HOUSING LEASE
I.
Iowa State University, as Lessor, hereby leases to the Lessee, a space in a double or single occupancy room to
be occupied as a private residence only by the named Lessee.
II.
The Terms and Conditions are a part of the Housing Lease and residents are required to comply with its
contents. Where the lease conditions differ from the Terms and Conditions, the current Terms and Conditions
take precedence. The Terms and Conditions are subject to change at any time. If a change is made, you will
be notified in writing of the new policy.
III.
Lessee agrees to pay the monthly rent to Iowa State University in advance on the first and no later than the
fifteenth of each month during the period of this lease. The rental rate includes room furnishings and
housekeeping. Each resident is furnished with a single bed, mattress, dresser, student desk and chair, and
wastebasket. Each room is furnished with draperies and a telephone. Housekeeping cleans the room and
bath on a regularly scheduled basis.
IV.
Minimum Term of Lease
The minimum term of this lease is two months (60 days) from the check-in date.
V.
Assignment Priorities
Room assignments for residents are determined according to the date the Application for University Student
Housing is received in the Residence Hall Administrative Office, 1215 Friley Hall. For specific information on
assignment priority, please refer to the current Terms and Conditions, Section 6.A.
VI.
Eligibility for Assignment and Maintaining Housing
A. To be eligible to live in Graduate/Adult Undergraduate Housing the Lessee must be an enrolled graduate or
adult undergraduate (adult defined as 21 years of age or older) student at Iowa State University.
1. Lessee must be a registered student in the semester assigned and in every semester thereafter except
as noted in the Terms and Conditions, Section 4.
2. Student eligibility does not require summer registration.
B. To remain eligible to live in Graduate/Adult Undergraduate Housing all housing fees must remain current.
VII.
Rental Rate
A. Lessee who does not meet the student eligibility requirements, and who is given permission to remain in
the room, agrees to pay non-student rent as of the beginning of the semester.
B. Lessee who does not meet and maintain the eligibility requirements, and is not given permission to remain
in the room, will be charged non-student rent from the beginning of the semester and will be issued a
Notice of Intent to Vacate.
C. The State Board of Regents reserves the right to increase the rental rate upon 30 days notice to the
Lessee. Upon receipt of said notice, Lessee shall have the option of electing either to accept the increased
rate and continue the existing lease or to terminate the present lease on the date the increase is to become
effective.
D. All such approved changes of rental rates will be accomplished by official communications from the
University and do not require a new lease agreement.
E. All such approved changes of rental rates will become effective July 1 of each year.
F. The first month’s rent, or remaining days of the month, shall be billed upon check-in. The $125.00
prepayment will be applied to the first full month’s rent.
G. Computation of the daily rental rate to be used at move in time and for refund purposes upon vacating will
be based on the actual number of days in the month.
H. Lessee agrees that the Lessor has the right to bill the Lessee for charges to cover damages, unpaid rent,
and other amounts owed to the University.
VIII. Termination of Lease
A. Lessee is responsible for a minimum of 60 days room rent. If Lessee checks out with less than a 60 day
stay or without a 45 day vacate notice, Lessee will be responsible for the remainder of the 60 days or an
additional 45 days room rent from date of check out, whichever is greater.
B. The Lessee is given written notification of check-in dates. If Lessee has not checked in by 7:00 p.m. of the
last date of this check-in period nor notified the Department of Residence Administrative Office, 1215 Friley
Hall, of a change of plans, the Lessee will be considered a “no-show” and the lease will be canceled by the
department. The prepayment will be forfeited and the space will be reassigned to the next eligible student.
C. Lessee agrees to give a 45 day written notice prior to the time when:
1. Lessee intends to move from the room.
2. Lessee is no longer a student at Iowa State University.
3. Lessee graduates.
D. A 45 day vacate notice is not required for the following reasons:
1. Lessee signs a lease with any other University owned housing.
2. Lessee is officially dropped by the University for academic or other reasons.
3. Lessee enters military services providing the Lessee submits a letter from a commanding officer
indicating the dates of required service to the Department of Residence Administrative Office, 1215
Friley Hall.
4. Lessee withdraws from ISU due to medical reasons providing the Lessee submits a valid doctor’s
statement to the Department of Residence Administrative Office, 1215 Friley Hall.
E. Graduating Lessee is required to vacate by the sixth (6th) day following graduation. Occupancy beyond the
sixth (6th) day will be charged the non-student rate through the last day of the graduating month.
F. Graduating Lessee who is granted permission to remain beyond the sixth (6th) day following graduation will
be charged the student rental rate through the last day of the graduation month or through the date of
extension (if prior to the last day of the graduation month). Thereafter, the non-student rental rate will be
charged.
G. Lessee shall remove all personal property from the leased premises on or before the last day of the lease.
Any such personal property that Lessee fails to remove shall be deemed to have been abandoned and may
either be retained by the University, or removed from the leased premises and stored at the expense of the
Lessee for a maximum period of time of four weeks. Any items remaining unclaimed after four weeks will
be disposed of according to University guidelines.
H. Lessor has the right to give a 45 day notification or termination notice when:
1. Lessee fails to make payment of rent or other charges by the fifteenth (15th) of each month.
2. Room where Lessee resides is decommissioned. The Lessee will be given preference for relocating to
another graduate/undergraduate adult residence hall space.
3. Lessee chooses not to accept approved changes in the terms of the lease.
4. Lessee commits or maintains any nuisance, breach of the peace, or disorder in or upon the leased
premise.
5. Lessee has violated any provision of this lease, the Terms and Conditions and/or any rules established
by the Department of Residence and Iowa State University.
I. Lessee has ten (10) days to appeal the lease termination to the Director of Residence. Violation of any of
the lease conditions during the 45 day vacate period will result in University disciplinary action or earlier
termination of the lease.

Use of Assigned Space
A. Lessee agrees to indemnify and hold harmless the Lessor, for any loss or damage from fire, theft, or other
cause, to their personal property or to any other person’s property, and for injuries to the Lessee or guests
of Lessee, which may result from use or occupancy of the leased premises.
B. Lessee agrees not to transfer possession, lease, or sublease the room.
C. Lessee may not use their room, telephone number, or mailbox for any commercial purpose.
D. It is the Lessee’s responsibility to inform visitors of parking regulations and lease conditions (e.g., no pets,
no smoking, alcohol policy) that may affect the Lessee.
E. The Lessee agrees to abide by the “Uniform Rules of Personal Conduct at Universities Under the
Jurisdiction of the State Board of Regents,” available in the Dean of Students Office, 1010 Student
Services, which states in part “Use or possession on campus of firearms, or other dangerous weapons,
substances, or materials (except as expressly authorized by the University), or of bombs, explosives, or
explosive or incendiary devices is prohibited by law.” The Lessee agrees not to use or possess firearms on
University property. This includes rifles, shotguns, air rifles, BB guns, slingshots, bows and arrows, and
other potentially dangerous items.
