MINUTES WEST VIRGINIA BOARD OF EDUCATION Board Conference Room Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia November 14, 2012 I. Call to Order Following the welcome, introductions and Pledge of Allegiance, President L. Wade Linger Jr. called the meeting of the West Virginia Board of Education (WVBE) to order at 1:03 p.m. on November 14, 2012, in the Board Conference Room, Capitol Building 6, Room 353, Charleston, West Virginia. The following members were present: President Linger, Vice President Gayle C. Manchin, Secretary Robert W. Dunlevy, Michael I. Green, Priscilla M. Haden, Lloyd G. Jackson II, Jenny N. Phillips and William M. White, and ex officios Jorea M. Marple, State Superintendent of Schools, and Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission. Student representative in attendance was Molly Ballard of Liberty, West Virginia, who attends Poca High School (Putnam County). Member absent was ex officio James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. II. Oath of Office President Linger deferred the Oath of Office ceremony to a future meeting. III. Recognitions Ms. Liza Cordeiro, Executive Director, WVDE Office of Communications, introduced Mr. Ben Shew, Executive Director, WVDE Office of Transportation, who introduced Mr. George J. “Jack” Defibaugh Jr., Chief Mechanic, Greenbrier County Schools, recipient of the 2012 National Association for Pupil Transportation (NAPT) America's Best School Bus Inspector of the Year Award. This is Mr. Defibaugh’s second recognition; the first award was conferred in 2011. IV. Speaker Series for Student Assistance Programs Ms. Shelly DeBerry, Coordinator, WVDE Office of Optional Educational Pathways, introduced Captain Spencer Phillips, United States Army Recruiting Command, who provided information regarding a speaker series for student assistance programs. -2V. Delegations Ms. Carolyn Arritt, citizen of Fayette County, addressed the Board regarding Fayette County school closures and return of local control. VI. Approval of Agenda President Linger requested a motion to approve the agenda. Mr. Dunlevy moved that the agenda be approved. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. VII. Broadband Technology and Opportunities Program (BTOP) Update Mr. Mark McKenzie (distributed information), Manager - Engineering, Frontier Communications, provided an update regarding BTOP. Mr. John Miller (distributed information), Assistant Director, WVDE Office of Instructional Technology, provided an update regarding WVDE BTOP issues. Director’s Information Dr. Gus Penix, Director of the Office of Education Performance Audits (OEPA), provided an update regarding the revision of Policy 2320. IX. Progress Education Performance Audit Report for the Preston County School District and Aurora Elementary School, Rowelsburg School, Bruceton School, Terra Alta East Preston School, Fellowsville Elementary School, Kingwood Elementary School, Tunnelton-Denver Elementary School, Valley Elementary School, Central Preston Middle School, South Preston Middle School, West Preston Middle School, and Preston High School Dr. Penix reported that an announced on-site reviews (five days in advance) were conducted at the Preston County School District, Aurora Elementary School, Rowelsburg School, Bruceton School, Terra Alta East Preston School, Fellowsville Elementary School, Kingwood Elementary School, Tunnelton-Denver Elementary School, Valley Elementary School, Central Preston Middle School, South Preston Middle School, West Preston Middle School, and Preston High School August 21-23, 2012. Mr. Ted Mattern, System Support Liaison, Office of the State Superintendent, and Dr. Larry Parsons, Superintendent, Preston County Schools, and Ms. Kathy McNeill, President, Preston County Board of Education, addressed the Board regarding the audit findings. Upon the recommendation of Dr. Penix, Mr. Dunlevy moved that 1) partial control be returned to the Preston County Board of Education in the areas of policy and the establishment and operation of a school calendar; 2) all other areas of intervention remain in place and that the West Virginia Department of Education continue oversight in curriculum, finance, facilities, and personnel; 3) that the Nonapproval status of the Preston County School District be continued; and 4) another audit occur, as determined by the WVBE, to assess improved student -3achievement, reduction of the financial deficit, stability of personnel practices according to W. Va. Code, and progress of facility improvements. Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously. Call to Order President Linger called the meeting back to order at 2:54 p.m. XII. Capacity Building for Low Performing Schools, Intervention Counties and East Lynn Elementary School and Wayne Middle School, Wayne County Mr. Mattern, Ms. Michele Blatt, Executive Director, WVDE Office of School Improvement, and Dr. Jack McClanahan, System Support Liaison, Office of the State Superintendent, provided information regarding capacity building for a number of low performing schools, the intervention counties and East Lynn Elementary Schools and Wayne Middle School. XIII. Consent Agenda Ms. Haden moved that the Consent Agenda be approved. Ms. Phillips seconded the motion and upon the call for the question the motion was carried unanimously. Approved meeting minutes of October 3, 2012 (Attachment B) Approved the amendment to the Preston County 2010-2012 Comprehensive Education Facilities Plan to construct two barns that were demolished during construction of the site work at the new Central Preston Middle School (Attachment C) Approved an Employment of Substitute Teachers in Areas of Critical Need policy for Tyler County Schools (Attachment D) Received notifications, per W. Va. Code §18A-4-7a(l)(3), Transfer of Person Employed in a Professional Position after the Twentieth Day Prior to the Beginning of the Instructional Term for Brooke, Cabell, Fayette, Greenbrier, Lewis, McDowell, Nicholas, Ohio and Roane County Schools (Attachment E) Approved one first time request for a waiver of WVBE policy (Attachment F) -4- XIV. Repealed Policy (Attachment G) Repealed Policy 2700.56, Competitive Grants for Instructional Improvement (Attachment H) Repealed Policy 5110.1, Educational Personal Development Plan Regarding the Teaching of Economics as Part of the Social Studies Graduation Requirement (Attachment I) 2324, Courses of Instruction, Voter Registration Amendment and Closure - Grant County Comprehensive Educational Facilities Plan (CEFP) Mr. Joe Panetta, Assistant State Superintendent, Division of Student Support Services, presented an amendment and closure to the Grant County CEFP for the Board’s consideration. The closure of Dorcas Elementary is currently identified in Grant County's CEFP. All supporting documentation has been provided to WVDE staff for review. Grant County has conducted closure hearings for Dorcas Elementary and has met all requirements set forth in Policy 6204. Upon approval of the closure, an amendment to the Grant County 2010-2020 Comprehensive Educational Facility Plan (CEFP) is required to move the closure of Dorcas Elementary from the current date of 2014 to the 2013 school year. All requirements for revision of the CEFP, as specified in W. Va. Code §18-5-13a, have been met. Dr. DeEdra Lundeen Bolton, Superintendent, Grant County Schools, addressed the Board regarding the closure and amendment. Ms. Haden moved that the closure and amendment be approved. President Linger moved New Business item B. Resolution - Federal Qualified Zone Academy Bonds (QZAB) to Mingo County Schools to be taken up on November 15, 2012. XV. Preston County Memorandums of Agreement with the State Historic Preservation Office Ms. Heather Hutchens Deskins, General Counsel to the WVBE and WVDE, presented, in compliance with the historic preservation statute, two Memoranda of Agreement with the State Historic Preservation Office, to demolish two structures with historical significance as part of Preston County Board of Education’s construction of the new Central Preston Middle School and of renovations to Bruceton Elementary School for the Board’s consideration. Mrs. Manchin moved that the two Memoranda of Agreement with the State Historic Preservation Office be approved. Ms. Phillips seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachments L-1 and L-2.) -5XVI. Implementation of the Master Plan for Professional Staff Development for 2011-2012 and Evaluation Study Ms. Haden, assisted by Mr. Nate Hixson (distributed information), Assistant Director, WVDE Office of Research, presented the evaluation report of the Implementation of the Master Plan for Professional Staff Development for 2011-2012 and Evaluation Study for the Board’s consideration. W. Va. Code §18-2-23a requires the WVBE to a) establish annual professional development goals for public schools; b) coordinate professional development programs; and c) guide program development, approval and evaluation. The code also requires measures by which the effectiveness of the professional staff development programs will be evaluated. To meet this requirement, the WVDE Office of Research was charged with conducting the evaluation of the Master Plan. This evaluation report details the implementation and outcomes of the Master Plan for Statewide Professional Staff Development for 2011-2012. Ms. Haden moved that the evaluation report of the Master Plan for Statewide Professional Staff Development for 2011-2012 be accepted. XVII. 2012-13 Local Solutions Dropout Prevention and Recovery Innovation Zones Ms. Blatt presented the Innovation Zone Selection Committee’s additional Innovation Zones for 2012-2013 for the Board’s consideration. Ms. Haden moved that the additional innovation zones, as presented by the Innovation Zone Selection Committee, be approved. Approval of RESA Executive Director Goals Mr. Charles K. Heinlein, Deputy State Superintendent of Schools, presented the annual goals of the RESA Executive Directors for the Board’s consideration. Ms. Phillips moved that the goals of RESA Executive Directors be approved. Mr. Dunlevy seconded the motion and upon the call for the question the motion was carried unanimously. Official State Multiple List of Instructional Materials for Social Studies and Mathematics K-8 Off-Cycle Ms. Carla Williams, Special Assignment, WVDE Office of Instruction, presented the Official State Multiple List of Instructional Materials for Social Studies and Mathematics K-8 Off-Cycle for the Board’s consideration. The West Virginia Instructional Materials Review Committee and the West Virginia Instructional Materials Advisory Committee, in accordance -6with the requirements specified in W. Va. Code §18-2A-2, have completed the process of reviewing instructional materials for Social Studies K-12 and for newly developed mathematics materials grades K-8. The instructional materials being recommended have met established generic, general and specific criteria. Upon approval, these recommendations become part of the Official State Multiple List of Instructional Materials. The searchable database of recommended material for Social Studies is found at http://wveis.k12.wv.us/nclb/Materials/public12/mainmenu.cfm and Mathematics Off-Cycle at http://wveis.k12.wv.us/nclb/Materials/public_offcycle/Mainmenu.cfm. Ms. Ballard addressed the Board regarding her classroom experience with regard to mathematics courses. Mr. Green moved that the Official State Multiple List of Instructional Materials for Social Studies K-12 and Mathematics K-8 Off-Cycle be approved. Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously. Mr. Jackson departed the meeting. XX. Policy 2445.40, Groupings for Adoption of Instructional Resources for Early Childhood Education, Middle Childhood Education, and Adolescent Education AND Policy 2445.44, Rules for Granting Exemptions to the Legal Requirements for the Adoption and Utilization of Textbooks Programs Ms. Williamson presented Policy 2445.40 and Policy 2445.44 for the Board’s consideration. Policy 2445.40 has been revised to incorporate Policy 2445.44 thus eliminating the need for two separate policies. The revision switches the adoption years for English Language Arts and Science. While the major publishing houses are developing new resources built around the Common Core State Standards for Science, their new resources will not be finalized until approximately one year after the release of the Next Generation Standards for Science. Since publishers have already developed new resources built around Next Generation Standards for English Language Arts, revising the adoption schedule to switch English Language Arts and Science adoption years will ensure availability of instructional resources with full alignment to Next Generation Standards for both Science and English Language Arts. Ms. Phillips moved that Policy 2445.40, inclusive of the repeal of Policy 2445.44, be placed on public comment for 30 days. Policy 2520.16, Alternate Academic Achievement Standards for Science in West Virginia Schools Ms. Pat Homberg, Executive Director, WVDE Office of Special Programs, presented Policy 2520.16 for the Board’s consideration. Policy 2520.16 currently defines the alternate academic achievement standards across grades 3-8 and 10 in reading/language arts and 3-8, 10 and 11 in mathematics and science for students with the most significant cognitive disabilities. As a member of the Dynamic Learning Maps (DLM) Alternate Assessment System Consortium, WVDE has participated in the development of the Common Core Essential Elements (CCEE): standards, objectives and performance descriptors aligned with the Common Core Standards in -7the areas of English Language Arts and mathematics. the CCEE are the standards assessed by the alternate assessment being developed by the consortium for this population. Because the science standards have not yet been revised, English language arts and mathematics are being established as separate policies and have been deleted from Policy 2620.16. No changes have been made to the science section. Mrs. Manchin moved that Policy 2520.16, be placed on public comment for 30 days. Policy 2520.161, Alternate Academic Achievement Standards for English Language Arts in West Virginia Schools Ms. Homberg presented Policy 2520.161 for the Board’s consideration. Election of WVBE Member to the School Building Authority of West Virginia President Linger requested a motion to elect Robert W. Dunlevy to the School Building Authority of West Virginia. W. Va. Code §18-9D-1 which states, in part, that “The School Building Authority (SBA) shall consist of eleven members, including the Governor or designee; the state superintendent of schools, ex officio; three members of the state board of education, elected by the state board.... State board of education members are elected for three-year terms and may not be elected to serve additional consecutive terms or portions thereof.” WVBE member Priscilla M. Haden completed her term as a member of the SBA on November 4, 2012. Mr. Green moved that Mr. Dunlevy be elected to serve as a member of the School Building Authority of West Virginia. Mrs. Manchin seconded the motion and upon the call for the question the motion was carried unanimously. President Linger, with the consensus of the Board, moved the Board’s personnel matters to take place immediately upon conclusion of the SBA appointment. XXVII. WVBE Personnel Matters including a Five Day Suspension without Pay for an Employee at the West Virginia Schools for the Deaf and the Blind and the Indefinite Suspension without Pay for a RESA 5 Employee Executive Session President Linger, in accordance with W. Va. Code 6-9A-4(b)(2)(A) (personnel matters) called for a motion to enter into executive session to discuss personnel matters. -9Ms. Haden moved that the Board enter into executive session as provided by W. Va. Code 6-9A-4(b)(2)(A) to discuss personnel matters. Dr. White seconded the motion and upon the call for the question the motion was carried unanimously. The Board entered into executive session at 9:05 a.m. XXVIII. Return from Executive Session The Board returned from executive session at 10:24 a.m. at which time President Linger announced that no decisions were made or action taken. President Linger moved action regarding personnel matters to occur later in the agenda. XXIX. WVBE Position on Single Sex Classes President Linger requested that Mr. Juan D’Brot, Executive Director, WVDE Office of Research, address the Board regarding single sex class research. President Linger read the following statement for the Board’s consideration. The West Virginia Board of Education supports school systems’ efforts to improve student achievement through innovative ways based on research and sound educational practice. To this end, the Board supports counties which choose to implement single-sex classrooms if the aforementioned is in alignment with guidance provided by the U.S. Department of Education, federal regulations, and is in compliance with all applicable state and local policies and laws. Mrs. Manchin moved that the position statement be approved. Ms. Phillips seconded the motion and upon the call for the question the motion was carried unanimously. XXX. Resolution - Federal Qualified Zone Academy Bonds (QZAB) to Mingo County Schools Ms. Heather Hutchens Deskins, General Counsel to the WVBE and WVDE, presented a resolution on behalf of the Mingo County Board of Education authorizing the issuance of a Federal Qualified Zone Academy Bond (QZAB) in the amount of $423,469 to Mingo County Schools to equip and renovate the Riverside PK-8 and Matewan PK-8 school buildings for the Board’s consideration. Mr. Edd McDevitt, Esq., Bowles Rice LLP, addressed questions regarding the QZAB. Mr. Dunlevy moved that the WVBE adopt, on behalf of the Mingo County Board of Education, the resolution authorizing the issuance of a Federal Qualified Zone Academy Bond (QZAB) in the amount of $423,469 to Mingo County Schools to equip and renovate the Riverside PK-8 and Matewan PK-8 school buildings. Ms. Haden seconded the motion and upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment K.) - 10 XXXI. Hiring of Independent Legal Counsel by WVBE President Linger addressed the Board regarding the hiring of independent legal counsel. It was the general consensus of the Board that President Linger investigate and provide factual information regarding the hiring of independent legal counsel. Ms. Haden requested that her reservations regarding the hiring of independent legal counsel be noted. XXXII. Board Reports Response to Governor’s Education Efficiency Audit. President Linger provided an update regarding the status of the response and announced the Board will meet on November 21, 2012, to take action regarding the response. WVBE Common Ground: Education and the Military Committee. Ms. Haden provided an update on the behalf of the Common Ground Committee. The committee’s charge has been completed and the committee disbanded. Student Representative Remarks. Ms. Ballard provided remarks regarding her service as student representative. The Board recognized Ms. Ballard for her service as student representative. XXXIII. Break President Linger called for a break at 11:23 a.m. XXXIV. Call to Order President Linger called the meeting back to order at 11:29 a.m. XXXV. Board Reports (Continued) WVBE Wellness Committee. Mrs. Manchin provided an update on the behalf of the Wellness Committee. ReConnecting McDowell. Reconnecting McDowell initiative. XXXVI. Mrs. Manchin provided an update regarding the WVBE Personnel Matters including a Five Day Suspension without Pay for an Employee at the West Virginia Schools for the Deaf and the Blind and the Indefinite Suspension without Pay for a RESA 5 Employee President Linger distributed an addendum to the Board’s personnel attachment for the Board’s consideration and requested approval of Attachment S as well as the termination of employment of the State Superintendent of Schools effective at the close of business on - 11 November 15, 2012. Mrs. Manchin moved that the WVBE’s personnel matters found in the attachment, inclusive of a five day suspension without pay for an employee at the West Virginia Schools for the Deaf and the Blind and the indefinite suspension without pay for a RESA 5 employee, and the addendum be approved. Dr. White seconded the motion and upon the call for the question the motion was carried with five members voting yes and two members, Ms. Haden and Ms. Phillips, voting no. Ms. Haden and Ms. Phillips notified President Linger that they will notify the Governor that they will resign as members of the Board effective December 31, 2012. Mr. Heinlein was requested to take the chair vacated by Superintendent Marple. XXXVII. Board Reports (Continued) NASBE Technology Study Group: The Role of Technology in Schools and Communities. Dr. White (distributed information) provided information regarding his participation on the NASBE Technology Study Group and the resulting publication Born in Another Time: Ensuring Educational Technology Meets the Needs of Students Today – and Tomorrow. Ms. Brenda Williams, Division Leader, WVDE Office of Instructional Technology, provided additional information regarding technology in schools. Dr. White requested an item be placed on a future agenda regarding technology. (Copies appended to Official Minutes, Attachment Z.) Board Member Reports. Ms. Haden attended meetings of the Center for Professional Development and accountability and accreditation and announced the following new student representatives to the Board: Luke Massey, a senior at Preston High School (Preston County), Aishwarya Saluja, a senior at Hedgesville High School (Berkeley County), and Blake Humphrey, a junior at Wheeling Park High School (Ohio County). Mrs. Manchin (distributed information) conducted and participated in a meeting of the WVSBA Training Standards Review Committee and attended a Center for Professional Development Advanced Placement Leadership meeting. Dr. White attended a meeting at the West Virginia Schools for the Deaf and the Blind. President Linger worked on the audit report. (Copies appended to Official Minutes, Attachment AA.) XXXVIII. State Superintendent’s Report Mr. Heinlein (distributed addendum) presented WVDE personnel matters for the Board’s information. (Copy appended to Official Minutes, Attachment T and addendum.) Report of 2011-2012 Waivers of WVBE Policies and Regulations, Superintendent's Interpretations and State Statutes and Legislative Rules. Ms. Betty Jo Jordan, Executive Assistant to the State Superintendent, presented the report of 2011-12 waivers for the Board’s Information. (Copy appended to Official Minutes, Attachment U.) Update of Board Policies for Review/Repeal. Ms. Jordan presented an update regarding Board policies under review for amendment or repeal. (Copy appended to Official Minutes, Attachment V.) - 12 - Update on Policy 2512 (Critical Skills). Dr. Monica Beane, Assistant Director, WVDE Office of Research, presented an update regarding Policy 2512, Instructional Supports for Third and Eighth Grade Students to Achieve Critical Skills. (Copy appended to Official Minutes, Attachment W.) XXXIX. Board Items for Future Consideration President Linger requested that items mentioned during the meeting be placed on the appropriate agenda. (Copy appended to Official Minutes, Attachment X.) LX. Future Meetings The Board will meet in special session on November 21, 2012, at 1:00 p.m. in Charleston, West Virginia. The next regular meeting of the WVBE will be held December 12, 2012, in Lincoln County, West Virginia. The meeting will continue on December 13, 2012, in Charleston, West Virginia, if the agenda is not completed on December 12, 2012. LXI.
