SJ SUPPLEMENT 2709.11-2012-1 EFFECTIVE DATE: 6/21/2012 DURATION: Effective until superseded or removed 2709.11 30 Page 2 of 3 FSH 2709.11 - SPECIAL USES HANDBOOK CHAPTER - 30 A – ESTABLISHING FEES A.1 – Methods for Determining Fair Market Value The following fee determination should be used to compute the fee for livestock area use authorizations, under use code 215. All livestock area permits should be issued in compliance with both WO and RO FSM direction (2722.15) which states that these uses should be phased out, if appropriate. The fee is based on a per animal unit (AU). This fee applies to all new uses, reissuances of existing uses, and opportunities for fee adjustments to existing authorizations where terms and conditions allow. The fee determination shall not be used for authorizations which are already covered by another fee system or schedule; such as linear rights-of-way, recreation residences, communication sites, ski areas, municipal reservoirs, outfitter/guide, organizational camps, or grazing fees for grazing allotments, that are established annually by Congress. Unique properties with a different highest and best use may require individual appraisal. SAN JUAN NATIONAL FOREST LIVESTOCK AREA FEE, FSM 2700; 2722.15 LIVESTOCK AREA, USE CODE 215 FEE DETERMINATION OF $15.00 PER AU PER MONTH Effective as of 6/21/2012 All fees in this section shall be adjusted annually by the Implicit Price Deflator (IPD) The schedule is based upon current rental sales data, and state publications. It is expected that the fee shall apply to virtually all livestock area use authorizations under use code 215. Fees for the livestock area Special Use Permits shall be $15.00 per animal unit (AU) month. For purposes of calculating these fees, an animal unit (AU) is a month’s use and occupancy of rangeland by one adult cow, bull, steer or heifer. An animal is an adult if it is weaned, is at least six months old at the beginning of the permitted period of use, or will be 12 months old during the permitted period of use. For each authorization, the carrying capacity for the permitted area will be determined to set the maximum AU’s/year allowed. Permit Administrators must work with the holder to identify the annual AU for the permitted area. This number will be used to determine the base fee. Annually, bill the holder the base fee as established above, and indexed by the IPD annually. Do not bill less than the regional minimum fee. Annual fees should reflect the occupancy that is authorized. Example: Holder A has a livestock area permit for which the carrying capacity has been determined to be 100 AU’s by the forest range specialist. The holder states that they will run 5060 AU’s annually (10-12 animals/month for 5 months). The base fee will be calculated from the AU’s authorized. In this case, it would be 60 AU’s annually. The AU/month fee has been calculated for this Forest at $15/AU. The annual fee is: Annual AU x Fee/AU/month 60 AU x $15 = $900 (indexed by the IPD annually)
