Course Outline: This is a “nuts and bolts pracHcal course that will consider the basic building blocks of real estate transacHons. It will survey a wide range of various common real estate transacHons and related maNers. Many topics to be covered apply both to commercial and consumer real estate transacHons.
Some consumer transacHons will be considered, but the primary focus will be on commercial transacHons. MaNers to be covered will include estates in land, legal descripHons, brokerage agreements, conveyancing documents, recordaHon statues, chain of Htle, purchase agreements, selected oil, gas and mineral issues as they may impact real estate Htle and development, basic methods for real estate finance, promissory notes, deed of trust, homestead rights, troubled loan workout issues, foreclosure, leases, ethics and lawyer liability issues in real estate transacHons. Course assignments will include the draSing of various documents, in part or in whole, including client and other leNers, deeds, promissory notes, sales contracts, deeds of trust, foreclosure documents and leases.

Grades: The following is the breakdown of what will be encompassed in the final grade:

The grade for Assignments not turned in on Hme will be reduced.
Final Exam: The final will be an take home exam. The exam will consist of mulHple choice and short answer as well as a draSing essay. The final exam will contain a statement that by taking and turning in the final exam the student represents the student has aNended the minimum number of classes required by the rules of the Law Center.

First Day Assignment:

Each student is to draS a memo to the professor to be turned in the first day of class. The memo should include informaHon about student’s background including major in college, extracurricular acHviHes, work experience, law school property courses taken and any other experience with real estate law if any. The memorandum should also set out the student’s expectaHons for this course, anHcipated Law Center graduaHon date and anHcipated area of legal pracHce aSer graduaHon if known. The memorandum may contain any other informaHon about the student that the student cares to share with the professor that may help the professor in tailoring the course to be of maximum benefit to the student. The memorandum will not be graded and should be 3 to 5 pages, double spaced and typed. The students name should appear at the top of the first page.

The first class will be a review of real estate related concepts that will be helpful to the students going forward. There is no addiHonal reading required.
