It w a s also p r o p o s e d t h a t t h e P r i m e M i n i s t e r , in c o m p a n y w i t h t h e C h a n c e l l o r of the E x c h e q u e r a n d the M i n i s t e r of L a b o u r , s h o u l d discuss w i t h r e p r e s e n t a t i v e s of t h e T r a d e s U n i o n C o n g r e s s (T.U.C.) t h e m e a s u r e s w h i c h t h e G o v e r n m e n t h a d f o u n d it n e c e s s a r y t o t a k e t o r e m e d y t h e e c o n o m i c s i t u a t i o n . The Prime Minister r e c a l l e d t h a t o n 11th J a n u a r y the Cabinet had agreed that, despite the objections which the R o y a l Fine A r t C o m m i s s i o n h a d r a i s e d t o t h e d e m o l i t i o n of t h e C o l l c u t t b u i l d i n g , t h e G o v e r n m e n t s h o u l d p r o c e e d w i t h their p l a n for c o n s t r u c t i n g o n this site n e w a n d e n l a r g e d p r e m i s e s for t h e I m p e r i a l C o l l e g e of Science. I t h a d n o w b e e n s u g g e s t e d to h i m t h a t the F i n a n c i a l S e c r e t a r y , T r e a s u r y , s h o u l d h o l d a m e e t i n g w i t h r e p r e s e n t a t i v e s of t h e C o m m i s s i o n a n d of t h e U n i v e r s i t y a u t h o r i t i e s c o n c e r n e d w i t h a v i e w t o e x p l a i n i n g t h e g r o u n d s for t h e G o v e r n m e n t s decision a n d p e r s u a d i n g t h e C o m m i s s i o n t o w i t h d r a w t h e i r o b j e c t i o n s t o it. The G o v e r n m e n t w e r e a l r e a d y b e i n g criticised for failing to t a k e earlier s t e p s t o e x p a n d t h e facilities for t e c h n o l o g i c a l e d u c a t i o n . They s h o u l d n o t risk t h e c h a r g e of f u r t h e r d e l a y i n t h e e x e c u t i o n of their p l a n for e n l a r g i n g t h e I m p e r i a l College. I n discussion s o m e M i n i s t e r s e x p r e s s e d r e g r e t at t h e decision t o d e m o l i s h t h e C o l l c u t t b u i l d i n g . I t w a s a b u i l d i n g of s o m e a r c h i t e c t u r a l interest, a n d w a s a f e a t u r e of t h e L o n d o n skyline. O t h e r M i n i s t e r s e x p r e s s e d d i s q u i e t a b o u t t h e d e s i g n of t h e n e w b u i l d i n g w h i c h w a s t o t a k e its p l a c e . T h e y s u g g e s t e d t h a t this h a d little m e r i t in itself a n d w o u l d n o t b e c o n g r u o u s w i t h t h e s u r r o u n d i n g b u i l d i n g s . T h e y t h o u g h t it w o u l d b e wise t o c o n s i d e r a n y s u g g e s t i o n s w h i c h t h e F i n e A r t C o m m i s s i o n m i g h t h a v e t o m a k e for i m p r o v e m e n t of t h e design of t h e n e w b u i l d i n g . I n further discussion it w a s a g r e e d t h a t t h e r e m i g h t be a d v a n t a g e i n h o l d i n g a m e e t i n g w i t h r e p r e s e n t a t i v e s of the F i n e A r t C o m m i s s i o n , p r o v i d e d t h a t it w a s m a d e clear f r o m t h e o u t s e t t h a t t h e G o v e r n m e n t w e r e n o t p r e p a r e d t o m o d i f y t h e i r d e c i s i o n to d e m o l i s h t h e C o l l c u t t b u i l d i n g a n d t o build n e w p r e m i s e s for t h e I m p e r i a l College o n this site, a n d t h a t t h e d i s c u s s i o n s c o u l d n o t be a l l o w e d to d e l a y p r o g r e s s in t h e c o n s t r u c t i o n of t h e n e w b u i l d i n g . O n this u n d e r s t a n d i n g , h o w e v e r , t h e G o v e r n m e n t c o u l d offer to c o n s i d e r a n y c o m m e n t s w h i c h t h e F i n e A r t C o m m i s s i o n m i g h t wish t o m a k e o n t h e d e s i g n of t h e n e w b u i l d i n g . The Cabinet— Agreed that the Financial Secretary, Treasury, should be a u t h o r i s e d t o invite t h e c o m m e n t s of t h e R o y a l F i n e A r t C o m m i s s i o n o n t h e design of t h e n e w b u i l d i n g for t h e I m p e r i a l College of Science, o n t h e u n d e r s t a n d i n g t h a t t h e G o v e r n m e n t w e r e finally c o m m i t t e d t o p r o c e e d w i t h this p r o j e c t a n d t h a t this c o n s u l t a t i o n w i t h t h e C o m m i s s i o n w o u l d n o t b e a l l o w e d t o d e l a y its e x e c u t i o n . Egypt? 5 . The Foreign Secretary said t h a t h e w o u l d s h o r t l y b e m e e t i n g t h e P r i m e M i n i s t e r of E g y p t in C a i r o . S u b j e c t t o t h e C a b i n e f s views, R e f e r e n c e : h e p r o p o s e d , in his discussions w i t h C o l o n e l N a s s e r , to t a k e a firm C M . It was not to be e x p e c t e d t h a t , if E g y p t s h o w e d s u c h hostility t o w a r d s us, w e s h o u l d c o n t i n u e to t r e a t h e r as a friendly S t a t e a n d , for e x a m p l e , t o give h e r financial assistance t o w a r d s t h e c o n s t r u c t i o n of t h e A s w a n H i g h D a m . H i s object w o u l d b e t o m a k e it clear t h a t E g y p t c o u l d n o t e x p e c t f u r t h e r h e l p f r o m us unless she c h a n g e d h e r p o l i c y t o w a r d s u s . (Previous I n discussion it w a s p o i n t e d o u t t h a t o u r decision t o m a k e a financial c o n t r i b u t i o n t o w a r d s t h e c o n s t r u c t i o n of t h e A s w a n D a m h a d b e e n t a k e n , after full c o n s i d e r a t i o n , b e c a u s e it w a s t h o u g h t to b e in o u r interests t o p r e v e n t t h e Soviet G o v e r n m e n t f r o m o b t a i n i n g c o n t r a c t s w h i c h w o u l d give t h e m a f o o t h o l d in E g y p t . W e c o u l d n o t lightly w i t h d r a w f r o m this u n d e r t a k i n g a n d c e r t a i n l y c o u l d n o t d o so w i t h o u t p r i o r c o n s u l t a t i o n w i t h t h e U n i t e d S t a t e s G o v e r n m e n t . The Foreign Secretary said t h a t h e w a s n o t a s k i n g t h e C a b i n e t t o reverse t h e i r decision a b o u t t h e A s w a n D a m a n d w o u l d n o t p r o p o s e , in his f o r t h c o m i n g discussions, to t h r e a t e n t o w i t h d r a w t h e offer of British assistance in this p r o j e c t . H e n e e d n o t at this stage b e specific a b o u t t h e c o n s e q u e n c e s w h i c h w o u l d follow if the E g y p t i a n s failed t o m o d i f y their p o l i c y t o w a r d s u s . H e n e e d g o n o further at p r e s e n t t h a n t o e m p h a s i s e the c o m m o n a d v a n t a g e s t o b o t h c o u n t r i e s of a b e t t e r u n d e r s t a n d i n g a n d friendlier r e l a t i o n s b e t w e e n the U n i t e d K i n g d o m a n d E g y p t . The Capital Punishment. (Previous Reference : C M . (56) 10th Conclusions, M i n u t e 3.) I n t h e d e b a t e in t h e H o u s e of C o m m o n s o n 16th F e b r u a r y , t h e G o v e r n m e n t m o t i o n c o m m e n d i n g t h e r e t e n t i o n of c a p i t a l p u n i s h m e n t as the p e n a l t y for m u r d e r h a d b e e n d e f e a t e d , o n a free vote, b y 293 votes to 262. T h e C a b i n e t c o n s i d e r e d w h a t c o u r s e t h e G o v e r n m e n t s h o u l d n o w t a k e in t h e light of this e x p r e s s i o n of t h e view of t h e H o u s e of C o m m o n s . T h e y h a d b e f o r e t h e m a m e m o r a n d u m o n this q u e s t i o n b y t h e H o m e S e c r e t a r y ( C P . (56) 43). I n discussion of t h e H o m e following p o i n t s w e r e m a d e : — Secretary's memorandum the (a) T h e r e w a s g e n e r a l a g r e e m e n t that, as t h e G o v e r n m e n t h a d invited t h e H o u s e t o s u p p o r t a m o t i o n for t h e r e t e n t i o n of c a p i t a l p u n i s h m e n t , t h e y c o u l d n o t n o w i n t r o d u c e a G o v e r n m e n t Bill to abolish it. G o v e r n m e n t s u p p o r t e r s w h o h a d v o t e d in f a v o u r of the m o t i o n w o u l d b e u n w i l l i n g to s u p p o r t G o v e r n m e n t legislation t o t h e c o n t r a r y effect. (b) D o u b t s w e r e e x p r e s s e d a b o u t t h e e x p e d i e n c y of the a l t e r n a t i v e c o u r s e , suggested b y t h e H o m e S e c r e t a r y , of p r o v i d i n g G o v e r n m e n t t i m e for t h e p a s s a g e of t h e D e a t h P e n a l t y (Abolition) Bill w h i c h h a d been i n t r o d u c e d b y M r . S. S i l v e r m a n , M . P . T h i s Bill p r o v i d e d t h a t t h e d e a t h p e n a l t y for m u r d e r s h o u l d b e s u s p e n d e d for five y e a r s a n d t h a t after a further five y e a r s it s h o u l d b e a b o l i s h e d a l t o g e t h e r unless, in t h e i n t e r v e n i n g p e r i o d , p r a y e r s for its c o n t i n u a n c e h a d b e e n p a s s e d b y b o t h H o u s e s of P a r l i a m e n t . T h e H o u s e of C o m m o n s h a d n o w d e c l a r e d for t h e a b o l i t i o n of the p e n a l t y , a n d it w a s u n d e s i r a b l e t h a t legislation s h o u l d b e p a s s e d w h i c h w o u l d h a v e the effect of r e o p e n i n g t h e issue after a p e r i o d of five y e a r s . M i g h t it n o t b e p r e f e r a b l e t h a t t h e l e a d e r s of t h e L a b o u r O p p o s i t i o n s h o u l d t h e m s e l v e s p r o m o t e a Bill p r o v i d i n g for t h e a b o l i t i o n of t h e d e a t h p e n a l t y ? A s a g a i n s t this it w a s a r g u e d t h a t , if t h e p r i n c i p l e of M r . S i l v e r m a n ' s Bill w a s c o n f i r m e d o n S e c o n d R e a d i n g , it w o u l d be o p e n t o t h e G o v e r n m e n t t o m o v e in t h e C o m m i t t e e S t a g e a m e n d ­ m e n t s w h i c h w o u l d t r a n s f o r m t h e m e a s u r e i n t o o n e for t h e c o m p l e t e a b o l i t i o n of t h e d e a t h p e n a l t y . T h e r e w a s m u c h t o b e said for allowing t h e H o u s e of C o m m o n s to p r o c e e d w i t h this q u e s t i o n o n t h e basis of t h e Bill a l r e a d y b e f o r e t h e m . T h e G o v e r n m e n t w o u l d seem t o b e a s s u m i n g a g r e a t e r r e s p o n s i b i l i t y t h a n t h e y n e e d if they t o o k t h e initiative in inviting t h e l e a d e r s of t h e L a b o u r O p p o s i t i o n t o s p o n s o r a different f o r m of Bill. (c) T h i s s h o u l d b e t r e a t e d as a P r i v a t e M e m b e r ' s Bill. T h e G o v e r n m e n t s h o u l d p r o v i d e n o facilities for it, a p a r t from finding G o v e r n m e n t t i m e for its discussion. I n all p r o c e e d i n g s o n it G o v e r n m e n t s u p p o r t e r s s h o u l d b e allowed a free v o t e . (d) I n t h e H o u s e of L o r d s t h e r e w a s a great b o d y of a u t h o r i t a t i v e legal o p i n i o n in f a v o u r of r e t a i n i n g t h e d e a t h p e n a l t y . E v e n if this Bill s h o u l d p a s s t h e C o m m o n s , it w a s likely t o b e r e j e c t e d b y the L o r d s . P u b l i c o p i n i o n o n this q u e s t i o n w a s d i v i d e d a n d this w o u l d , t h e r e f o r e , b e a p r o p e r o c c a s i o n for t h e exercise of t h e p o w e r of t h e H o u s e of L o r d s t o d e l a y t h e p a s s a g e of legislation. T h e r e w e r e a l r e a d y i n d i c a t i o n s of a g r o w i n g v o l u m e of p u b l i c s u p p o r t for t h e r e t e n t i o n of t h e d e a t h p e n a l t y ; a n d it w a s t o b e e x p e c t e d t h a t this m o v e m e n t w o u l d g r o w d u r i n g t h e p e r i o d b e t w e e n t h e first r e j e c t i o n of t h e Bill b y t h e H o u s e of L o r d s a n d its s u b s e q u e n t p r e s e n t a t i o n to the U p p e r House. (e) The Prime Minister said t h a t s o m e G o v e r n m e n t s u p p o r t e r s h a d s u g g e s t e d t o h i m t h a t this issue s h o u l d b e d e c i d e d b y a r e f e r e n d u m . T o t h e s e s u g g e s t i o n s h e p r o p o s e d to r e p l y t h a t this w a s essentially a m a t t e r for d e c i s i o n b y P a r l i a m e n t itself a n d t h a t t h e h o l d i n g of a r e f e r e n d u m o n it w o u l d d e r o g a t e f r o m t h e s o v e r e i g n t y of P a r l i a m e n t . T h e C a b i n e t t h e n c o n s i d e r e d t h e t e r m s of t h e s t a t e m e n t w h i c h t h e H o m e S e c r e t a r y p r o p o s e d to m a k e a b o u t t h e exercise of t h e p r e r o g a t i v e of m e r c y in m u r d e r cases d u r i n g t h e i n t e r v a l b e f o r e a final d e c i s i o n o n this q u e s t i o n w a s t a k e n b y P a r l i a m e n t . T h e t e r m s of his p r o p o s e d s t a t e m e n t w e r e set o u t in p a r a g r a p h 4 of C P . (56) 4 3 . The Home Secretary s a i d t h a t , o n f u r t h e r reflection, h e t h o u g h t it m i g h t b e p r e f e r a b l e n o t to s t a t e t h a t , in d e c i d i n g w h e t h e r t o r e c o m m e n d t h e exercise of t h e p r e r o g a t i v e of m e r c y in a n y p a r t i c u l a r c a s e , h e w o u l d b e influenced b y t h e views o n t h e s u b j e c t of c a p i t a l p u n i s h m e n t w h i c h h a d b e e n e x p r e s s e d in t h e H o u s e of C o m m o n s . H e t h o u g h t it p r e f e r a b l e t o d e a l w i t h this p o i n t in t h e m o r e g e n e r a l t e r m s w h i c h h a d b e e n u s e d b y M r . C h u t e r E d e , M . I t h a d b e e n h o p e d t h a t this s c h e m e w o u l d b e i n t r o d u c e d by M a y this y e a r , b u t owing to the n u m e r o u s representations which had been m a d e by i n d u s t r y a b o u t its details it n o w s e e m e d unlikely t h a t it c o u l d b e i n t r o d u c e d b e f o r e t h e e n d of t h e y e a r . T h e p r o p o s e d 10 p e r c e n t , i n c r e a s e w o u l d t h e r e f o r e a p p l y to t h e existing s c h e m e of freight charges. A f u r t h e r p r o b l e m w h i c h faced t h e C o m m i s s i o n w a s a s e t t l e m e n t of t h e s u p e r a n n u a t i o n s c h e m e for t h e i r e m p l o y e e s . T h e p r e s e n t financial a r r a n g e m e n t s of the C o m m i s s i o n w e r e n o t e n t i r e l y satisfactory.
