(Hard copy is also on file) R1 CLEARWATER NF SUPPLEMENT EFFECTIVE DATE: DURATION: Effective until superseded or removed Clw Supp 2600-2007-01 Page 2 of 4 FSM 2600 – WILDLIFE, FISH AND SENSITIVE PLANT HABITAT MANAGEMENT CHAPTER 2610 – COOPERATIVE RELATIONS 2611 – Cooperation With State Wildlife and Fish Management Agencies Memorandum Of Understanding Supplementing and Extending the Statewide Agreement of April 14, 1983 Supplemental Agreement No. 1 Between Department of Fish and Game, Region 2 State of Idaho Forest Service, Clearwater National Forest U.S. Department of Agriculture This Memorandum of Understanding, made this 13th day of March, 1985, by and between the Idaho Department of Fish and Game, Region 2, hereinafter called the “Department,” and the U.S. Forest Service through the Forest Supervisor, Clearwater National Forest, Region 1, hereinafter called the “Forest Service,” is entered into for the purpose of protecting, conserving and managing the fish and wildlife resources of the State of Idaho within the Clearwater National Forest. The Department and the Forest Service agree to the following to promote cooperation in managing the game and nongame wildlife and fish and their habitats. I. Improving cooperative Efforts A. The Forest Service shall: 1. Send the Environmental Assessment (EA) Update, the 5-year Timber Sale Plan, Pre-Analysis Letters (PALS) for projects potentially affecting fish and wildlife that were not published on the EA Update, and notification of projects treated as Categorical Exclusions. Forest Supervisor is responsible ot send the EA Update and 5-year Plan. District Rangers are responsible to send the PALs, Decision Notices, and notices of Categorical Exclusion. 2. Periodically conduct problem-solving/training workshops for Department and Forest Service personnel to give hands-on experience in WATBAL, FISHSED, North Idaho Elk Coordinating Guidelines, EA Process, and other models or coordination procedures used by the Forest Service to evaluate proposals affecting fish and wildlife resources. 3. Supply the Regional Supervisor with a copy of the Clearwater National Forest’s Environmental Analysis process and supplements or revision thereof. B. The Department shall: 1. In a timely manner, send the Forest Supervisor or district Ranger a response to the EA Updates, 5-year Timber Sale Plans, and PALs indicating the level of interest, proposal by proposal, and designate a Department contact for subsequent coordination and input. 2. Provide the Forest Supervisor and District Rangers with copies of Species Management Plans, reports, findings, etc., related to fish and wildlife for review and comment. 3. Invite input from the Forest Supervisor on any proposed changes in hunting seasons, hunting area boundaries, fish stocking, etc. 4. Supply the Forest Supervisor with a copy of the Department’s interagency review process. Both Parties shall: 1. Encourage communication by participating in Interdisciplinary Team meetings, staff reviews, field reviews, etc., for the purpose of identifying and evaluating ICOs, alternatives, effects, and recommending management direction. 2. Sponsor winter and summer interagency coordination meetings. Utilize the summer meeting to get into the field to mutually evaluated selected proposals that affect fish and wildlife resources. 3. Openly discuss differing mandates that require or suggest a firm position on certain policies and proposals. 4. Invite participation at the outset in special studies or activities such as Grizzly Bear studies, wildlife transplants, fish stocking activities, etc. II. Problem or Conflict Resolution A. Both parties shall: 1. Put the other “on notice” informally when a conflict or problem is evident. The Regional Supervisor should call the Responsible Official (Forest Supervisor or District Ranger) and vice versa. 2. Establish organizational level at which the disagreement can be settled. For example, a wilderness issue is ultimately settled by Congress while a timber sale management requirement issue may be settled at the District or Forest level. 3. If resolution of a conflict is potentially resolvable at the Forest/Region level, the Forest Supervisor and Regional Supervisor should: a. Establish the common ground involved in the conflict. b. Assign an appropriate team to conduct problem-solving (scope, develop alternative, evaluate, and make recommendations). c. Jointly review the team’s analysis and discuss the management conclusions, probable decision(s), etc. 4. If resolution of a conflict is not resolvable at the Forest/Region level, then the Forest Supervisor or Regional Supervisor should: a. Put the other “on notice” formally that he/she intends to pursue resolution at a higher level. b. Continue to provide appropriate input to analyses, layout of project, etc., if the proposal in contention is being implemented. c. Simultaneously begin providing input through appropriate channels to the Responsible Official who can potentially resolve the conflict. III. Outfitter/Guide Activities A. The Forest Service shall: 1. Consult with the Lewiston office of the Department on new areas, or expansion of operations when evaluating proposed outfitter/guide activities. Send copies of PALs, EAs, etc., to the Regional Supervisor of the Department and request comments. 3. Provide correspondence and citations involving outfitter/guide activities on National Forest System lands that would be of interest to the Department in administration of fish and game laws. B. The Department shall: 1. Consult with the appropriate District when presented with an outfitter/guide license application that has not been signed by the District Ranger. 2. Provide copies of correspondence and citation involving outfitter/guide activities that would be of interest to the Forest in the administration of the permit and public services. (Game violations or violations of Forest Service permits.) C. It is mutally agreed and understood between the said parties: 1. To review annually area boundaries and submit recommendations for change to Idaho Outfitter/Guides Board. 2. To work cooperatively to the extent that personnel and funds are available in administration and enforcement of outfitter/guide activities. 3. To maintain communications regarding illegal outfitters, operations out of permit areas or other possible violation of State or Federal laws. In Witness Whereof, recognizing that additional supplements may be required in the future, the parties hereto have executed this agreement as of the last date written below.
