Claims and Incident Reporting

In the event of an incident on campus resulting in a loss or damage to property or which results in injury to third parties (visitors, guests, or in some cases students) a State

Report of Incident form must be completed and filed with EHRM to record the incident.

In some cases an insurance claim may be opened and the appropriate claim investigation measures will be initiated.

Note: Timely and accurate reporting of accidents and claims is critical in order to protect the interests of the University and its employees.

Following are the types of incidents requiring a State Report of Incident to be filed:

Motor Vehicle Incidents:

Any accident/incident involving a University owned, rented or leased vehicle resulting in damage or loss to either the U of M vehicle, damage to vehicles owned by third parties, or injury to any individual within the vehicle during the incident require that a State

Report of Incident be filed and contact be made with EHRM.

Each University vehicle shoul d have within the glove compartment an “In Case of

Accident” guide to assist you in the steps to take if you are in an accident. A copy of the guide can be found at: http://rmtd.mt.gov/claims/incaseaccidentform.aspx

University of Montana owned, rented, leased or loaned motor vehicles are covered by liability insurance with liability limits of $750,000 per claimant and $1,500,000 per occurrence. This coverage provides protection to the motor vehicle operator and the

University for claims filed by third parties for property damage and personal injury arising out of use of the University of Montana or State motor vehicles. UM motor pool vehicles also carry comprehensive/collision coverage, as do a few of the other departmental vehicles at that department's request. A $250.00 deductible is the responsibility of the department owning or renting the vehicle for any damage sustained by the vehicle. Most state-owned vehicles typically contain a Certificate of Insurance for

Auto Liability in the glove box. If your vehicle does not have one, it may be downloaded from the division's website at the links provided. For leased or courtesy vehicles, agency personnel are responsible to download the Certificate of Insurance for Auto Liability from the division's website and assure that it is in the vehicle.

Property Damage Incidents:

Damage or loss to property owned, leased or rented (in the care and custody of UM):

This includes damage or loss from such perils as hail, windstorm, earthquake, fire, theft, flood, vandalism, etc. In case of theft or vandalism the University Police Department should be notified immediately, followed by notifying immediate supervisor and completing a State Report of Incident form and sending it to Environmental Health and

Risk Management.

Employee’s Personal property that is being kept in/on campus property is not covered under the University’s property insurance policy.

Liability Loss Incidents:

Damage or Loss to Property Not Owned by UM which is in UM’s Care, Custody and Control: This includes property owned by others for which it is alleged or likely to be alleged the loss or damage occurred as a result of UM’s negligence. This can include property not owned, leased, rented to or loaned to UM, but property of others over which UM exercises control regarding where it is used, stored or maintained.

Damage or Loss to Property Not Owned by UM which is NOT in UM’s Care,

Custody and Control: this includes property of any kind owned by others for which it is alleged or likely to be alleged that loss or damage occurred as a result of UM’s negligence. This can include vehicles in parking lots or third party owned property in dormitories and University owned apartments.

Injuries to UM Visitors, Guests and/or the Public: This includes incidents that result in injury to visitors, guests, or the general public that occur on UM property or for which it is likely to be alleged the injuries were due to UM’s negligence.

Injuries to UM students: This does NOT include injuries or illnesses arising from intercollegiate, intramural, recreational, academic, student club/organization or research activities. Student injuries that require a State Report of Incident report be filed include incidents that result in injury to students for which it is likely to be alleged the injuries were due to UM’s negligence.

All other Student Injuries can be documented on the Student (non-employee) Accident form.

Injuries to UM Employees:

In the event that any of the above incidents result in an injury or illness to a UM employee a “First Report of Injury” report must also be completed and filed. This can be found under Workers' Compensation .
