Public institutions and institutions with no physical presence in California are not required to seek approval
to operate in California.
Thank you for your inquiry. Under current policy, institutions must have a physical presence in the state to
qualify for state authorization. The definition of physical presence under this policy is a main campus or
headquarters, a branch campus, or a place of business as determined by the Department (CCHE policy,
Section I, Part J). I have attached a statement that summarizes the regulations for both the degree-granting
institutions and the private occupational schools wishing to operate in Colorado. Colorado has no
authorization process for pure online delivery instruction and out-of-state public institutions are handled the
same way private institutions are.
At present, the Office of Financial and Academic Affairs for Higher Education does not regulate placement of
students in experiential settings, unless the institution has a physical presence in Connecticut. In addition,
according to guidance released by the U.S. Dept. of Education on March 17, 2011 (GEN-11-05), a document
verifying no authorization is required by a state is not necessary for institutions to comply with the
regulations for state authorization (see #22), and the Office of Financial and Academic Affairs for Higher
Education does not issue such letters.

The University of Wisconsin-Stout is exempt from regulation by the North Dakota State Board for Career and
Technical Education. NDCC ch 15-20.4-02(6) exempts institutions “established, operated and governed” by a
state. By way of this e-mail, I am referring you to Dr. Janet Welk, Director, North Dakota Educational
Standards and Practices Board. ESPB may have requirements pertaining to your school’s online education
programs. It is my understanding all of the programs will be distance education which does not require any
additional correspondence for educator programs.

in Ohio; If students in the program would want to add the reading endorsement to their license, you could

physical presence. However, additional information is requested in order to determine the extent of the
University of Wisconsin-Stout’s (UW-Stout) physical presence. Your response should include: 1) Information
pertaining to proctored exams and experiential student learning activities (e.g., externship, internship,
clinical, practica, etc.) that may be required; 2) Whether the UW-Stout will have administrators or adjunct
faculty oversight for these requirements within the state; 3) If learning activities are required, please explain
the logistics associated with identifying a site and any administrative oversight for the learning activity (i.e.,
is the onus on the student or UW-Stout to identify the site and formalize any agreement); 4)Please indicate
what the level of involvement the site employees will have in evaluating the student’s academic performance
during the learning activity; and 5)Please include information on whether the UW-Stout employs, or will
employ, Oklahoma residents as adjunct faculty and whether these faculty members will convene students
residing in Oklahoma for any reason.

December 8, 2011 This memo is to inform you that the Texas Higher Education Coordinating Board has
approved new distance education regulations regarding Chapter 7 of the Texas Administrative Code:
DEGREE GRANTING COLLEGES AND UNIVERSITIES OTHER THAN TEXAS PUBLIC INSTITUTIONS that are now in
effect. The Coordinating Board considers exempt those institutions that are accredited by an accrediting
agency recognized by the Board and that have no physical presence as defined in 7.3 (29).
However, the Utah legislature recently passed SB 210 in response to 34 CFR 600.9. The law became
effective on May 10, 2011. This will be a filing for an accredited institution to obtain and renew a certificate
