Affordable Care Act (ACA) Policy FAQs:
1. When is the 25 hour limit going into effect?
 January 19, 2016
2. How many hours can student employees work up to per week?
 In general, student can work 25 hours per week when classes are in session. Please
reference the calendar provided for the number of hours allowed to work per week.
3. How many hours can student employees work per week when classes are not in session?
 Students may work up to a maximum of 40 hours per week when classes are not in
session (WinTerm, Spring Break, Summer), except the weeks indicated on the calendar
that are limited to 25 hours, which are May 29th – June 4th, June 26th – July 9th and
starting August 28th for the fall semester.
4. If the student employee is enrolled in half time or less can they work more than 25 hours?
 No, the number of credits a student is enrolled in has no bearing on the hour limit.
5. Are student employees who are paid with Federal Work Study fund limited to 25 hours as
well?
 Federal work-study hours are not counted against the 25 hour limit
 State Pay hours are limited to 25 hours per week
6. Are Graduate Assistant affected by the ACA policy?
 Graduate Assistants are not impacted by the ACA limits; however, they are limited to 20
hours per week based on a university limit.
7. My department pay student employee on a Non-hourly Lump Sum payment, can I still do
that?
 The preferred student employee payment method for ACA is to pay hourly.
 If you must pay as a non-hourly lump sum payment, the number of hours worked will
need to be tracked, so that they do not exceed the 25 hours per week.
 The non-hourly rule does not apply to Resident Assistants/Resident Advisors/Resident
Counselors, as they are temporarily exempted from the 25 hour limit until further
notice.
8. What can student supervisors do to reduce the risk of going over the 25 hours per week limit?
 Supervisors will need to limit the number of hours a student employee works when
classes are in session.

Some students may have multiple appointments, so make sure to communicate with
your student employee(s) about the 25 hours limit, which applies to all jobs on campus
that is not a Work Study job.
9. What is the penalty for a student who goes over the 25 hours limit per week?
 Due to the strong penalties that University of Wisconsin would face, exceeding the 25
hour limit could lead to discipline or termination of employment.
10. Since Resident Assistants/Resident Advisors work around the clock, do I have to limit their
hours to 25 per week?
 Resident Assistants/Resident Advisors/Resident Counselors are temporarily exempted
from the 25 hour limit until further notice but all hours must be tracked
