The sale was located on the Green National Forest, Fawn Ranger District, Fawn, Oregon. Due to your failure to complete this timber sale, the contract was terminated on October 25, 1992, pursuant to B9.3 - Breach and as authorized by 36 CFR 223.116(a)(1). In accordance with Contracting Officer John Doe's decision of December 24, 1992, damages resulting from this default were assessed against you in the amount of $16,999.30. The Buggy Fiber Salvage Timber Sale, Contract No. 065048, awarded to you on June 12, 1991, has $2,000 that is refundable to you. It is our intent to apply these funds to the damages involved in the High Fiber Salvage Timber Sale. It is also our intention to administratively offset any additional funds that may become due you on any other contracts that you may have with the Forest Service or other Federal agencies until this debt is paid. Before this administrative offset is processed, you have the right to: 1. Inspect and copy agency records related to this debt. You must pay the copying costs. 2. Enter into a written agreement to repay the debt, which must be approved by this agency. 3. Obtain review of the agency's determination that the debt exists and the propriety of administrative offset. You have 20 days from receipt of this letter to request in writing any of the above. Please send your request to my attention, at the above address. Hearing Officer Qualifications. The hearing officer shall be appointed by the Administrative Officer on the requesting unit in accordance with the parent text. When an administrative offset involves an FS-2400-6 or FS-2400-6T timber sale contract, the Administrative Officer shall provide the Director of Financial Management (FM) with a nominee. The Director of FM must either confirm the nomination or request the Administrative Officer to recommend another nominee. 13. Hearing Record. The hearing officer shall provide FM with a copy of the decision. FM shall forward a copy of the decision to the USDA Assistant Secretary for Administration.
