as a native of Santa Fe,
New Mexico, Professor Piatt has had a long
personal and professional interest in the
appreciation of cultural differences. On this
point, Professor Piatt is quite explicit in the
preface to his book: "I consider it my good
fortune both to have been born and raised in the
Southwest, and to have had the opportunity to
learn Spanish as well as English from family,
friends and the educational system. The town
(Santa Fe) where I was born and street (Callecita)
where I was raised carry Spanish names." From
this perspective and based upon his years of
study and writing, Piatt argues in his book for
the necessity to protect the rights of people to
view the world through their own language and
culture. He holds that language should not be a
barrier to the exercise of fundamental legal rights
nor the satisfaction of basic human needs.
Professor Piatt's research and writings led to
the creation of a "Law and Language Seminar"
offered in the Fall 1990 to twenty-four Texas
Tech law students. "I am impressed with the
interest of our current student body in law and
language rights issues. They understand that the
cultural composition of this state will require any
successful attorney to be able to relate to peoples
of differing backgrounds. I am pleased that our
current student body demonstrates a respect for,
and appreciation of, diversity."
Professor Piatt is already at work on his
next book.

Texas Tech University Professor of Law
John Krahmer has been named the Texas Tech
Law School Professor of Commercial Law.
The endowed professorship, funded through
the Texas Tech School of Law Foundation, was
approved during the foundation's fall meeting in
November.
Krahmer was named a Foundation Fellow
of Commercial Law in 1988.
A native of Cedar Rapids, Iowa, Krahmer
has been on the Texas Tech faculty since 1971.
He received the President's Excellence in
Teaching Award in 1984 and the Outstanding
Researcher Award in 1980, both at Texas Tech.
He received the Texas Tech School of Law
Outstanding Law Professor award in 1974, 1976
and 1978.
Krahmer completed his law degree in 1966
from the University of Iowa. He earned an
advanced law degree in 1967 from Harvard Law
School. He served from 1967-71 as a faculty
member of the University of South Carolina
School of Law.

IN MEMORIAM
The alumni, faculty, staff and students
of the Texas Tech School of Law extend
their sympathy to the family of Kathy
McDowell Stewart.
Ms. Stewart, a 1976 graduate of the
Texas Tech Law School, was admitted to
the Texas Bar in 1976. She served in the
Dallas city attorney's office in 1976 and the

Austin city attorney's office from 1977 to
1979. Ms. Stewart worked with the Central
Intelligence Agency as directorate of
operations from 1979 to 1983 and in the
CIA's Office of Legal Counsel from 1983
to 1990.
Ms. Stewart died on February 9, 1990.
She is survived by her husband, David A.
Stewart, 1536 Longfellow Court, McLean,
Virginia 22101 and a stepdaughter,
Anastasia Stewart.
