(a) "Skilled nursing facility" defined in this subchapter, the term "skilled nursing facility" means an institution (or a distinct part of an
institution) which--(1) is primarily engaged in providing to residents--(A) skilled nursing care and related services for residents who require
medical or nursing care, or (B) rehabilitation services for the rehabilitation of injured, disabled, or sick persons, and is not primarily for the care
and treatment of mental diseases; (2) has in effect a transfer agreement (meeting the requirements of section 1395x(l) of this title) with one or
more hospitals having agreements in effect under section 1395cc of this title; and (3) meets the requirements for a skilled nursing facility

A facility that is not an acute care hospital and that provides nursing care and related medical services over a period of 24 hours each day to
individuals admitted because of illness, disease, or physical infirmity is a nursing facility, and must comply with 7 AAC 12.250 - 7 AAC

Alabama State Board of Health as another kind of facility, and (2) functioning within the scope of applicable law and administrative rules.
All providers of services, including but not limited to "skilled nursing facility," "extended care facility," "intermediate care facility,"
"convalescent nursing home," "personal care facility," and "home care agency" shall be defined in relation to the services and facilities required
to be available and the licensure or degree status of those providing or supervising the services. The definition may require that the provider be
appropriately licensed or certified.
Nursing Home shall mean and be construed to include any buildings, structure, agency, institution, or other place for the reception,
accommodation, board, care, or treatment of two or more unrelated individuals, who, because of physical or mental infirmity are unable to
sufficiently or properly care for themselves, and for which reception, accommodation, board, care, and treatment, a charge is made, provided
the term "Nursing Home" shall not include the offices of private physicians and surgeons, boarding homes, or hospitals, or institutions operated
by the Federal Government. (Section 2, Act 141 of 1961 as amended).
Service providers, including "skilled nursing facility," "extended care facility," "intermediate care facility," "convalescent nursing home,"
"personal care facility," and "home care agency" shall be defined in relation to the services and facilities required to be available and the
licensure or degree status of those providing or supervising the services and may require that the provider be appropriately licensed or certified.
"Nursing care institution" means a health care institution providing inpatient beds or resident beds and nursing services to persons who need
nursing services on a continuing basis but who do not require hospital care or direct daily care from a physician.

A long-term care facility is a health facility that holds itself out as a nursing home, nursing facility, nursing care facility or intermediate care
facility or a health facility that is planned, organized, operated, and maintained to provide supportive, restorative, and preventive services to
persons who, due to physical and/or mental disability, require continuous or regular inpatient care. (a) a long-term care facility is a nursing care R - 6 CCR
facility, or a nursing facility serving residents who require continuous medical and nursing care and supervision. (b) a long-term care facility is 1011-1
an intermediate care facility serving residents who require regular, but not continuous nursing care and supervision.

"Convalescent Nursing Home," "Extended Care Facility," or "Skilled Nursing Facility" shall be defined in relation to its status, facilities and
available services. A definition of such home or facility shall not be more restrictive than one requiring that it: (1) be operated pursuant to law;
(2) be approved for payment of Medicare benefits or be qualified to receive such approval, if so requested; (3) be primarily engaged in
providing, in addition to room and board accommodations, skilled nursing care under supervision of a duly licensed physician; (4) provide
continuous twenty-four hours a day nursing service by or under the supervision of a registered nurse (R.N.); and (5) maintains a daily medical
record of each patient. The definition of such home or facility may provide that such term shall not be inclusive of: (1) any home, facility or part
thereof used primarily for rest; (2) a home or facility for the aged or for the care of drug addicts or alcoholics; or (3) a home or facility primarily
used for the care and treatment of mental disease or disorders, or custodial or educational care.
A "custodial or intermediate nursing home" is an institution which: (1) is licensed as a nursing home or operated under the law as a nursing
home or a hospice; (2) operates primarily to provide nursing care for which a charge is made for three or more persons; (3) provides continuous
nursing care under the supervision of a registered nurse (R.N.), a licensed practical nurse (L.P.N.) or a licensed physician; (4) is not a hospital
or clinic; (5) is not a home for the aged or mentally ill, a rest home, a community living center, or a place that provides domiciliary, residency,
or retirement care; and (6) is not a facility which operates primarily for the treatment of alcoholics or drug addicts, even if it is a section of a
nursing home.
"Nursing home facility" means any nursing home or residential care home as defined in section 19a-490, as amended, or any rest home with
nursing supervision which provides, in addition to personal care required in a residential care home, nursing supervision under a medical
director twenty-four hours per day, or any chronic and convalescent nursing home which provides skilled nursing care under medical
supervision and direction to carry out nonsurgical treatment and dietary procedures for chronic diseases, convalescent stages, acute diseases or
injuries.

"Nursing home" means a licensed organized institution that maintains conditions or facilities and equipment to provide domiciliary, personal, or

care agency" and all other service providers shall be defined in relation to the facilities and the required available services, together with the

addicts or alcoholics; or (C) a home or facility primarily used for the care and treatment of mental diseases or disorders, or custodial or

"Nursing home" means a place where 5 or more persons who are not related to the operator or administrator reside, receive care or treatment
and, because of their mental or physical condition, require access to 24-hour nursing services, including limited nursing care, intermediate level
nursing care and skilled nursing services. "Nursing home" does not include any of the following: (c) A convent or facility owned or operated
exclusively by and for members of a religious order that provides reception and care or treatment of an individual. (d) A hospice, as defined in
s. 50.90(1), that directly provides inpatient care. (e) A residential care apartment complex.
All providers of services, including but not limited to "skilled nursing facility," "extended care facility," "intermediate care facility,"
"convalescent nursing home," "personal care facility," and "home care agency" shall be defined in relation to the services and facilities required
to be available and the licensure or degree status of those providing or supervising the services. The definition may require that the provider be
appropriately licensed or certified.
"Nursing home" or "facility" means any institution, residence or place, or any part or unit thereof, however named, in this state which is
advertised, offered, maintained or operated by the ownership or management, whether for a consideration or not, for the express or implied
purpose of providing accommodations and care, for a period of more than twenty-four hours, for four or more persons who are ill or otherwise
incapacitated and in need of extensive, ongoing nursing care due to physical or mental impairment or which provides services for the
rehabilitation of persons who are convalescing from illness or incapacitation. The care or treatment in a household, whether for compensation or
not, of any person related by blood or marriage, within the degree of consanguinity of second cousin to the head of the household, or his or her
spouse, may not be deemed to constitute a nursing home within the meaning of this article. Nothing contained in this article applies to nursing
homes operated by the federal government; or extended care facilities operated in
conjunction with a hospital; or institutions operated for the treatment and care of alcoholic patients; or offices of physicians; or hotels, boarding
homes or other similar places that furnish to their guests only room and board; or to homes or asylums operated by fraternal orders pursuant to
article three, chapter thirty-five of this code.
