University of Wisconsin-Stout Policy Advertising, Sponsorship and Promotion of Alcohol and Tobacco Products Policy No. 14-74 Date: 1/21/2015 1.0 INTRODUCTION The abuse of alcohol and tobacco products interferes with the education and development of students. It negatively affects the campus environment and reduces the effectiveness of employees. The purpose of this policy is to establish guidelines for the advertisement, sponsorship or promotion of alcohol and tobacco products on the University of Wisconsin-Stout campus or at campus sponsored events. This policy also provides guidance to all units, departments, schools, colleges and registered student organizations on the sponsorship of university events, programs, publications or other activities by non-university entities. References: UW-Stout Tobacco Free Policy UW-Stout Alcohol and Other Drug Policy UWS Chapter 17 – Non Academic Student Misconduct [pdf] Student Organizations Code of Conduct [pdf] Faculty/Staff Handbook [pdf] Classified handbook http://www.uwstout.edu/hr/upload/class_handbook.pdf 2.0 DEFINITIONS 2.1 Advertising: Any advertisement, signage, label, logo, packaging, imprint, sales promotion activity or device, public relations material or event, merchandising, or other activity or communication that has the obvious intent of promoting or marketing a non-university product, service, event, or organization. 2.2 Alcohol and/or Tobacco Industry: A commercial industry that is involved in the manufacture, distribution and/or sale of alcohol and/or tobacco. 2.3 Campus: Any property owned or controlled by UW-Stout. 2.4 Sponsorship: The provision by a non-university entity of money, goods, services to the university, college, school, department, unit, or student organization, in support of one or more activities, events or programs. In return, the sponsor may be provided tangible return benefits. 2.5 University event: Any event, on or off campus, where the university or recognized organization is in control of the activity. 2.6 Campus student-run media: need a definition 3.0 STATEMENT OF POLICY It is the policy of UW-Stout that advertising, sponsorship, or marketing with the purpose of promoting alcohol and/or tobacco use or products (including in official university print or online publications and media) is prohibited on campus and at universitysponsored events. 4.0 GUIDELINES FOR IMPLEMENTATION The following applies when the participants or the intended audience are college students (or minors): 4.1 Distribution of alcohol or tobacco industry promotional giveaways is prohibited on campus or at university-sponsored events. 4.1.1 Community businesses, such as restaurants or retailers, can advertise, market, or sponsor an event or activities, but the specific brand name of a tobacco or alcohol product and/or logo cannot be used. The activity, if off campus, must conclude by 9pm to not discriminate against students who are not of legal drinking age. Businesses must demonstrate how their sponsorship does not promote alcohol and/or tobacco use. 4.1.2 Promotional giveaways with alcohol or tobacco product brand names or logos cannot be distributed on campus or at university-sponsored events. 4.2 Campus student-run media are encouraged to follow this policy. 5.0 RESPONSIBILITY FOR IMPLEMENTATION: The Vice Chancellor for Administrative and Student Life Services has responsibility for implementation. 6.0 CONSEQUENCES OF POLICY 6.1 Failure to adhere to the provisions of this policy may result in appropriate disciplinary action as provided under existing procedures applicable to students, faculty, staff, and/or civil or criminal law. 6.2 Violations of the provisions of this policy by a student may lead to the imposition of a disciplinary sanction, up to and including suspension or expulsion, under s. UWS 17.06(1)(c), Wis. Adm. Code. 6.3 Student organizations are subject to disciplinary sanctions, up to and including suspension or expulsion according to the Student Organization Code of Conduct. 6.4 University employees are also subject to discipline on a work rule violation. 6.5 Disciplinary sanctions are initiated and imposed in accordance with applicable procedural requirements and work rules, as set forth in Wisconsin statutes, administrative rules, and faculty bargaining agreements. Referral for prosecution under criminal law is also possible. Violations of ss. UWS 18.06(13) and 18.10, Wis. Adm. Code may result in additional penalties as allowed under Ch. UWS 18, Wis. Adm. Code. 7.0 APPEAL PROCESS Exceptions to this policy (while rarely granted) must support the mission and priorities of the university. Exception requests must be made in writing, signed by the dean or director and submitted to the Vice Chancellor for Administrative and Student Life Services least 4 weeks prior to the date of the event. A decision on whether the exception will be granted will be made and communicated within 10 days of receipt of the written request. Return to Sequential Index.
