Researcher Agreement
Legal Responsibilities and Privacy Rights
By my signature below, I affirm that I have read, understand, and agree to the
following conditions:
I understand, Western Carolina University (“WCU”) shall retain, in perpetuity or as long
as it deems necessary, a record of this Agreement and all material that I have
requested. These records may be released in response to a valid request made
pursuant to law.
As discussed above, pursuant to my research requirements, I may have access to
records and personal writings of living individuals whose privacy rights and/or literary
and copyrights must be respected. Records of this type may contain sensitive or
confidential information that is protected under federal or state right to privacy laws
and regulations, the North Carolina Public Records Act (N.C.G.S. Section 132.1 et seq.),
and Article 7 of the North Carolina State Personnel Act (N.C.G.S. Section 126-22 et
seq.). Western Carolina University assumes no responsibility for infringement of literary
propriety rights and copyright, or for liability to any person for defamation or invasion of
privacy that results from my use of any rare book, manuscript, special collection, or any
collection or work currently maintained by WCU and/or the WCU Library. I agree to
defend and indemnify WCU and/or the WCU Library for any action, based in law or
equity, regarding my use of any rare book, manuscript, special collection or any other
collection or work currently maintained by WCU and/or the WCU Library.
