2164.04 - Responsibility
2164.04c - Regional Foresters and Station Directors
The Regional Forester has overall responsibility for hazardous materials management in the
Alaska Region.
It is the responsibility of the Director of Engineering and Aviation Management (E&AM) to
provide overall program leadership and coordination for the Regional Comprehensive
Environmental Response, Compensation, and Liability Act (CERCLA) program.
1. Comprehensive Environmental Response, Compensation, and Liability Act
(CERCLA) Coordinator. The Facilities and Environmental Engineering Group Leader on the
Regional Office Engineering & Aviation Management Staff is designated as the Regional
CERCLA Coordinator to provide overall leadership and coordination for the Regional program.
2. CERCLA Response Actions. For CERCLA response actions to:
 Director of Engineering and Aviation Management. The Director of Engineering
and Aviation Management is delegated the responsibility for paragraphs a, b, e, f, and
i and the following:
q. Designate staff to act as On-Scene Coordinators for removal actions and as
Remedial Project Managers for remedial actions as part of the planning and
preparedness for response actions (40 CFR 300.120).
r. Approve the appropriate response action(s) for a site pursuant to sections 104, 121,
and 116(a) of CERCLA (42 U.S.C. 9604, 9621, and 9616(a) when the overall cost of
the response(s) are expected to exceed $50,000.
 Deputy Regional Forester for Operations. The Deputy Regional Forester for
Operations is delegated the responsibility for paragraphs d, h, m, n, o and the
following:
s. Pursuant to section 122 of CERCLA (42 U.S.C. 9622 (h) (1), review and approve
all other CERCLA settlements with the concurrence of the Department of Justice
through the Office of the General Counsel.
t. Review, approve, coordinate, refer response, environmental and litigation reports,
and recommendations for all cost recovery actions to the appropriate Office of the
General Counsel.

 Director of Public Affairs. The Director of Public Affairs is delegated the
responsibility for paragraph j.
3. Natural Resource Damage Assessment Actions.
 Director of Engineering and Aviation Management. The Director of Engineering
and Aviation Management is delegated the responsibility for paragraphs e, l, m, and
the following:
c. Pursuant to section 122(j)(1) of CERCLA (42 U.S.C. 9622(j)(1)), notify the
Washington Office, Director of Engineering; the Office of the General Counsel;
other trustees; and potential responsible parties of injuries to natural resources
resulting from the release or threatened release of hazardous substances or oil.
Encourage involvement by all other Federal trustees in order to avoid duplication of
effort; expedite the natural resource damage assessment; and present a coordinated
front to the potentially responsible parties.
n. When appropriate, enter into an interagency agreement with the Environmental
Protection Agency (after consultation with the Director of Engineering, Washington
Office) which sets forth a plan and schedule to achieve and maintain compliance for a
Forest Service facility pursuant to section 120 of CERCLA (42 U.S.C. 9620 et seq.).
o. Approve in writing the permanent treatment, storage, or disposal of hazardous
substances and wastes on National Forest System lands.
 Deputy Regional Forester for Operations. The Deputy Regional Forester for
Operations is delegated the responsibility for paragraphs f, h, i, and the following:
p. Send bills for collection for costs incurred pursuant to section 107(a)(4) of
CERCLA (42 U.S.C. 9607(a)(4)).
 Director of Public Services. The Director of Public Services is delegated the
responsibility for paragraph j.

2164.04d - Forest Supervisors
1. Removal and Remedial Actions. It is the responsibility of the Forest Supervisors to:
h. Review and sign administrative orders for access pursuant to section 104(e) of
CERCLA (42 U.S.C. 9604(e)) upon prior Department of Justice concurrence,
pursuant to Executive Order 12580, section 2(j).
i. Review all CERCLA-related correspondence and reports for technical accuracy
and ensure that appropriate correspondence procedures are followed.
j. Designate a Forest CERCLA Coordinator to provide overall leadership and
coordination for the Forest CERCLA program. This individual should also be an
advisory member of the Regional Hazardous Materials Committee.
