CHAPTER 4G33 - PROTESTS, DISPUTES, AND APPEALS
4G33.1 - PROTESTS
4G33.103 - Protests to the Agency
(a) If a protest is filed, the contract may not be awarded unless authorized by the
Head of the Contracting Activity (HCA). Also, refer to the FAR 33.103.
(1) If the award has occurred and the regulatory timelines for protest were met,
contract performance must be suspended unless continued performance is authorized
by the HCA.
(2) The Line Officer responsible for mission accomplishment prepares a written
justification for contract award as required by the FAR 33.103. The recommendation
is submitted through the Contacting Officer (CO) and the Chief of Contracting Office
(COCO) to the HCA for approval.
4G33.104 - Protests to the General Accounting Office
(a) Protests before award:
(1) If a protest is filed prior to award, the contract may not be awarded unless
authorized by the HCA.
(2) The Line Officer responsible for mission accomplishment prepares a written
determination for contract award as required by the FAR 33.104(b). The
recommendation is submitted through the Contacting Officer and COCO to the
HCAD and then to the HCA for approval.
(b) Protests after award:
(1) If the award has already occurred and a protest is filed within the regulatory
timelines, contract performance must be suspended, unless continued performance is
authorized by the HCA.
(2) The Line Officer responsible for mission accomplishment prepares a written
determination for continued performance as required by the Federal Acquisition
Regulation (FAR) 3.104(c). The recommendation is submitted through the CO and
the COCO, to Head of the Contracting Activity Designee (HCAD), and then to the
HCA approval.
