This application is submitted annually in order to receive West Virginia’s federal Part B grant award for the education of students with disabilities ages 3-21. The WV Part B Application packet provides information pertaining to West Virginia’s status with regard to the implementation of the reauthorized IDEA and its final regulations, effective October 13, 2006. Each state is required to ensure that their state policy is consistent with the final Part B regulations. Proposed Policy 2419: Regulations for the Education of Students with Exceptionalities includes the requirements needed to implement the Part B regulations and address the required components of this application. The WV Part B Application can be accessed at Department’s and OSP’s websites at http://wvde.state.wv.us and http://wvde.state.wv.us/ose, respectively. Memorandum Page Two March 16, 2007 OSEP requires all states to publish these applications for 60 days and 30 days for public comment in accordance with 441 of the General Education Provisions Act and the Part B regulations at 34 CFR 300.165. Two public hearings on the WV Part B Application will also be conducted to fulfill the public participation requirements. Beginning March 16, 2007, the WV Part B Application will be published on the Department’s and OSP’s websites at http://wvde.state.wv.us and http://wvde.state.wv.us/ose, respectively. Beginning March 23, 2007, the WV Part B Application will be available for comment and can be accessed at the Department’s and OSP’s websites at http://wvde.state.wv.us and http://wvde.state.wv.us/ose, respectively. The public comment period ends April 21, 2007. Written comments and suggestions regarding the application may be submitted:1) online though the Department’s homepage at http://wvde.state.wv.us/ose; 2) by mail or email; or 3) by facsimile (please refer to attached comment form). Two public hearings will be conducted via conference calls to receive oral comments and suggestions with regard to the proposed application.
