COLLECTION AGREEMENT
Between
The USDA Forest Service, Northern Region, Regional Office
and
State of Montana, Office of the Governor
THIS COLLECTION AGREEMENT, made and entered into by and between the State of
Montana, hereinafter referred to as The State, and the USDA Forest Service, Northern Region,
Regional Office, hereinafter referred to as The Forest Service, in connection with providing
training of interest to both parties in sharing resources, knowledge, and expertise of land resource
management for the public benefit, is entered into under the authority of the
INTERGOVERNMENTAL COOPERATION ACT OF 1968, Title III - P.L. 90-577.
WHEREAS, The Forest Service has a number of training programs and personnel skilled in
presenting training and working with land resource management for the public benefit, and
WHEREAS, The State has expressed a desire to share resources and participate with the Forest
Service in managment planning and training efforts, and
WHEREAS, both parties have individuals who have a need to gain these skills, and
WHEREAS, it is mutually beneficial for the Forest Service and The State to participate in joint
workshops to train these individuals.
NOW, THEREFORE, in consideration of the above premises:
A. The Forest Service shall:
1.
At the request of State Agencies provide a cadre of personnel to present the training
to an interagency group.
2.
Furnish the training materials.

3.
Notify the State of training available.
4.
Notify the State of estimated costs.
5.
Notify the State of training dates and locations.
6.
Bill requesting State Agencies for costs of their employees attendance.
B. The State shall:
1.
Provide interested State Agencies with the information about Forest Service
training.
C. The Interested State Agency shall:
1.
Reimburse the Forest Service for training costs for each employee's attendance in
conjunction with A. (3).
2.
Provide a listing of employees who will be attending each session.
3.
Certify that such services cannot be procured reasonably and expeditiously through
ordinary business channels in accordance with the policies set forth in the Office of
Management and Budget, Circular A-76.
IT IS MUTUALLY AGREED THAT:
1.
No member of, or delegate to, Congress or Resident Commissioner shall be
admitted to any share or part of this agreement, or to any benefit that may arise
therefrom: but this provision shall not be construed to extend to this agreement if
made with a corporation for its general benefit.
2.
This agreement shall be effective upon execution by both parties hereto, from last
date entered below, until October 1, 1995.
3.
This agreement may be modified upon mutual agreement of both parties.
4.
Either party may terminate this agreement by providing 60 days written notice:
Provided the State Agencies agree to reimburse the Forest Service for the work
performed prior to the termination date.
IN WITNESS WHEREOF, the parties hereto have executed this agreement as of the last date
written below.
