2.—(1) F o r t h e p u r p o s e of giving a d v i c e a n d assista n c e in c o n n e c t i o n w i t h t h e exercise a n d p e r f o r m a n c e b y
t h e T r e a s u r y of t h e i r p o w e r s a n d d u t i e s u n d e r t h i s A c t ,
t h e r e shall b e c o n s t i t u t e d a c o m m i t t e e t o be called t h e
I m p o r t D u t i e s A d v i s o r y C o m m i t t e e (in t h i s A c t referred

(3) T h e C o m m i t t e e shall, a s soon as m a y b e after
t h e c o m m e n c e m e n t of t h i s A c t , t a k e i n t o consideration t h e
provisions of t h i s A c t , a n d m a y m a k e r e c o m m e n d a t i o n s
w i t h r e s p e c t t o m a t t e r s on w h i c h , u n d e r t h e provisions
of t h i s A c t , a c t i o n m a y b e t a k e n o n a r e c o m m e n d a t i o n b y 1 0
t h e C o m m i t t e e a n d m a y from t i m e t o t i m e r e c o m m e n d
t h a t a n y duties imposed p u r s u a n t to a n y previous
r e c o m m e n d a t i o n so m a d e o u g h t t o b e v a r i e d or r e v o k e d .
(4) T h e T r e a s u r y shall p u b l i s h a r e c o m m e n d a t i o n
m a d e t o t h e m b y t h e C o m m i t t e e a s soon as m a y b e after 1 5
t h e y have m a d e an order p u r s u a n t to t h e recommendation
or h a v e d e t e r m i n e d t o m a k e n o o r d e r on t h e r e c o m m e n d a ­
tibn.
(5) T h e e x p e n s e s of t h e C o m m i t t e e t o s u c h a n a m o u n t
as m a y b e a p p r o v e d b y t h e T r e a s u r y (including t h e 2 0
e x p e n s e s of t h e i r staff a n d such salaries or o t h e r r e m u n e r a ­
t i o n p a i d t o all or a n y of t h e m e m b e r s as t h e T r e a s u r y m a y
d e t e r m i n e ) shall b e p a i d o u t of m o n e y s p r o v i d e d b y
Parliament.
(6) T h e C o m m i t t e e m a y m a k e r u l e s for r e g u l a t i n g 2 5
t h e proceedings, i n c l u d i n g q u o r u m , p l a c e of m e e t i n g , a n d
notices t o b e given of m e e t i n g s of t h e C o m m i t t e e .
(7) T h e C o m m i t t e e , so far as t h e y consider i t
n e c e s s a r y or desirable so t o d o for t h e p u r p o s e of t h e
p r o p e r d i s c h a r g e of t h e i r functions, m a y b y o r d e r r e q u i r e 3 0
a n y person, s u b j e c t t o t h e p a y m e n t or t e n d e r of t h e
r e a s o n a b l e e x p e n s e s of his a t t e n d a n c e , t o a t t e n d as a
w i t n e s s before t h e m or before a n y p e r s o n a u t h o r i s e d b y

( 3 ) I n deciding w h e t h e r t o m a k e a r e c o m m e n d a t i o n
for t h e p u r p o s e s of t h i s section in r e s p e c t of o t h e r articles
o t h e r t h a n articles of l u x u r y , t h e C o m m i t t e e shall h a v e
r e g a r d t o t h e a d v i s a b i l i t y in t h e n a t i o n a l i n t e r e s t of
regulating imports into the United Kingdom and the
4 0 i n t e r e s t s g e n e r a l l y of t r a d e a n d i n d u s t r y in t h e U n i t e d
K i n g d o m , i n c l u d i n g t h o s e of t r a d e s w h i c h a r e con­
s u m e r s of g o o d s as well a s t h o s e of t r a d e s w h i c h a r e
p r o d u c e r s of g o o d s .

( 4 ) T h e d u t i e s c h a r g e d u n d e r t h i s section, according
as m a y b e p r e s c r i b e d in t h e order, m a y be c h a r g e d —
(a) b y reference t o v a l u e , t o w e i g h t , t o m e a s u r e m e n t

(6) for a n y p e r i o d or periods, w h e t h e r c o n t i n u o u s or 5
n o t , or w i t h o u t a n y limit of p e r i o d ;
(c) a t different r a t e s for different periods or p a r t s of

( 5 ) W h e r e i t is a p p r e h e n d e d t h a t a n y goods which,
b y r e a s o n of t h e i r b e i n g liable t o C u s t o m s d u t i e s u n d e r 1 0
a n y o t h e r A c t , a r e n o t liable t o d u t y u n d e r section one
of t h i s A c t will s h o r t l y b e c o m e liable t o d u t y u n d e r t h e
said section one b y r e a s o n of t h e d u t y u n d e r t h e said
o t h e r A c t ceasing t o b e chargeable, t h e C o m m i t t e e m a y
m a k e a r e c o m m e n d a t i o n u n d e r t h i s section w i t h respect 1 5
t o t h o s e goods, a n d t h e a p p r o p r i a t e D e p a r t m e n t m a y
m a k e a n order accordingly, so, however, t h a t t h e order
shall n o t h a v e effect u n t i l t h e d a t e on w h i c h d u t y becomes
chargeable u n d e r section o n e of t h i s A c t .

goods of a n y d e s c r i p t i o n specified i n t h e order, being
goods w h i c h a r e s h o w n t o t h e satisfaction of t h e Com­
missioners of C u s t o m s a n d E x c i s e t o h a v e b e e n consigned
from a n d grown, p r o d u c e d or m a n u f a c t u r e d in a n y 2 5
D o m i n i o n specified i n t h e o r d e r t h a t as from t h e d a t e
of t h e order, or as f r o m s u c h d a t e a s m a y b e specified
in t h e order, t h e a d v a l o r e m d u t y of t e n p e r cent, charged
b y t h i s A c t or a n y a d d i t i o n a l d u t y c h a r g e a b l e u n d e r t h i s
A c t , or b o t h s u c h d u t i e s , shall n o t b e c h a r g e a b l e or shall 3 0
b e c h a r g e a b l e only a t s o m e specified r a t e less t h a n t h e

C u s t o m s u n d e r t h i s A c t , a n d a n y s u c h goods r e - i m p o r t e d
i n t o G r e a t B r i t a i n o r N o r t h e r n I r e l a n d after e x p o r t a t i o n
t h e r e f r o m shall, if i t is s h o w n t o t h e satisfaction of t h e
Commissioners of C u s t o m s a n d E x c i s e t h a t n o d r a w b a c k 2 0
of d u t y w a s allowed o n e x p o r t a t i o n , or t h a t a n y d r a w ­
b a c k so allowed h a s b e e n r e p a i d t o t h e E x c h e q u e r —
(a) w h e r e i t is f u r t h e r s h o w n a s aforesaid t h a t t h e
goods h a v e n o t b e e n s u b j e c t e d t o a n y process
a b r o a d , b e e x e m p t from d u t y ; a n d

(6) w h e r e it is s h o w n as aforesaid t h a t t h e goods
h a v e b e e n s u b j e c t e d t o a n y process a b r o a d b u t
t h a t t h e i r f o r m or c h a r a c t e r h a s n o t b e e n

process i n G r e a t B r i t a i n or N o r t h e r n I r e l a n d , or with a
view t o t h e r e - e x p o r t a t i o n thereof after t r a n s i t t h r o u g h
G r e a t B r i t a i n or N o r t h e r n I r e l a n d or b y w a y of t r a n s - A . D . 1932.

a n i m p o r t e r w o u l d give for t h e goods on a p u r c h a s e in ^ " ^
t h e o p e n m a r k e t if t h e g o o d s w e r e delivered t o h i m a t
t h e p o r t of i m p o r t a t i o n , freight, i n s u r a n c e , commission
a n d all o t h e r costs, c h a r g e s a n d expenses i n c i d e n t a l t o
the purchase a n d delivery a t t h a t port (except the duties
u n d e r t h i s A c t ) h a v i n g b e e n p a i d , a n d d u t y shall b e
p a i d o n t h a t v a l u e a s fixed b y t h e Commissioners of
Customs and Excise.
(2) I n d e t e r m i n i n g t h e v a l u e of a n y goods for t h e
p u r p o s e s of t h i s A c t t h e Commissioners of C u s t o m s a n d

(a) t h e p r i c e w h i c h a t t h e t i m e of i m p o r t a t i o n of
t h e g o o d s of w h i c h t h e v a l u e is t o b e a s c e r t a i n e d
(in t h i s s u b s e c t i o n referred t o as " t h e said
goods " ) is being p a i d b y o t h e r i m p o r t e r s for
g o o d s of t h e like description a n d q u a l i t y ; or, if
t h a t price c a n n o t b e d e t e r m i n e d t o t h e satisfac­

c h a r g e a b l e o n a n y goods u n d e r t h i s A c t , a n y d i s p u t e
arises a s t o t h e v a l u e of t h e goods, t h e q u e s t i o n shall b e
referred t o t h e a r b i t r a t i o n of a referee a p p o i n t e d b y t h e
L o r d Chancellor, w h o shall n o t b e a n official of a n y 5
G o v e r n m e n t D e p a r t m e n t , a n d t h e decision of t h e referee
w i t h r e s p e c t t o t h e m a t t e r " in d i s p u t e shall b e final a n d
conclusive, a n d sections t h i r t y a n d t h i r t y - o n e of t h e
C u s t o m s Consolidation A c t , 1 8 7 6 , shall a p p l y as if t h e
