At a r e c e n t m e e t i n g over which I p r e s i d e d i n t h e a b s e n c e of t h e L o r d C h a n c e l l o r , t h e C o m m i t t e e c o n f i r m e d t h e i r e a r l i e r c o n c l u s i o n t h a t it w a s b o t h p r a c t i c a b l e a n d n e c e s s a r y to introduce legislation controlling Commonwealth immigration; and they approved for s u b m i s s i o n to the Cabinet, subject to s o m e revision, t h e d r a f t of a B i l l f o r t h a t p u r p o s e . The draft Bill attached to this p a p e r has been approved by the Legislation Committee, subject to further c o n s i d e r a t i o n o f s o m e p o i n t s o f d e t a i l w h i c h a r e n o t e d i n p a r a g r a p h 13 below. 2. T h e s c a l e of c o l o u r e d i m m i g r a t i o n i s a l r e a d y v e r y h i g h a n d i s rapidly increasing. The latest monthly figure available, for August, is t h e h i g h e s t o n r e c o r d a t 1 5 , 7 0 0 ; a n d t h e e s t i m a t e d t o t a l f o r 1961 i s w e l l o v e r 100, 000 a s c o m p a r e d with 57, 700 for I960 a n d 21, 000 for 1959. The g r e a t b u l k of c o l o u r e d i m m i g r a n t s h a v e a l w a y s c o m e f r o m t h e W e s t Indies but the Indian sub-continent is now a fairly close second: for s o m e y e a r s the Indian and P a k i s t a n i G o v e r n m e n t s w e r e able to e x e r c i s e r e a s o n a b l y effective c o n t r o l s on e m i g r a t i o n to the U n i t e d K i n g d o m but these no longer a p p e a r to be achieving their purpose, while the West I n d i a n G o v e r n m e n t s h a v e n e v e r f e l t a b l e t o i m p o s e a n y k i n d of e f f e c t i v e control. The case for control by Her Majesty's Government rests mainly upon two considerations - the strain imposed by coloured immigration on t h e h o u s i n g r e s o u r c e s of c e r t a i n l o c a l a u t h o r i t i e s a n d . t h e d a n g e r s of s o c i a l t e n s i o n i n h e r e n t i n t h e e x i s t e n c e of l a r g e u n a s s i m i l a t e d c o l o u r e d communities. The Commonwealth Migrants Committee recognise that c o n t r o l w o u l d r e p r e s e n t a d e p a r t u r e f r o m t h e l o n g - s t a n d i n g f r e e d o m of a l l B r i t i s h subjects to e n t e r and stay in the United Kingdom; that u n r e s t r i c t e d C o m m o n w e a l t h i m m i g r a t i o n is on b a l a n c e to our e c o n o m i c advantage; that control cannot at p r e s e n t be conclusively justified on g r o u n d s of e m p l o y m e n t , h e a l t h o r p u b l i c o r d e r ; a n d t h a t i t s i n t r o d u c t i o n would give r i s e to s h a r p c r i t i c i s m in s o m e C o m m o n w e a l t h countries and f i e r c e c o n t r o v e r s y in P a r l i a m e n t . N e v e r t h e l e s s , taking full a c c o u n t of a l l t h e a r g u m e n t s o n b o t h s i d e s , t h e C o m m i t t e e r e c o m m e n d t h a t , s i n c e a s s i m i l a t i o n is not taking place to any significant extent while coloured i m m i g r a t i o n s e e m s likely to go on i n c r e a s i n g , c o n t r o l should be a c c e p t e d as a sad necessity. SEG1IT Character of t h e P r o p o s e d Control 3. The s c h e m e c o m p r i s e d in the Bill is a flexible e m p l o y m e n t c o n t r o l applying, broadly, to C o m m o n w e a l t h citizens not either b o r n in the United Kingdom or holding valid p a s s p o r t s i s s u e d by the United Kingdom G o v e r n ­ ment. T h e c e n t r a l f e a t u r e of t h e s c h e m e i s t h a t e n t r y w o u l d d e p e n d u p o n p o s s e s s i o n of a v o u c h e r i s s u e d b y t h e M i n i s t r y of L a b o u r , w h i c h w o u l d f o r t h i s p u r p o s e r e c o g n i s e t h r e e c a t e g o r i e s of a p p l i c a n t : ­ (a) T h o s e h a v i n g j o b s to go t o . (b) Those who have undergone apprenticeship or training, or have professional or educational qualifications or experience, accepted as likely to be useful in this country. (c) Others. T h e intention is that v o u c h e r s should be i s s u e d f r e e l y to p e r s o n s in c a t e g o r i e s ( a ) a n d ( b ) ; a n d t o p e r s o n s i n c a t e g o r y ( c ) o n t h e p r i n c i p l e of "first come, first served" within n u m e r i c a l limits d e t e r m i n e d by the G o v e r n m e n t f r o m t i m e t o t i m e i n t h e l i g h t of a l l r e l e v a n t f a c t o r s - s o c i a l economic, etc. The Bill p r o v i d e s that e n t r y m a y not be r e f u s e d to anyone w h o c a n s u p p o r t h i m s e l f w i t h o u t w o r k i n g a n d e n t r y w o u l d , of c o u r s e , c o n t i n u e t o b e g r a n t e d u n c o n d i t i o n a l l y t o p e r s o n s of c e r t a i n o t h e r t y p e s , such as genuine students. On the other hand, the Bill applies to all w o u l d - b e i m m i g r a n t s p r o v i s i o n that e n t r y m a y be r e f u s e d to a n y o n e on s p e c i f i e d g r o u n d s of h e a l t h , c r i m i n a l r e c o r d o r n a t i o n a l s e c u r i t y . 4. T h e g r e a t m e r i t of t h i s s c h e m e i s t h a t i t c a n b e p r e s e n t e d as m a k i n g n o d i s t i n c t i o n o n g r o u n d s of r a c e o r c o l o u r , a l t h o u g h i n p r a c t i c e all would-be i m m i g r a n t s f r o m the old C o m m o n w e a l t h c o u n t r i e s would a l m o s t c e r t a i n l y b e able to obtain a u t h o r i t y to e n t e r u n d e r e i t h e r c a t e g o r y (a) o r c a t e g o r y (b). We m u s t r e c o g n i s e that, although the s c h e m e p u r p o r t s to r e l a t e solely to e m p l o y m e n t and to b e n o n ­ d i s c r i m i n a t o r y , its a i m is p r i m a r i l y social and its r e s t r i c t i v e effect i s i n t e n d e d to, and would in fact, o p e r a t e on c o l o u r e d p e o p l e a l m o s t exclusively. T h i s w i l l b e s e e n a n d , n o d o u b t , l a b o u r e d b y s o m e of o u r critics b u t t h e r e i s no e s c a p e f r o m it a n d at l e a s t s u c h c r i t i c s w i l l n o t be able to sustain a n y suggestion that the s c h e m e is inherently discriminatory. The Commonwealth Migrants Committee are agreed that we should r e s i s t any a t t e m p t to write into the Bill p r o v i s i o n against d i s c r i m i n a t i o n o n g r o u n d s of r a c e o r c o l o u r . On the other hand, the s c h e m e will not n e c e s s a r i l y p r o d u c e an i m m e d i a t e or d r a m a t i c reduction in c o l o u r e d i m m i g r a t i o n : its i m p a c t will l a r g e l y d e p e n d upon our d e c i s i o n s a s a G o v e r n m e n t about the n u m b e r s to be a d m i t t e d in c a t e g o r y (c). Some of o u r o w n s u p p o r t e r s m a y t h e r e f o r e w e l l b e f a r f r o m s a t i s f i e d , b u t w e Can p r o b a b l y hope for no b e t t e r situation t h a n one not w h o l l y p l e a s i n g to our critics at either e x t r e m e . 5. T h e C o m m o n w e a l t h M i g r a n t s C o m m i t t e e a r e s a t i s f i e d t h a t , if w e w e r e t o j o i n t h e E u r o p e a n E c o n o m i c C o m m u n i t y , t h e f r e e d o m of c i t i z e n s of o t h e r c o u n t r i e s i n t h e C o m m u n i t y t o c o m e h e r e w o u l d r e m a i n s u b j e c t t o administrative control which need be no m o r e liberal than the s y s t e m of c o n t r o l f o r C o m m o n w e a l t h c i t i z e n s . Other Features of t h e proposed Dill 6. Landing Conditions.. A n i m p o r t a n t a s p e c t of t h e B i l l i s t h a t i t differentiates b e t w e e n C o m m o n w e a l t h citizens and aliens b y not i m p o s i n g upon the f o r m e r a universal r e q u i r e m e n t to obtain leave to land. On the o t h e r h a n d , t h e B i l l a u t h o r i s e s I m m i g r a t i o n O f f i c e r s to g r a n t e n t r y subject to conditions and in consequence to r e q u i r e landing and e m b a r k a t i o n cards. It s e e m s p r u d e n t t o h a v e t h e s e a d d i t i o n a l p o w e r s , if o n l y i n reserve. D e s p i t e t h e b e s t e f f o r t s of I m m i g r a t i o n O f f i c e r s t h e s c h e m e i s bound to c a u s e s o m e additional delay to all a r r i v i n g at the sea and a i r p o r t s u s e d by C o m m o n w e a l t h i m m i g r a n t s , but this is an unavoidable d i s a d v a n t a g e of a n y s c h e m e f o r c o n t r o l l i n g C o m m o n w e a l t h i m m i g r a t i o n . 7. The Bill gives p o w e r s , c o m p a r a b l e to those under the A l i e n s O r d e r , t o r e q u i r e t h e m a s t e r , c o m m a n d e r , o w n e r s o r a g e n t s of a s h i p o r a i r c r a f t to take back p e r s o n s refused admission. This is essential as a deterrent t o a n y w h o m i g h t b e t e m p t e d t o b r i n g l a r g e n u m b e r s of i m m i g r a n t s t o t h i s c o u n t r y w i t h o u t M i n i s t r y of L a b o u r v o u c h e r s . 8. Appeals. It i s i n e v i t a b l e t h a t I m m i g r a t i o n O f f i c e r s s h o u l d b e g i v e n wide discretion and that their decisions to grant or refuse entry should have i m m e d i a t e effect. The Commonwealth Migrants Committee are a g r e e d that it w o u l d not b e p r a c t i c a b l e to p r o v i d e for a p p e a l s a g a i n s t refusal but there will be administrative a r r a n g e m e n t s whereby on o c c a s i o n s of d o u b t I m m i g r a t i o n O f f i c e r s c a n r a p i d l y r e f e r i n d i v i d u a l c a s e s to the H o m e Office for c o n f i r m a t i o n . 9* jrish Citizens. A s d r a f t e d , t h e B i l l a p p l i e s t o c i t i z e n s of t h e Irish Republic, but the Commonwealth Migrants Committee are agreed t h a t c o n t r o l of e n t r y f r o m I r e l a n d i s n o t i n f a c t p r a c t i c a b l e . Since in the l a s t a n a l y s i s t h e p r o p o s e d c o n t r o l w o u l d o p e r a t e o n t h e p r i n c i p l e of " f i r s t c o m e , f i r s t s e r v e d " , thus involving no national q u o t a s , I s e e no a l t e r n a t i v e b u t t o b e f r a n k a b o u t t h e I r i s h if t h e q u e s t i o n i s r a i s e d , t a k i n g o u r s t a n d u p o n t h e s a m e c o n s i d e r a t i o n s w h i c h l e d u s i n t h e c o n t e x t of n a t i o n a l i t y t o t r e a t I r i s h c i t i z e n s a s if t h e y w e r e B r i t i s h s u b j e c t s - a u s e f u l p r e c e d e n t in the p r e s e n t c o n n e c t i o n . It w o u l d a l s o b e i m p r a c t i c a b l e t o h a v e a c o m p r e h e n s i v e c o n t r o l of C o m m o n w e a l t h c i t i z e n s e n t e r i n g t h i s c o u n t r y via the Irish Republic. A r r a n g e m e n t s would b e m a d e for a d hoc c o n t r o l w h e r e , f o r e x a m p l e , a l a r g e b o a t l o a d of W e s t I n d i a n s w a s e x p e c t e d b y this route: for the r e s t we would hope to obtain - a s we do over aliens ­ t h e c o - o p e r a t i o n of t h e i m m i g r a t i o n a u t h o r i t i e s of t h e I r i s h R e p u b l i c i n o p e r a t i n g a control s i m i l a r to o u r s . 10. Deportation. The Commonwealth Migrants Committee consider p r o v i s i o n £or d e p o r t a t i o n d e s i r a b l e a n d o v e r d u e in its own r i g h t s , quite a p a r t f r o m t h e q u e s t i o n of c o n t r o l l i n g C o m m o n w e a l t h i m m i g r a t i o n , a n d t h e B i l l i n c l u d e s p r o v i s i o n f o r d e p o r t a t i o n e s s e n t i a l l y o n t h e l i n e s of t h e policy agreed when a draft Deportation Bill was considered in 1958-59. T h i s p r o v i s i o n e n a b l e s t h e C o u r t s t o r e c o m m e n d t h e d e p o r t a t i o n of C o m m o n w e a l t h citizens who have lived h e r e for l e s s than five y e a r s , do not b e l o n g to the United K i n g d o m b y b i r t h , d e s c e n t or n a t u r a l i s a t i o n a n d a r e c o n v i c t e d of a n y o f f e n c e c a r r y i n g l i a b i l i t y t o i m p r i s o n m e n t . The Legislation. Committee suggested, however, that a n i m m i g r a n t should be l i a b l e t o d e p o r t a t i o n e v e n if h e h a d l i v e d h e r e f o r m o r e t h a n f i v e y e a r s , provided that this result could be achieved without an unfortunate d i s c r i m i n a ­ t i o n b e t w e e n c i t i z e n s of d e p e n d e n t a n d i n d e p e n d e n t C o m m o n w e a l t h territories. T h e r e is no p r o v i s i o n for d e p o r t a t i o n e x c e p t on the r e c o m m e n d a t i o n of a C o u r t a n d t h e H o m e S e c r e t a r y w i l l h a v e a d i s c r e t i o n w h e t h e r or not to o r d e r d e p o r t a t i o n . 11. B u t u n d e r t h e B r i t i s h N a t i o n a l i t y A c t , 1 9 4 8 , a s it n o w s t a n d s , c i t i a e n s of m o s t o t h e r C o m m o n w e a l t h c o u n t r i e s c o u l d e s c a p e l i a b i l i t y t o d e p o r t a t i o n after only t w e l v e m o n t h s ' r e s i d e n c e in the United K i n g d o m by e x e r c i s i n g t h e r i g h t g i v e n i n S e c t i o n 6(1) t o r e g i s t e r a s c i t i a e n s of t h e United Kingdom and Colonies. F o r c i t i z e n s of m o s t C o m m o n w e a l t h c o u n t r i e s s u c h r e g i s t r a t i o n e n t a i l s l o s s of t h e i r f o r m e r c i t i z e n s h i p , w i t h the result that a subsequent deportation o r d e r could not be m a d e effective. The C o m m o n w e a l t h Migrants C o m m i t t e e consider that the British Nationality Act, 1948, should be a m e n d e d by i n c r e a s i n g the p e r i o d p r e s c r i b e d i n S e c t i o n 6(1) f r o m t w e l v e m o n t h s t o f i v e y e a r s , t h u s b r i n g i n g i t f u l l y into line with the p r o p o s e d p e r i o d during which C o m m o n w e a l t h citizens would be liable to deportation. It i s p r o p o s e d t h a t t h e r e s h o u l d b e a p e r i o d of s i x m o n t h s d u r i n g w h i c h p e r s o n s m a y e x e r c i s e a n e x i s t i n g r i g h t t o registration which would otherwise be r e m o v e d by the Bill. 12, T h e f o r m of t h e B i l l . Miscellanoous. Power o f immigration officers to refuse admission or admit subject to conditions. 2 . — ( 1 ) Subject t o the p r o v i s i o n s of this section, a n i m m i g r a - 2 0 tion officer m a y , b y n o t i c e given t o a n y C o m m o n w e a l t h citizen n o t b e l o n g i n g to t h e U n i t e d K i n g d o m w h o l a n d s or seeks to l a n d in t h e U n i t e d K i n g d o m — (a) refuse h i m admission i n t o t h e U n i t e d K i n g d o m ; o r (b) a d m i t h i m i n t o t h e U n i t e d K i n g d o m subject t o c o n - 2 5 ditions for restricting t h e p e r i o d for w h i c h h e m a y r e m a i n t h e r e o r for r e g u l a t i n g h i s e m p l o y m e n t o r occupation there. (2) E x c e p t as p r o v i d e d b y s u b s e c t i o n (3) of this section, a C o m m o n w e a l t h citizen shall n o t b e refused a d m i s s i o n i n t o t h e 3 0 U n i t e d K i n g d o m if h e satisfies t h e i m m i g r a t i o n officer e i t h e r — (a) t h a t h e wishes to e n t e r t h e U n i t e d K i n g d o m for t h e p u r p o s e s of e m p l o y m e n t t h e r e , a n d is t h e h o l d e r of a v o u c h e r issued in p u r s u a n c e of a r r a n g e m e n t s m a d e for the p u r p o s e s of this section b y the M i n i s t e r 3 5 of L a b o u r a n d the M i n i s t r y of L a b o u r a n d N a t i o n a l I n s u r a n c e in N o r t h e r n I r e l a n d ; or (h) t h a t h e is a b l e , while in t h e U n i t e d K i n g d o m , t o s u p p o r t himself a n d his d e p e n d a n t s , if any, otherwise t h a n b y taking employment or engaging for reward in any 4 0 b u s i n e s s , profession o r o c c u p a t i o n . (3) N o t w i t h s t a n d i n g a n y t h i n g in t h e last foregoing s u b s e c t i o n , a d m i s s i o n i n t o t h e U n i t e d K i n g d o m m a y b e refused i n t h e case of a n y C o m m o n w e a l t h citizen n o t b e l o n g i n g to t h e U n i t e d Kingdom— 5 10 PART I (a) if it a p p e a r s t o t h e i m m i g r a t i o n officer, or to a m e d i c a l inspector, t h a t h e is a person suffering from m e n t a l dis­ o r d e r , or t h a t it is otherwise u n d e s i r a b l e for m e d i c a l reasons that he should be admitted ; o r (b) if the i m m i g r a t i o n officer has r e a s o n t o believe t h a t h e h a s b e e n sentenced in a n y c o u n t r y t o i m p r i s o n m e n t for a t e r m n o t less t h a n twelve m o n t h s ; or (c) if his admission w o u l d , i n the o p i n i o n of the Secretary of S t a t e , b e c o n t r a r y t o t h e interests of n a t i o n a l security. ( 4 ) A n o t i c e u n d e r subsection ( 1 ) of this section refusing a d m i s s i o n i n t o the U n i t e d K i n g d o m m a y at a n y t i m e be c a n ­ celled b y a s u b s e q u e n t notice given b y a n i m m i g r a t i o n officer ; 1 5 a n d a n y c o n d i t i o n i m p o s e d b y a notice u n d e r t h a t subsection m a y at a n y t i m e b e r e v o k e d or varied b y the Secretary of State. 3 . — ( 1 ) T h e provisions of P a r t I of t h e F i r s t S c h e d u l e to this Supplementary A c t shall h a v e effect with r e s p e c t t o t h e e x a m i n a t i o n of p e r s o n s provisions as l a n d i n g or seeking t o l a n d in the U n i t e d K i n g d o m , t h e r e m o v a l i n ^ g r a u o n 2 0 from the U n i t e d K i n g d o m of C o m m o n w e a l t h citizens n o t belong­ ing t o t h e U n i t e d K i n g d o m w h o are refused a d m i s s i o n u n d e r section t w o of this A c t , the d e t e n t i o n of s u c h p e r s o n s a n d citizens p e n d i n g further e x a m i n a t i o n or p e n d i n g r e m o v a l from t h e U n i t e d K i n g d o m , a n d other m a t t e r s s u p p l e m e n t a r y to t h e foregoing p r o ­ 2 5 visions of this A c t . ( 3 ) A n y notice u n d e r subsection ( 1 ) of the said section t w o , a n d a n y c o n d i t i o n i m p o s e d b y such a notice shall, unless p r e v i o u s l y cancelled or r e v o k e d u n d e r s u b s e c t i o n ( 4 ) of t h a t sec­ 3 5 tion, cease to h a v e effect if the p e r s o n t o w h o m it relates a g a i n l a n d s or seeks t o l a n d i n t h e U n i t e d K i n g d o m a n d is o n t h a t occa­ sion e x a m i n e d in p u r s u a n c e of P a r t I of t h e said First Schedule. ( 4 ) I n this section, a n d in P a r t I I of t h e said F i r s t S c h e d u l e , " m e m b e r of t h e c r e w " , in r e l a t i o n to a ship or aircraft, m e a n s 4 0 a n y p e r s o n a c t u a l l y e m p l o y e d i n the w o r k i n g or service of t h e ship or aircraft, i n c l u d i n g t h e m a s t e r of t h e ship or c o m m a n d e r of t h e aircraft. (3) If a n y p e r s o n — (a) m a k e s o r causes t o b e m a d e to a n y i m m i g r a t i o n officer or o t h e r person lawfully a c t i n g i n t h e execution of this P a r t of this A c t , a n y false r e t u r n , false s t a t e m e n t o r false r e p r e s e n t a t i o n ; o r 25 (b) refuses t o p r o d u c e to a n y such officer o r p e r s o n a n y d o c u m e n t , o r t o furnish h i m with a n y i n f o r m a t i o n , w h i c h t h e said officer o r person m a y r e a s o n a b l y require for t h e p u r p o s e s of this P a r t of this A c t , o r otherwise o b s t r u c t s a n y such officer o r p e r s o n in t h e exercise of 30 his functions t h e r e u n d e r ; o r (c) w i t h o u t lawful authority, alters a n y v o u c h e r o r o t h e r d o c u m e n t issued o r m a d e u n d e r or for t h e p u r p o s e s of this P a r t of this A c t , o r uses for t h e p u r p o s e s of this P a r t of. this A c t , o r h a s in his possession for such u s e , 35 a n y forged, altered o r irregular v o u c h e r , p a s s p o r t o r other document, he shall b e guilty of a n offence. (4) If a n y person acts in c o n t r a v e n t i o n of, o r fails to c o m p l y with, a n y provision of t h e First Schedule t o this A c t , o r of a n y 4 0 order m a d e , directions given or r e q u i r e m e n t i m p o s e d t h e r e u n d e r , h e shall b e guilty of a n offence (5) F o r the p u r p o s e s of the trial of a p e r s o n for a n y offence under this section, t h e offence shall b e d e e m e d t o h a v e b e e n c o m m i t t e d either a t t h e p l a c e a t w h i c h it actually w a s c o m m i t t e d 45 or at a n y place a t w h i c h t h e offender m a y b e . (6) A c o n s t a b l e or i m m i g r a t i o n officer m a y arrest w i t h o u t w a r r a n t a n y p e r s o n w h o m he h a s . r e a s o n a b l e g r o u n d s to believe to h a v e c o m m i t t e d a n offence u n d e r subsection (1) of this section. PART I (7) A p e r s o n guilty of a n offence u n d e r this section shall be 5 liable o n s u m m a r y conviction t o a fine n o t exceeding o n e h u n d r e d p o u n d s or to i m p r i s o n m e n t for a t e r m n o t exceeding six m o n t h s or t o b o t h . PART II DEPORTATION 10 5.—(1) T h i s P a r t of this A c t shall h a v e effect for authorising Application the d e p o r t a t i o n f r o m the U n i t e d K i n g d o m of C o m m o n w e a l t h of Part II. citizens to w h o m it a p p l i e s , w h o a r e convicted of offences p u n i s h a b l e w i t h i m p r i s o n m e n t a n d r e c o m m e n d e d b y the c o u r t for d e p o r t a t i o n . 15 ( 2 ) T h i s P a r t of this A c t applies t o a n y C o m m o n w e a l t h citizen n o t b e i n g — (a) a p e r s o n b o r n in the U n i t e d K i n g d o m , or w h o s e father w a s b o r n in the U n i t e d K i n g d o m , or of w h o s e p a r e n t s either o r b o t h w a s ordinarily resident in t h e U n i t e d 20 K i n g d o m a t the time of his b i r t h ; (b) a p e r s o n w h o b e c a m e a C o m m o n w e a l t h citizen by being n a t u r a l i s e d i n t h e U n i t e d K i n g d o m or b y b e i n g a d o p t e d in the U n i t e d K i n g d o m , or b y b e i n g registered in the U n i t e d K i n g d o m as a citizen of the U n i t e d K i n g d o m 25 a n d C o l o n i e s u n d e r section seven of the British N a t i o n a l i t y A c t , 1948 ; or (c) the wife of a p e r s o n satisfying the c o n d i t i o n s specified in p a r a g r a p h (a) o r p a r a g r a p h (b) of this subsection. (3) T h e references in subsection (2) of this section to t h e 30 U n i t e d K i n g d o m shall b e construed as i n c l u d i n g references t o the C h a n n e l I s l a n d s a n d t h e Isle of M a n . (4) T h i s P a r t of this A c t shall a p p l y t o British p r o t e c t e d per­ sons a n d citizens of the R e p u b l i c of I r e l a n d as it applies to C o m m o n w e a l t h citizens. . ­ 6.—(1) Subject to the provisions of this section, where a C o m m o n w e a l t h citizen to w h o m t h i s P a r t of this A c t applies, a n d w h o h a s a t t a i n e d the age of seventeen years, is convicted of a n offence p u n i s h a b l e with, i m p r i s o n m e n t , the c o u r t by or before w h i c h h e is. convicted, o r a n y c o u r t t o w h i c h his case 4 0 is b r o u g h t b y w a y of a p p e a l against c o n v i c t i o n o r sentence, m a y r e c o m m e n d t h a t a d e p o r t a t i o n order b e m a d e i n respect of h i m . 35 Power of court to recommend for deportation, 01 (2) N o r e c o m m e n d a t i o n u n d e r this section (in this P a r t of this A c t referred t o as a r e c o m m e n d a t i o n for d e p o r t a t i o n ) shall b e m a d e u p o n the conviction of a n offender w h o — (a) is o r d i n a r i l y resident in the U n i t e d K i n g d o m on t h e d a t e of his conviction ; a n d 5 (b). h a s b e e n so resident for a t least five y e a r s before t h a t date; a n d for t h e p u r p o s e s of this subsection a p e r i o d of residence in a n y of the C h a n n e l Islands o r t h e Isle of M a n shall b e t r e a t e d as a p e r i o d of residence in the U n i t e d K i n g d o m , b u t in 10 c a l c u l a t i n g the p e r i o d for w h i c h a n y p e r s o n h a s b e e n so resident n o a c c o u n t shall b e t a k e n of a n y c o n t i n u o u s p e r i o d of six m o n t h s or m o r e d u r i n g w h i c h h e h a s b e e n d e t a i n e d u n d e r a sentence or order p a s s e d o r m a d e b y a n y c o u r t o n a conviction of a n offence. (3) N o r e c o m m e n d a t i o n for d e p o r t a t i o n shall b e m a d e in 15 r e s p e c t of a n offender unless a notice h a s b e e n given t o h i m a t least three d a y s before t h e r e c o m m e n d a t i o n is m a d e — (a) describing the classes of p e r s o n s in r e s p e c t of w h o m such a r e c o m m e n d a t i o n m a y b e m a d e ; a n d (b) c o n t a i n i n g a s t a t e m e n t of t h e effect of subsection (6) of 20 this section ; a n d the p o w e r of a d j o u r n m e n t conferred b y subsection (3) of section fourteen of the M a g i s t r a t e s ' Courts. A c t , 1952, shall i n c l u d e p o w e r to a d j o u r n , after convicting a n offender, for t h e p u r p o s e of e n a b l i n g such a notice t o b e given t o h i m or, if s u c h 2 5 a n o t i c e w a s given t o him less t h a n three d a y s previously, for t h e p u r p o s e of e n a b l i n g the necessary t h r e e days to e l a p s e . (4) W h e r e a p e r s o n c o n v i c t e d of a n offence by a n y c o u r t is c o m m i t t e d for sentence to a n o t h e r court, a n y p o w e r t o m a k e a r e c o m m e n d a t i o n for d e p o r t a t i o n in respect o f h i m shall b e exercisable by the c o u r t to w h i c h h e is c o m m i t t e d a n d n o t b y the c o u r t b y w h i c h h e is convicted. (5) F o r the p u r p o s e s of a n y e n a c t m e n t relating t o a p p e a l s in c r i m i n a l cases, a r e c o m m e n d a t i o n for d e p o r t a t i o n shall b e treated as an o r d e r m a d e o n c o n v i c t i o n ; a n d the validity of s u c h a r e c o m m e n d a t i o n shall n o t b e called in question e x c e p t o n a n a p p e a l a g a i n s t - t h e r e c o m m e n d a t i o n or a g a i n s t the con­ viction in c o n s e q u e n c e of w h i c h it is m a d e . (6) If a n y question arises w h e t h e r a p e r s o n is a C o m m o n ­ w e a l t h citizen to w h o m this P a r t of this A c t a p p l i e s or, b e i n g s u c h a citizen, is a p e r s o n i n r e s p e c t of w h o m a r e c o m m e n d a t i o n for d e p o r t a t i o n m a y b e m a d e u n d e r this section, it shall lie o n h i m to p r o v e t h a t he is n o t s u c h a citizen or p e r s o n ; a n d for t h e p u r p o s e s of this section the age of a n offender a t t h e time of his conviction shall b e d e e m e d to b e o r t o h a v e b e e n t h a t w h i c h a p p e a r s to the c o u r t , after considering a n y a v a i l a b l e e v i d e n c e , to b e o r t o h a v e b e e n his age a t t h a t time. 30 35 40 45 (7) I n this section " offence p u n i s h a b l e w i t h i m p r i s o n m e n t " includes a n offence w h i c h w o u l d b e so p u n i s h a b l e a p a r t from any e n a c t m e n t restricting the i m p r i s o n m e n t of y o u n g offenders or first offenders. 5 7.—(1) W h e r e a r e c o m m e n d a t i o n for d e p o r t a t i o n h a s b e e n m a d e i n respect of a n offender, t h e Secretary of S t a t e m a y , if h e thinks fit, m a k e in respect of him a d e p o r t a t i o n o r d e r , t h a t is to say a n o r d e r r e q u i r i n g h i m t o leave t h e U n i t e d K i n g d o m a n d pro­ hibiting h i m f r o m r e t u r n i n g there so l o n g a s t h e o r d e r is in 10 force. (2) A d e p o r t a t i o n o r d e r shall n o t b e m a d e u n d e r this section i n p u r s u a n c e of a r e c o m m e n d a t i o n for d e p o r t a t i o n unless either— (a) t h e t i m e for b r i n g i n g a n a p p e a l against the r e c o m m e n d a ­ 15 tion, or a g a i n s t the conviction u p o n w h i c h it was m a d e , has e x p i r e d w i t h o u t s u c h a n a p p e a l h a v i n g b e e n b r o u g h t ; or ib) such a n a p p e a l h a s b e e n b r o u g h t a n d a b a n d o n e d , or finally d e t e r m i n e d otherwise t h a n b y the q u a s h i n g of the 20 r e c o m m e n d a t i o n or the conviction ; or PART I I Deportation orders, (c) the r e c o m m e n d a t i o n was m a d e on a p p e a l a n d n o further a p p e a l lies. (3) T h e S e c r e t a r y of S t a t e m a y , if he thinks fit, r e v o k e a d e p o r t a t i o n o r d e r a t a n y t i m e , w h e t h e r before o r after the p e r s o n 25 to w h o m it relates h a s left or b e e n r e m o v e d f r o m the U n i t e d K i n g d o m , b u t the r e v o c a t i o n of a d e p o r t a t i o n o r d e r shall n o t affect t h e validity of a n y t h i n g previously d o n e t h e r e u n d e r . 8. T h e p r o v i s i o n s of the Second Schedule to this A c t shall Supplementary h a v e effect w i t h respect to t h e r e m o v a l from t h e U n i t e d K i n g d o m provisions as to 30 of p e r s o n s in respect of w h o m d e p o r t a t i o n orders a r e m a d e , a n d w i t h respect t o the d e t e n t i o n or c o n t r o l of p e r s o n s in respect of w h o m r e c o m m e n d a t i o n s for d e p o r t a t i o n or d e p o r t a t i o n orders a r e i n force. e p o r a l o r u 9.—(1) If a n y p e r s o n in respect of Whom a d e p o r t a t i o n order Offences in 35 is in force ' connection (a) h a v i n g left t h e U n i t e d K i n g d o m after t h e c o m i n g into ^on orders^ force of the o r d e r , subsequently r e t u r n s to the U n i t e d Kingdom ; or (b) h a v i n g b e e n p l a c e d o n b o a r d a ship or aircraft u n d e r 40 the S e c o n d S c h e d u l e to this A c t , l a n d s f r o m t h a t ship or a i r c r a f t before it has left the U n i t e d K i n g d o m , h e shall toe guilty of a n offence; a n d a n y offence u n d e r this subsection shall b e d e e m e d t o c o n t i n u e t h r o u g h o u t a n y p e r i o d d u r i n g w h i c h the offender is in t h e U n i t e d K i n g d o m after its 45 c o m m i s s i o n . 137 B 59 (2) If a n y p e r s o n u p o n w h o m a n y restriction o r r e q u i r e m e n t is i m p o s e d u n d e r p a r a g r a p h 2 of t h e S e c o n d Schedule to this A c t fails to c o m p l y with t h a t restriction or r e q u i r e m e n t , h e shall be guilty of a n offence. . (3) W h e r e a p e r s o n in r e s p e c t of w h o m a d e p o r t a t i o n o r d e r is in force is convicted of a n offence u n d e r s u b s e c t i o n (1) of this section, t h e d e p o r t a t i o n o r d e r shall cease t o h a v e effect, b u t w i t h o u t p r e j u d i c e t o t h e p o w e r to m a k e a r e c o m m e n d a t i o n for d e p o r t a t i o n u p o n t h a t conviction. 5 (4) If a n y p e r s o n k n o w i n g l y h a r b o u r s a n y p e r s o n w h o m he 10 k n o w s o r h a s r e a s o n a b l e g r o u n d s for believing to h a v e c o m m i t t e d an offence u n d e r subsection (1) of this section, h e shall b e guilty 0 1 a n offence. (5) F o r the p u r p o s e s of the trial of a p e r s o n for a n y offence u n d e r this section, the offence shall b e d e e m e d to h a v e b e e n com- 15 m i t t e d either a t t h e p l a c e at which it a c t u a l l y w a s c o m m i t t e d or a t a n y place at w h i c h t h e offender m a y be. (6) A c o n s t a b l e or i m m i g r a t i o n officer m a y a r r e s t w i t h o u t w a r r a n t a n y p e r s o n w h o m he h a s r e a s o n a b l e g r o u n d s to believe to h a v e c o m m i t t e d a n offence u n d e r subsection (1) or sub- 20 section (2) of this section. (7) A p e r s o n guilty of a n offence u n d e r this section shall be liable o n s u m m a r y c o n v i c t i o n t o a line n o t e x c e e d i n g one h u n d r e d p o u n d s o r to i m p r i s o n m e n t for a t e r m n o t e x c e e d i n g six m o n t h s or t o b o t h . 25 PART III M I S C E L L A N E O U S AND G E N E R A L 1 0 . — ( 1 ) Subsection (1) of section six of the British N a t i o n a l i t y A c t , 1948 (which relates to t h e r e g i s t r a t i o n a s citizens of the U n i t e d K i n g d o m a n d C o l o n i e s of certain C o m m o n w e a l t h citizens 30 a n d citizens of t h e R e p u b l i c of I r e l a n d ) shall b e a m e n d e d as follows— (a) i n p a r a g r a p h (a) ( u n d e r w h i c h the r i g h t to b e registered arises at the e n d of twelve m o n t h s ' o r d i n a r y r e s i d e n c e - in the U n i t e d K i n g d o m , or such shorter p e r i o d of 35 r :--.:') . o r d i n a r y residence t h e r e as the Secretary of State m a y -" in t h e special c i r c u m s t a n c e s of a n y p a r t i c u l a r case accept), for the w o r d s " t w e l v e m o n t h s " there shall b e substituted t h e w o r d s " f i v e y e a r s " ; a n d , , (W i n p a r a g r a p h (/;). (which oonfers the said right o n a n y , p e r s o n w h o is i n C r o w n service u n d e r H e r Majesty's g o v e r n m e n t in, t h e U n i t e d K i n g d o m ) , after the w o r d . ; " K i n g d o m " there shah b e a d d e d the w o r d s " a n d 1 h a s b e e n in s u c h service t h r o u g h o u t the p e r i o d of twelve m o n t h s , o r such shorter p e r i o d as the Secretary of State m a y in the special circumstances of any p a r ­ ticular case a c c e p t , immediately preceding his application." 5 PART n i ( 2 ) A , p e r s o n in r e s p e c t of w h o m a r e c o m m e n d a t i o n for d e p o r t a t i o n or d e p o r t a t i o n o r d e r u n d e r P a r t I I of this A c t is for the t i m e being in force shall n o t b e entitled to be registered as a citizen of the U n i t e d K i n g d o m a n d Colonies u n d e r sub­ 1 0 section ( 1 ) of the said section s i x ; b u t the Secretary of State m a y , if h e thinks fit, register u n d e r t h a t subsection a n y p e r s o n w h o w o u l d b e entitled to b e so registered b u t for this subsection. ( 3 ) A n y p e r s o n w h o within six m o n t h s after the d a t e of t h e p a s s i n g of this A c t m a k e s a p p l i c a t i o n for registration u n d e r 1 5 subsection ( 1 ) of the said section six shall b e entitled to registra­ tion t h e r e u n d e r as if s u b s e c t i o n ( 1 ) of this section h a d n o t b e e n e n a c t e d if h e satisfies the Secretary of State either-— 2 0 25 (a) t h a t he w a s ordinarily r e s i d e n t in t h e U n i t e d K i n g d o m o n that date and h a d b e e n s o resident t h r o u g h o u t the p e r i o d of twelve m o n t h s e n d i n g with t h a t d a t e , or s u c h shorter p e r i o d so e n d i n g as t h e Secretary of State m a y in the special c i r c u m s t a n c e s of a n y p a r t i c u l a r case accept; or (b) t h a t he w a s in C r o w n service u n d e r H e r Majesty's g o v e r n m e n t in t h e U n i t e d K i n g d o m o n that d a t e ; a n d subsection ( 2 ) of section t h r e e of the British N a t i o n a l i t y A c t , 1 9 5 8 (which e x t e n d s the p o w e r of the Secretary of State to register p e r s o n s u n d e r subsection ( 1 ) of t h e said section six) shall h a v e effect a c c o r d i n g l y . 30 ( 4 ) T h i s section shall b e c o n s t r u e d a s o n e w i t h t h e British Nationality Act, 1 9 4 8 . 1 1 — ( 1 ) A n y p e r s o n s r e q u i r e d or a u t h o r i s e d to b e d e t a i n e d General u n d e r this A c t m a y b e d e t a i n e d i n such places as the Secretary provisions as of S t a t e m a y direct. 35 i(2) W h e r e a p e r s o n is d e t a i n e d b y virtue of this A c t , a n y imrni­ g r a t i o n officer, c o n s t a b l e o r p r i s o n officer, or any other person a u t h o r i s e d b y the Secretary of State, m a y t a k e all s u c h steps as m a y b e r e a s o n a b l y necessary for p h o t o g r a p h i n g , m e a s u r i n g or o t h e r w i s e identifying h i m . 40 ( 3 ) A n y p e r s o n detained b y v i r t u e of this A c t , a n d a n y p e r s o n w h o , b e i n g d e t a i n e d i n p u r s u a n c e of the sentence or o r d e r of a c o u r t , w o u l d o t h e r w i s e b e liable to b e s o d e t a i n e d , m a y b e t a k e n in the c u s t o d y of a c o n s t a b l e to a n d f r o m a n y place w h e r e h i s 1 3 7 B2 Wi PART I I I a t t e n d a n c e is r e q u i r e d for t h e p u r p o s e of a s c e r t a i n i n g his citizen­ ship, or of m a k i n g a r r a n g e m e n t s for his a d m i s s i o n t o a n y c o u n t r y o r territory. (4) A n y p e r s o n r e q u i r e d o r a u t h o r i s e d b y this A c t t o b e d e t a i n e d m a y b e arrested w i t h o u t w a r r a n t b y a constable or a n i m m i g r a t i o n officer ; a n d a n y such p e r s o n w h o is so d e t a i n e d , o r is being r e m o v e d i n p u r s u a n c e of this seotion, shall b e d e e m e d t o be i n legal custody. 5 Appointment 12—(1) I m m i g r a t i o n officers for t h e p u r p o s e s of this A c t and powers of shall b e a p p o i n t e d b y the Secretary of State, a n d t h e Secretary of 10 immigration State m a y a r r a n g e w i t h t h e C o m m i s s i o n e r s of C u s t o m s a n d officers, etc. Excise for t h e e m p l o y m e n t of officers of C u s t o m s a n d E x c i s e a s i m m i g r a t i o n officers u n d e r this A c t . (2) I n the exercise of their functions u n d e r this A c t , i m m i g r a ­ t i o n officers shall aot in a c c o r d a n c e w i t h such instructions a s 1 5 m a y b e given b y the Secretary of State. (3) M e d i c a l inspectors for the p u r p o s e s of this A c t m a y b e a p p o i n t e d b y t h e Minister of H e a l t h in p u r s u a n c e of a r r a n g e ­ m e n t s m a d e b e t w e e n t h a t M i n i s t e r a n d t h e Secretary of State ; a n d s u c h inspectors shall, in t h e exercise of their functions u n d e r 20 this A c t , a c t in a c c o r d a n c e with s u c h instructions as m a y b e given b y t h a t Minister i n p u r s u a n c e of such a r r a n g e m e n t s as aforesaid. (4) A n i m m i g r a t i o n officer or m e d i c a l inspector m a y b o a r d a n y s h i p for the p u r p o s e of exercising a n y of his functions u n d e r 2 5 this A c t . General provisions as to orders, directions etc. 13—(1) A n y p o w e r to m a k e o r d e r s or give directions u n d e r this A c t includes power t o r e v o k e or v a r y such o r d e r s or directions. (2) A n y d o c u m e n t p u r p o r t i n g to b e a n order, notice o r direc- 30 tion m a d e or given' b y the Secretary of State for t h e p u r p o s e s of this A c t , a n d t o b e signed b y h i m or o n his behalf, shall b e received i n evidence, a n d s h a l l , u n t i l the c o n t r a r y is p r o v e d , b e d e e m e d to b e m a d e or issued b y h i m . (3) P r i m a facie evidence of a n y s u c h order, notice or d i r e c t i o n 35 as aforesaid m a y , i n a n y legal p r o c e e d i n g s , b e given b y t h e p r o d u c t i o n of a d o c u m e n t b e a r i n g a certificate p u r p o r t i n g t o b e signed b y or o n behalf of the Secretary of State a n d stating that t h e d o c u m e n t is a true c o p y of t h e order, notice or direction. Expenses, 15 Persons excepted from co^o^and deportation. 5 1 5 . Isle of Man. visions of this A c t o t h e r t h a n section ten a n d this section shall 35 e x t e n d , w i t h such exceptions, a d a p t a t i o n s a n d m o d i f i c a t i o n s , if a n y , a s m a y b e specified in t h e O r d e r , to t h e Isle of M a n o r a n y of t h e C h a n n e l I s l a n d s ; a n d a n y O r d e r i n C o u n c i l u n d e r this section m a y in p a r t i c u l a r direct t h a t , for t h e p u r p o s e s of t h e e x t e n s i o n a s aforesaid of a n y such p r o v i s i o n specified in the 40 o r d e r , a n y reference t o the U n i t e d K i n g d o m shall b e c o n s t r u e d a s or a s including a reference t o any of those islands. Short title, interpretation and com­ mencement. 18.—(1) T h i s A c t m a y b e cited a s t h e C o m m o n w e a l t h I m m i ­ grants Act, 1961. (2) I n this A c t t h e following expressions h a v e t h e m e a n i n g s PART I I I h e r e b y respectively assigned to t h e m , t h a t is t o s a y , — " C o m m o n w e a l t h citizen n o t b e l o n g i n g to t h e U n i t e d K i n g d o m " h a s the m e a n i n g assigned b y section o n e of 5 this A c t ; " i m m i g r a n t " m e a n s a C o m m o n w e a l t h citizen n o t belonging to t h e U n i t e d K i n g d o m w h o h a s l a n d e d or seeks to l a n d in t h e U n i t e d K i n g d o m ; " p o r t " i n c l u d e s any p l a c e w h e r e a p e r s o n l a n d s or e m b a r k s 10 in t h e U n i t e d K i n g d o m ; " s h i p " includes every description of vessel u s e d in navigation; a n d s u b s e c t i o n (5) of section thirty-two of the British N a t i o n a l i t y A c t , 1948 (which relates to p e r s o n s b o r n a b o a r d ships o r air­ 15 craft) shall a p p l y for the p u r p o s e of this A c t as it applies for the p u r p o s e of t h a t A c t . (3) T h i s A c t shall c o m e i n t o o p e r a t i o n on s u c h d a t e a s the Secretary of State m a y b y o r d e r a p p o i n t ; a n d different dates m a y b e a p p o i n t e d b y o r d e r u n d e r this section for different 20 p u r p o s e s of this Act. SCHEDULES FIRST SCHEDULE SUPPLEMENTARY PROVISIONS AS TO CONTROL O F IMMIGRATION PART GENERAL I PROVISIONS 5 Examination of persons landing in the United Kingdom 1 . — ( 1 ) Subject to the provisions of this paragraph, an immigration officer may examine any person who lands or seeks to land in the United Kingdom for the purpose of ascertaining whether that person is or is not a Commonwealth citizen not belonging to the United 1 0 Kingdom, and if so for the purpose of determining what action, if any, should be taken in his case under Part I of this A c t ; and it shall be the duty of every such person to furnish to an immigration officer such information as that officer may require for the purpose of his functions under this paragraph. 15 1 ( 2 ) A person shall not be required to submit to examination under this paragraph after the expiration of the period of twenty-four hours from the time when he lands in the United Kingdom unless, upon being examined within that period, he is required by an immigration officer to submit to further examination. 20 ( 3 ) A n y person liable to be examined by an immigration officer under the foregoing provisions of this paragraph shall, if directed to do so by such an officer in the course of his examination— (a) declare whether or not he is carrying or conveying any documents; 25 (U) produce to the officer any documents which he is carrying or conveying. ( 4 ) T h e power to examine a person seeking to land in the United Kingdom conferred on an immigration officer by the said provisions shall include power to search him and any baggage belonging to 3 0 him or under his control with a view to ascertaining whether he is carrying or conveying any documents ; and the immigration officer may examine, and may detain for such time as he thinks proper for the purposes of examination, any documents produced to him or found on such a search. 35 (5) T h e powers of a n immigration officer under this p a r a g r a p h may be exercised also by a medical inspector, and references in this paragraph to examination shall be construed accordingly. General provisions as to refusal of admission and admission subject to conditions 40 2 . — ( 1 ) A notice under subsection ( 1 ) of section two of this Act shall not be given to any person later than twelve hours after the conclusion of his examination under paragraph 1 of this Schedule. ( 2 ) Any such notice as aforesaid shall be in writing and, subject to sub-paragraph ( 3 ) of this paragraph shall be delivered by the im- 45 migration officer to the immigrant to whom it relates. (3) Where an immigrant w h o is t o be admitted into the United 1ST SCH. Kingdom subject to conditions is a member of a party in the charge of a person appearing to the immigration officer to b e a responsible person, the notice shall be duly given if given to the person in charge 5 of the party. (4) The power of the Secretary of State to vary conditions im­ posed by a notice under section two of this Act m a y be exercised either by notice in writing to any immigrant to whom such a condition applies or by order applying to immigrants of any class to whom 1 0 such conditions for the time being apply. 15 2 0 2 5 30 35 4 0 Removal of immigrants on refusal of admission 3 . — ( 1 ) Where an immigrant is refused admission into the United Kingdom a n immigration officer may, subject to sub-paragraph (2) of this paragraph, give directions— (a) to the master of the ship or commander of the aircraft in which the immigrant arrived in the United Kingdom, re­ quiring him to remove the immigrant from the United Kingdom in that ship or aircraft; or (b) to the owners or agents of the said ship or aircraft, re­ quiring them to remove the immigrant from the United Kingdom in any ship or aircraft specified i n the directions, being a ship or aircraft of which they are the owners or a g e n t s ; or (c) to t h e said owners or agents, requiring them to make arrangements for the removal of the immigrant from the United Kingdom in any ship or aircraft bound for a country or territory specified in the directions, being either— (i) a country of which the immigrant is a citizen; or (ii) a country or territory in which h e has obtained a passport or other document of identity; or (iii) a country or territory in which h e embarked for the United Kingdom ; or (iv) a country or territory to which there is reason to believe that the immigrant will be admitted, and for securing h i m a passage to that country or territory. (2) N o directions shall be given under this paragraph in respect of an immigrant after the expiration of two months beginning with the date on which h e arrived in the United Kingdom. (3) A n immigrant in respect of whom directions are given under sub-paragraph ( 1 ) of this paragraph m a y be placed, under the authority of an immigration officer, on b o a r d any ship or aircraft in which he is to be removed in accordance with the directions. Detention of immigrants pending further examination or removal 4 . — ( 1 ) A n immigrant who is required to submit to further exami­ 45 nation under this Schedule, or w h o is refused admission into the United Kingdom under section t w o of this Act, m a y be detained under the authority of an immigration officer or constable pending ' 1 6 1ST SCH. Commonwealth Immigrants 9 & 1 0ELIZ. 2 that further examination, or pending the giving of directions under paragraph 3 of this Schedule and pending removal in pursuance of such directions, as the case may be ; and where any such immigrant is o n board a ship or aircraft, h e may, under t h e like authority, be removed therefrom for detention under this paragraph. 5 (2) The master of a ship shall, if so required by an immigration officer, take such steps as may be necessary for preventing— (a) an immigrant who arrived in the ship and to whom ad­ mission into the United Kingdom has been refused ; or (b) an immigrant who has been placed on board the ship under 1 0 paragraph 3 of this Schedule, from landing from the ship before it leaves the United K i n g d o m ; and for that purpose the master may detain the immigrant in custody on board the ship. (3) The commander of an aircraft shall, if so required by an im- 1 5 migration officer take such steps as may be necessary for preventing an immigrant who has been placed on board the aircraft under paragraph 3 of this Schedule from landing from the aircraft before it leaves the United Kingdom ; and for that purpose the commander may detain the immigrant in custody on board the aircraft, 20 Landing and embarkation cards 5 . — ( 1 ) T h e Secretary of State may by order m a k e provision for requiring passengers landing or embarking in the United Kingdom, or any class of such passengers, to produce t o a n immigration officer, if so required, landing or embarkation cards in such form 2 5 as the Secretary of State m a y direct, and for requiring the owners or agents of ships and aircraft to supply such cards to those passengers. (2) The power of the Secretary of State to m a k e orders under this p a r a g r a p h shall be exercisable by statutory instrument. 30 PART I I SPECIAL P R O V I S I O N S AS TO C R E W S OF S H I P S AND A I R C R A F T AND STOWAWAYS , British seaman's cards -. ; : M r 6 . - ( 1 ) If a Commonwealth citizen who holds a British seaman's 3 5 card arrives in the United K i n g d o m a s a member of the crew of a' ship, that card shall be treated for the purposes of section one of this. Act as a passport issued by the government of the United Kingdom. (2) In this paragraph " British seaman's card " means a card issued under any order "in force under section four of the Emergency Laws 4 0 (Miscellaneous Provisions) Act, 1 9 5 3 , or any card having effect as a Card SO issued. . . 1 K, - ; : ' - ' ^ 1 ; Examination of crews 7 . — ( 1 ) A n immigration officer may examine under p a r a g r a p h 1 of this Schedule any person w h o arrives at a port in the United K i n g d o m as a member of the crew of a ship, whether or not h e 5 lands or seeks to land in the United Kingdom and the provisions of that p a r a g r a p h shall apply t o any such person as they apply to persons landing o r seeking to l a n d in the United Kingdom. 1ST SCH. (2) T h e Secretary of State m a y by order m a k e provision for requiring the masters of ships a n d commanders of aircraft arriving 10 at ports in the United Kingdom to furnish to immigration officers particulars of the members of the crews of those ships or aircraft, a n d for enabling an immigration officer to dispense with the furnish­ ing of such particulars. ( 3 ) T h e power of the Secretary of State to make orders u n d e r 15 s u b - p a r a g r a p h (2) of this p a r a g r a p h shall be exercisable by statutory instrument. Seamen overstaying shore leave 8 . — ( 1 ) If any Commonwealth citizen not belonging t o the United Kingdom— 20 (a) arrives at a port in the United Kingdom as a member of the crew of a ship, not being a ship which began its voyage at a place in t h e United Kingdom, any of the Channel Islands or the Isle of M a n and has not during the voyage called at any place outside those countries; and 25 (b) remains in the United Kingdom after his ship has left the port and without having been examined by an immigration officer under paragraph 1 of this Schedule, h e shall, subject to the following provisions of this paragraph, be treated for the purposes of this Act as if he had been refused admis­ 30 sion to the United Kingdom. (2) A n immigration officer may, by notice given at any time to any such Commonwealth citizen as aforesaid, authorise him to remain in the United Kingdom either without conditions or subject to any such conditions as could be imposed by notice under section two of this Act, including in particular conditions requiring him to leave the United Kingdom in a specified ship or to leave the United Kingdom within a specified period in accordance with arrangements for his repatriation ; and where such a notice is given to any person, h e shall not be treated as a person to whom admission to the United 40 Kingdom has been refused unless, in the case where h e is subject t o conditions requiring h i m to leave the United Kingdom as afore­ said, he fails to comply or is reasonably suspected of intending to fail to comply with those conditions. 4 : 5 ( 3 ) I n relation to any person to whom it applies by virtue of this paragraph, paragraph 3 of this Schedule shall have effect as if sub-paragraph (2) of that paragraph were omitted. (4) A n y conditions imposed under this paragraph may at any time b e revoked or varied by the Secretary of State ; and sub-paragraph 137 D IP 1ST SCH. ( 4 ) of paragraph 2 of this Schedule shall apply in relation to any conditions so imposed as it applies in relation t o conditions imposed by a notice under section two of this Act. Stowaways 9.—(1) T h e provisions of paragraph 8 of this Schedule shall, 5 subject to the provisions of this paragraph, apply to any CommonWealth citizen not belonging to the United Kingdom w h o arrives at a port in the United Kingdom as a stowaway in a ship as they apply in relation to any such citizen who arrives at such a port as a member of the crew of a ship. 10 ( 2 ) In relation to any person to whom it applies b y virtue of this paragraph, sub-paragraph (1) of the said p a r a g r a p h 8 shall have effect as if p a r a g r a p h (b) were omitted. SECOND SCHEDULE SUPPLEMENTARY PROVISIONS AS TO DEPORTATION Removal of persons subject to deportation 15 orders 1 . — ( 1 ) T h e Secretary of State, or any person acting under his authority m a y give directions to the master of any ship or com­ mander of any aircraft which is about to leave the United Kingdom, requiring him to afford to any person against whom a deportation 2 0 order is in force, and to any dependants of his specified in the directions, a passage to any port so specified (being a port at which the ship or aircraft is to call or land in the course of the voyage) and proper accommodation and maintenance during the passage. 25 ( 2 ) A person in respect of whom directions are given under sub­ paragraph (1) of this paragraph may be placed, under the authority of the Secretary of State, on board any ship or aircraft in which he is to be removed in accordance with the directions. ( 3 ) The Secretary of State may, if he thinks fit, apply in or towards 3 0 payment of the expenses of or incidental to the voyage from the United Kingdom of a person against whom a deportation order is in force, or the maintenance until departure of such a person and his dependants, if any, any money belonging to that person. Detention and control of persons subject to deportation 35 2.—(1) Where a recommendation for deportation is in force in respect of an offender and the offender is neither detained in pursuance of the sentence or order of any court nor for the time being released on bail by any court having power so t o release him, he shall, unless the court by which the recommendation is 4 0 made otherwise directs, be detained under the authority of the Secretary of State until the Secretary of State e i t h e r ­ (a) makes a deportation order in respect of him ; or m (b) notifies him that no such order is to be made ; or (c) directs him to b e released pending further consideration of of his case. (2) Where a deportation order is in force in respect of an offender, 5 the offender may be detained under the authority of the Secretary of State until h e is rernoived from the United Kingdom pursuant to this Schedule. (3) The master of a ship or commander of an aircraft shall, if so required by a person acting under the authority of the Secretary 10 of State, take such steps as may be necessary for preventing any person placed on board the ship or aircraft under paragraph 1 of this Schedule from landing from the ship or aircraft before it leaves the United Kingdom ; and for that purpose the master or commander may detain the said person in custody on board the ship or aircraft. 15 (4) Where a person is released from detention by direction of jthe Secretary of State under sub-paragraph (1) of this paragraph pending further consideration of his case, or, being liable to be detained under sub-paragraph (2) of this paragraph, is not for the time being so detained, the Secretary of State may by order impose 20 on him such restrictions as to his place of residence, and such re­ quirements as to reporting to the police, as the Secretary of State thinks fit. 2ND SCH.
