The Governor, Himachal Pradesh, on the recommendations of
Himachal Pradesh Public Service Commission, is pleased to appoint Sh. Rajeev Kumar
Sharma S/O Sh. Jia Lal Village Nalwar P.O. Jukhala Tehsil Sadar Distt. Bilaspur, H.P.174033 (Ex-Serviceman General Category) to the post of Assistant District Attorneys
(Class-I Gazetted), in the pay scale of Rs. 10300-34800+4400 G.P. plus other allowances

are liable to be terminated at any time by giving one month’s

The appointment shall subject to medical fitness.

to be taken.
The service rules as are applicable in Himachal Pradesh for the
post of Assistant District Attorney, as amended from time to
time, shall regulate his service conditions.
The appointment shall carry the liability upon him to serve in
any part of Himachal Pradesh/Delhi.
These appointments are subject to the verification of Character
and Antecedents of above mentioned candidates satisfactorily.
He shall exercise option to take advantage of the retirement
benefits based on the combined military services under Rule 19
of the CCS Pension Rules, 1972.
In case the above conditions are acceptable to the candidate, he
should report for training to the Director of Prosecution, H.P. on 2.4.2012 at 10.00
A.M.., failing which this offer of appointment will be treated as cancelled.

NOTIFICAT ION
Whereas with regard to assigning of seniority to Ex-serviceman CWP
No. 488/2001 titled V.K. Behal Vs. State of HP was decided by Hon’ble High Court of HP
on 29.12.2008. As per this judgement the seniority list of ADA circulated vide letter no.
LLR-B (1)2/78 dated 17.01.1997 has been set aside and quashed.
And whereas against this judgement dated 29.12.2008 the aggrieved
Ex-serviceman filed SLP No. 8710/2009 titled R.K. Barwal & Others Vs State of HP &
Others before Hon’ble Supreme Court of India. This SLP was listed 16.03.2009 when State
of HP has been directed to maintain Status Quo as of today. After the passing of judgement
dated 29.12.2008 by Hon’ble High Court no seniority list in the category of ADA has been
finalised and circulated.
Thus the Governor, Himachal Pradesh, on the recommendations of
Departmental Promotion Committee, as well as after considering the order passed by
Hon’ble Supreme Court of India in the said pending SLP of maintaining Status Quo
is
pleased to promote the following ADA’s to the post of Deputy District Attorney in the pay
scale of Rs.10300-34800+5400 G.P. on temporary basis with immediate effect subject to
final outcome of SLP No. 8710/2009:1. Sh. Atma Ram

The above Deputy District Attorneys will continue to work at their

NOTIFICATION
The Governor, Himachal Pradesh, is pleased to reemploy Sh. Anil Sood, District Attorney with effect from 1st April, 2012 to 31st March, 2013
in the public interest. He is further posted as District Attorney at New Delhi.
The terms and conditions of re-employment are as
under:1. Salary:
The pay will be fixed in accordance with HP State Civil
Services (Fixation of Pay of Re-employed Pensioners)
Orders, 1988 issued by the FD vide OM dated 1st
December, 1988, Fin (C )-B(7)-10/98, dated
8th
September, 1999 and Fin (C )-B(7)-13/2009 dated 19th
April, 2010.
2. Tenure:
The tenure of appointment shall be for a period of one
year w.e.f. 01-04-2012 to 31.3.2013.
Provided that Government can terminate this
appointment even before the expiry of the above period
by giving notice of one month in advance or paying one
month’s salary in lieu of notice of one month in case
conduct and performance of the incumbent is not found
satisfactory or the services are not required any more.
3. TA/DA:
He shall be entitled to TA/DA as per admissibility to
the Class-I Officers to the State Government under the
concerned rules.
4. Leave:
CCS (Leave) Rules, 1972 shall not be applicable to the
re-employed pensioners and he will also not be entitled
to LTC/HLTC facility. However, he will be entitled to
one casual leave for each completed month.
5. Medical Facilities: He shall be entitled to avail medical facilities
and grant of re-imbursement of Medical Expenses as
admissible to Class-I Officers of the State Government.
6.Residential Accommodation: He shall be entitled to the allotment
of
Government
Residential
Accommodation,
if
available or otherwise he will be entitled to receive
House Rent Allowance as per State Government Rules
and instructions, in this regard.
