T h e r a n g e a n d difficulty of t h e m a t t e r s t o b e d i s c u s s e d a n d settled i n t h e s p e c i a l F r e e T r a d e A r e a C o m m i t t e e a r e s u c h t h a t , if p o s s i b l e , t h e m e m b e r s s h o u l d be represented by Ministers, though not necessarily by the n o r m a l Ministerial d e l e g a t e s t o O . E . E . C . F o r s o m e c o u n t r i e s t h i s will n o t be p o s s i b l e ; for S w i t z e r l a n d it w o u l d b e c o n s t i t u t i o n a l l y i m p r a c t i c a b l e . B u t w e s h o u l d n o t e n c o u r a g e c o u n t r i e s w h o s e p a r t i n t h e n e g o t i a t i o n s will b e critical, s u c h as D e n m a r k , t o a p p o i n t officials as t h e i r n o r m a l n e g o t i a t o r s . 1 1 . T h e special F r e e T r a d e A r e a C o m m i t t e e , if its c r e a t i o n is a g r e e d on, will a p p e a r n a t u r a l l y a p i e c e of m a c h i n e r y to assist t h e C h a n c e l l o r i n the role, given h i m a s C h a i r m a n of t h e C o u n c i l l a s t F e b r u a r y , t o c o - o r d i n a t e a n d direct all n e g o t i a t i o n s a n d d i s c u s s i o n s arising o u t of, o r c o n n e c t e d w i t h , t h e p r e p a r a t i o n of a F r e e T r a d e A r e a . B u t t h o u g h it m a y be d e s i r a b l e for h i m t o a t t e n d its m e e t i n g s o c c a s i o n a l l y — a n d w h e n h e d o e s h e will as C h a i r m a n of t h e C o u n c i l n a t u r a l l y p r e s i d e — i t will b e n e c e s s a r y t o p r o v i d e a r e g u l a r c h a i r m a n . A l t h o u g h t h e r e are i n e v i t a b l y s o m e d i s a d v a n t a g e s in h a v i n g t h e c h a i r , since i t is n o t always easy, to d e f e n d a difficult n a t i o n a l p o s i t i o n t h e r e , i t is d o u b t f u l w h e t h e r t h e r e will b e the n e c e s s a r y d r i v e u n l e s s t h e U n i t e d - K i n g d o m h a s it. I t will t h e r e f o r e b e desirable, if possible, t h a t t h e P a y m a s t e r - G e n e r a l be n o m i n a t e d c h a i r m a n . 12. T h e special C o m m i t t e e will n e e d s u b o r d i n a t e b o d i e s , w o r k i n g p a r t i e s , &c: I t s h o u l d h a v e p o w e r to c r e a t e these, a n d t h e existing W o r k i n g P a r t i e s 2 1 , 22 a n d 2 3 , w h i c h at p r e s e n t d e p e n d o n t h e C o u n c i l , s h o u l d b e m a d e subject to t h e d i r e c t i o n of t h e special C o m m i t t e e so t h a t all t h e t h r e a d s m a y be p u l l e d t o g e t h e r in o n e place. W e c a n n o t c o u n t o n n e g o t i a t i o n s i n a s e v e n t e e n - c o u n t r y C o m m i t t e e b e i n g r a p i d ; i n d e e d , if it c a n n o t b e r e d u c e d a n d s o m e s m a l l e r s t e e r i n g g r o u p d e v e l o p e d w e c a n n o t e x p e c t a successful o u t c o m e t o t h e n e g o t i a t i o n s . Ideally, w e s h o u l d like t o o b t a i n a g r e e m e n t a t t h e O c t o b e r m e e t i n g t o t h e f o r m a l c o n s t i t u t i o n of s u c h a g r o u p . B u t it d o e s n o t s e e m likely t h a t s u c h a g r e e m e n t c a n b e r e a c h e d in O c t o b e r , a n d u n l e s s t h e r e is a n u n e x p e c t e d c h a n g e w e s h o u l d n o t t a k e a n y s t e p s t o s e c u r e it d u r i n g t h e O c t o b e r m e e t i n g . W e s h o u l d l e a v e t h e special F r e e T r a d e A r e a C o m m i t t e e to work, expecting that the n e e d for the smaller g r o u p will t h e n b e c o m e a p p a r e n t . M o r e o v e r , t h e p o w e r s g i v e n t o t h e C h a n c e l l o r , as C h a i r m a n of t h e C o u n c i l , last F e b r u a r y t o c o n s u l t w h o m h e t h i n k s fit will r e m a i n u n i m p a i r e d , a n d m a y p r o v i d e t h e m e a n s of c r e a t i n g a s m a l l e r g r o u p t o deal w i t h t h e c r u c i a l issues. 14. T h e f o r m a l r e c o g n i t i o n i n t h e n e g o t i a t i n g m a c h i n e r y t h a t all t h e q u e s t i o n s r e f e r r e d t o in p a r a g r a p h 9 a b o v e , a n d i n p a r t i c u l a r a g r i c u l t u r e ( w h i c h will h a v e b e e n d i s c u s s e d as o n e of t h e p r o b l e m s m e n t i o n e d in t h e C h a n c e l l o r s r e p o r t ) , will h a v e to b e d e a l t w i t h t o g e t h e r e v e n t h o u g h t h e y f o r m p a r t of s e p a r a t e legal i n s t r u m e n t s m a y well a p p e a r t o t h e C o n t i n e n t a l c o u n t r i e s as a significant m o v e f o r w a r d b y t h e U n i t e d K i n g d o m . W e h o p e this will b e sufficient t o l a u n c h t h e n e g o t i a t i o n s . T h e r e a r e d a n g e r s in this. U n l e s s t h e U n i t e d K i n g d o m h a s m a d e q u i t e clear w h a t it c a n n o t d o i n t h e a g r i c u l t u r a l field, t h e r e is a r i s k t h a t t h e c r e a t i o n of t h i s m a c h i n e r y m i g h t p r e c i p i t a t e s e r i o u s p o l i t i c a l difficulties w i t h i n t h e U n i t e d K i n g d o m a n d e v e n in t h e C o m m o n w e a l t h . O n t h e o t h e r h a n d , if t h e U n i t e d K i n g d o m i n d i c a t e s o n l y t h e t h i n g s t h a t it c a n n o t d o a n d d o e s n o t i n d i c a t e t h e g e n e r a l lines of w h a t it is p r e p a r e d t o c o n s i d e r , t h e r e m a y n o t b e a g r e e m e n t in t h e C o u n c i l t o g o f o r w a r d w i t h t h e n e g o t i a t i o n s . T h i s p r o b l e m is d e a l t w i t h i n d e t a i l i n t h e s e p a r a t e brief on agriculture. T h e Risk of D e a d l o c k 15. I t m a y b e t h a t after t h e e x c h a n g e of v i e w s o n t h e p o i n t s set o u t in t h e C h a n c e l l o r s m e s s a g e t h e r e will n o t b e a n y r e a s o n a b l e g r o u n d o n t h e basis of t h e v a r i o u s s t a t e m e n t s m a d e t h a t t h e n e g o t i a t i o n s c a n b e successful. This could h a p p e n if w e t h o u g h t t h a t t h e F r e n c h s t a t e m e n t o n t h e s o r t of F r e e T r a d e A r e a t h e y c o u l d a c c e p t w a s s o u n r e a l a n d u n s a t i s f a c t o r y as t o give little c h a n c e of e v e r r e a c h i n g a g r e e m e n t , o r if o t h e r c o u n t r i e s c o n s i d e r e d o u r s t a t e m e n t o n foodstuffs t o b e a n i n a d e q u a t e b a s i s for n e g o t i a t i o n . I n t h i s e v e n t , it a p p e a r s n o w t o b e preferable t h a t t h e meeting b e adjourned r a t h e r t h a n t h a t the procedural device of c r e a t i n g t h e special F r e e T r a d e A r e a C o m m i t t e e b e u s e d to b r e a k t h e d e a d l o c k . I t w o u l d n o t b e d e s i r a b l e t o set u p t h e special F r e e T r a d e A r e a C o m m i t t e e . i f i t w a s c e r t a i n t o r u n i m m e d i a t e l y i n t o a d e a d l o c k w h i c h w e h a d failed t o b r e a k at t h e O c t o b e r m e e t i n g . It w o u l d b e b e t t e r to a d j o u r n t h e m e e t i n g a n d b y d i p l o m a t i c m e a n s , i n c l u d i n g s m a l l e r M i n i s t e r i a l m e e t i n g s a n d visits, t o seek t o m o v e f o r w a r d r a t h e r t h a n t o c r e a t e a n e w C o m m i t t e e b e f o r e t h e r e is a n y p r o s p e c t t h a t it c a n d o useful w o r k . Recommendations 16. W e r e c o m m e n d t h a t , if t h e s t a t e m e n t s at t h e O c t o b e r m e e t i n g g i v e r e a s o n a b l e h o p e t h a t n e g o t i a t i o n s c a n b e successful, w e s h o u l d s e e k t o r e a c h agreement on the following p o i n t s : — (1) T h e n e g o t i a t i o n s s h o u l d c o v e r — (a) T h e F r e e T r a d e A r e a C o n v e n t i o n ( a n d p r o v i s i o n for c o a l a n d steel). It quite clearly emerges f r o m these documents that, d e s p i t e t h e d e c i s i o n w e t o o k last F e b r u a r y t o e n t e r i n t o n e g o t i a t i o n s , w e h a v e n o t yet b e e n a b l e t o t a c k l e s o m e m a j o r issues, o n w h i c h t h e discussions h a v e s h o w n t h a t w e a r e w i d e l y d i v i d e d : t h e r e is far f r o m a c o m m u n i t y of v i e w a m o n g u s a s t o w h a t k i n d of F r e e T r a d e A r e a w e w a n t . 2 . T h e first essential p o i n t o n w h i c h t h e r e m u s t b e g e n e r a l a g r e e m e n t is, d o w e a c c e p t as o u r objective t h e c r e a t i o n of a F r e e T r a d e A r e a ? I h a v e b e e n m u c h e n c o u r a g e d i n m y d i s c u s s i o n w i t h a n u m b e r of M i n i s t e r s to find t h a t t h e y d o feel t h a t it is i n t h e b e s t i n t e r e s t of E u r o p e t h a t w e s h o u l d s u c c e e d i n o u r e n d e a v o u r t o complement the Customs Union by a Free Trade Area to maintain wider c o - o p e r a t i o n a n d a v o i d division. I h o p e t h a t w e shall all k e e p this essential n e e d c o n s t a n t l y i n m i n d d u r i n g t h e n e g o t i a t i o n s : w e shall n o t b e successful unless w e d o . 3 . W h a t are the major points o n which we m u s t at least m o v e together a little if n e g o t i a t i o n s a r e t o h a v e a n y p r o s p e c t of s u c c e s s ? T h e y a p p e a r to m e t o be the following: — A.—(i) I n g e n e r a l , w h a t s h o u l d b e t h e s c o p e of t h e F r e e T r a d e A r e a Convention? Institutions 8.—(i) T h e U n i t e d K i n g d o m p r o p o s a l is f o r a F r e e T r a d e A r e a t o b e e s t a b l i s h e d w i t h i n t h e f r a m e w o r k of O . E . E . C . , w i t h s u c h m o d i f i c a t i o n s of existing p r o c e d u r e a n d p r a c t i c e as m a y b e n e c e s s a r y . I n e i t h e r c a s e its m e m b e r s h i p w o u l d n e e d to b e r e s t r i c t e d t o a s m a l l n u m b e r . O u r p r e f e r e n c e is for (a). (iv) W h i c h e v e r t y p e of m a n a g i n g b o d y w e r e a d o p t e d , it s h o u l d n o t h a v e r i g h t s of i n i t i a t i v e similar t o t h o s e w h i c h the E u r o p e a n C o m m i s s i o n of t h e Six will p o s s e s s . F o r all p r a c t i c a l p u r p o s e s t h e C o u n c i l of M i n i s t e r s of t h e E u r o p e a n E c o n o m i c C o m m u n i t y c a n t a k e n o decision b y m a j o r i t y v o t e e x c e p t o n t h e r e c o m m e n d a t i o n of the C o m m i s s i o n . T h e C o u n c i l of M i n i s t e r s of t h e F r e e T r a d e A r e a should, h a v e p o w e r t o t a k e decisions e i t h e r b y u n a n i m i t y o r m a j o r i t y v o t e a c c o r d i n g to t h e s u b j e c t m a t t e r , r e g a r d l e s s of t h e r e c o m m e n d a t i o n m a d e , by the managing body. (v) U n a n i m o u s v o t i n g s h o u l d b e t h e r u l e , except w h e r e t h e C o n v e n t i o n e x p r e s s l y p r o v i d e s o t h e r w i s e . I t w o u l d i m p l y s u p e r s e d i n g t h o s e p a r t s of t h e T r e a t y of R o m e w h i c h d e a l w i t h t h e s a m e t o p i c s as t h e F r e e T r a d e A r e a C o n v e n t i o n a n d w o u l d seriously l i m i t t h e p o w e r s of t h e i n s t i t u t i o n s of t h e E u r o p e a n E c o n o m i c C o m m u n i t y . (iii) A l t h o u g h , t h e r e f o r e , w e c a n n o t e x p e c t t o o b t a i n a C o n v e n t i o n w h i c h b y its v e r y n a t u r e a v o i d s all d a n g e r of d i s c r i m i n a t i o n a g a i n s t U n i t e d K i n g d o m t r a d e r s i n t h e field of i n d u s t r i a l g o o d s a n d m a t e r i a l s , w e m u s t try to avoid such discrimination by two m e t h o d s : — (a) O n t h i n g s w h i c h really m a t t e r t o u s t h e t e r m s of t h e F r e e T r a d e A r e a C o n v e n t i o n a n d of t h e T r e a t y of R o m e m u s t b e effectively t h e s a m e ; t h a t is t o s a y , w e m u s t either a d o p t in t h e C o n v e n t i o n t h e p r o v i s i o n s of t h e R o m e T r e a t y , o r in a n y cases in w h i c h t h e s e p r o v i s i o n s a r e seriously o b j e c t i o n a b l e seek t o w r i t e i n a c c e p t a b l e p r o v i s i o n s sufficiently p r e c i s e t o o v e r r i d e t h e c o r r e s p o n d i n g articles of t h e R o m e T r e a t y a n d t o b i n d t h e Six as signatories of the Convention. (b) T h e a d m i n i s t r a t i o n of t h e rules of t h e F r e e T r a d e A r e a a n d of t h e E u r o p e a n E c o n o m i c Community, where they cover c o m m o n g r o u n d , m u s t b e similar. I n o r d e r t o s e c u r e this object c l o s e c o - o p e r a t i o n b e t w e e n t h e I n s t i t u t i o n s of t h e A r e a a n d of t h e C o m m u n i t y will b e essential ( p a r a g r a p h 1 0 b e l o w ) . (iv) T h e m o r e t h e p r o v i s i o n s of t h e F r e e T r a d e A r e a C o n v e n t i o n l i m i t t h e f r e e d o m of its m e m b e r s , t h e m o r e t h e c e n t r e of p o w e r will m o v e t o t h e i n s t i t u t i o n s of t h e A r e a . C o n t r a r i w i s e , t h e less t h e C o n v e n t i o n l i m i t s t h e f r e e d o m of m e m b e r s of t h e A r e a , t h e m o r e t h e c e n t r e of p o w e r will rest in t h e i n s t i t u t i o n s of the E u r o p e a n E c o n o m i c C o m m u n i t y , w h e r e w e shall h a v e n o influence. A r r a n g e m e n t s for t h e Close W o r k i n g Together of the Institutions of the F r e e T r a d e A r e a a n d the E u r o p e a n E c o n o m i c C o m m u n i t y 10.—(i) Council of Ministers.—We envisage t h a t the supreme governing b o d y of t h e F r e e T r a d e A r e a will be t h e C o u n c i l of M i n i s t e r s . T h e T r e a t y of R o m e delegates i m p o r t a n t powers to the E u r o p e a n C o m m i s s i o n , b u t w e s h o u l d s e e k t o s e c u r e t h a t all m a j o r P o w e r s i n t h e F r e e T r a d e A r e a will b e e x e r c i s e d b y t h e M i n i s t e r i a l C o u n c i l . P r o v i d e d t h e Six a r e r e p r e s e n t e d i n d i v i d u a l l y b y t h e i r M i n i s t e r s o n t h e C o u n c i l of t h e F r e e T r a d e A r e a , M i n i s t e r s of t h e n o n - S i x will h a v e t h e m a x i m u m opportunity for ensuring that decisions are taken on a E u r o p e a n , a n d n o t a " little E u r o p e " basis, (ii) Liaison between the Managing Bodies.—The F r e e T r a d e A r e a will h a v e a m a n a g i n g b o d y d e a l i n g w i t h s u b j e c t s s i m i l a r t o s o m e of t h o s e d e a l t w i t h b y t h e E u r o p e a n C o m m i s s i o n , t h o u g h its p o w e r s will b e m o r e r e s t r i c t e d a n d it will c o v e r a n a r r o w e r r a n g e of t o p i c s . N o n e t h e less t h e m a j o r q u e s t i o n s will b e d e a l t w i t h b y b o t h . It will b e d e s i r a b l e t o e n s u r e s o m e c o m m o n m e m b e r s h i p a n d close l i a i s o n a r r a n g e m e n t s . .
