5420 - LAND PURCHASES AND DONATIONS

5420.14b - Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970

(P.L. 91 646; 84 Stat. 1894)

Contacts with landowners regarding the proposed purchase of properties should be documented in writing, Certified--Return Receipt Requested. The contact and written documentation should include as a minimum:

1. Identification of the real property and the estate or interest therein to be acquired including, if appropriate, building, structural and other improvements on the property, as well as fixtures considered to be part of the real property.

2. Permission to enter upon the land to make an appraisal of the fair market value of the estate to be acquired.

3. An offer to the owner or his designated representative to accompany the appraiser during his inspection of the property.

4. Approximate dates the appraiser will be on the property and the date the Forest Service will make an offer for the property.

5. The United States will not initiate condemnation action to acquire the property if the offer by the United States is unacceptable to the landowner unless the purchase is a must acquisition. If the proposed purchase is a must acquisition, procedures stated in FSM 5480 will be followed.

5420.43 - Regional Foresters. The Director of Lands and Minerals is delegated the authorities of the Regional Forester for actions pertaining to land purchase and donations.
