Yes ORDER AND NOTICE OF SPECIAL ELECTION FOR CONTINUATION OF ADDITIONAL FAYETTE COUNTY BOARD OF EDUCATION LEVY TO THE VOTERS OF FAYETTE COUNTY Acting on behalf of the Board of Education of the County of Fayette, State of West Virginia, the State Superintendent of Schools, as Designee of the West Virginia Board of Education, approved the following order on November 9, 2012: After careful study and due deliberation, the State Superintendent of Schools being of the opinion that the levies for current expenses authorized by Article 8, Chapter 11, of the Code of West Virginia, as amended, will not provide sufficient funds for the payment of current expenses of the Fayette County Board of Education, including expenditures for the purposes hereinafter set forth, and that an election should be held to approve continuation of the special levies under the provisions of Section 16, Article 8, Chapter 11 of the Code, as amended, it is hereby ordered: 1. That the total approximate annual amount needed to be raised for said purposes, after allowances for discounts, delinquencies and exonerations, is $9,271,245. 3. That the total approximate amount to be raised for said purposes during the five year term of the levy, after allowances for discounts, delinquencies and exonerations, is approximately $46,356,225. 4. That the separate and aggregated assessed valuation of each class of taxable property within Fayette County is as follows: Class I Class II Class III Class IV $0 $466,854,564 $638,989,229 $235,702,405 5. That the proposed, continued additional rate of levy in cents per one hundred dollars of assessed valuation on each class of property is as follows: Class I Class II Class III Class IV 22.95 cents 45.90 cents 91.80 cents 91.80 cents Provided, however that the Board of Education reserves the right and authority to reduce the rates of the excess levy if increases in assessed valuations produce funds beyond the projected needs in any year specified in the levy call. 6. That the proposed years to which the continuation of the additional levy shall apply are the fiscal years beginning July 1, 2014, July 1, 2015, July 1, 2016, July 1, 2017 and July 1, 2018. 7. That upon approval of the proposed additional levy, the Board of Education will not issue bonds under the provisions of Section 16, Article 8, Chapter 11 of the Code, as last amended, obligating receipts of the additional levy. 8. That should collections from the additional levies be in excess of the amounts projected herein, the Board of Education reserves the right to expend the surplus for any of the above stated purposes or to enrich, supplement, and improve the educational services and/or facilities in the public schools in the county. In the event that the amount collected is less than the amounts projected herein, the Board of Education reserves the right to make the reduction in any of the above stated purposes. 9. That should additional money be obtained by grant or otherwise from the state or federal government or any other source, the additional money may be used either in substitution or in addition to the amount obtained from this levy. 10. That should any item in the aforementioned purposes be declared unconstitutional or invalid due to judicial or legislative action, the affected funds will be expended for any of the remaining unaffected purposes. 11. That the question of the continuation of such additional levy shall be submitted to a vote at a special election to be held on the 9 th day of February, 2013. 12. That notice calling such election shall be given by the publication of this order at least once each week for two successive weeks before said election in two newspapers of opposite politics and of general circulation in the territory in which the election is held. If there is only one newspaper published in the county, said publication shall be made therein. All the provisions of the laws concerning general elections shall apply as far as they are practicable, with the exception of the provisions contained in Section 17, Article 8, Chapter 11 of Code, as last amended. 13.
