The sale will be offered and sold on a hundred cubic foot (CCF) with total weight measurement. The volume harvested will be weighed and converted to CCF for reporting purposes. The conversion to be used in commercial aspen sales is 2.998 tons per CCF. See Section 53.41 for a appropriate contract language for a commercial aspen POL timber sale contract FS-2400-6. Timber sale contract form FS-2400-6T may be more appropriate if a sale primarily contains conifer sawlogs. Also, sales containing a commercial conifer POL component $2,000 or greater in advertised value will generally be offered on timber sale contract form FS-2400-6T. 53.41 – Division A(T) 1. A9 – Scaling Instructions and Specifications. See Regional direction. In addition, for commercial aspen POL sales enter “The conversion rate for products other than sawlogs is 2.998 tons per CCF.” 2. A10 – Scaling Services. For weight scaled commercial aspen POL sales, select “Total (100%) Weight Scale” for the scaling method within Timber Information Manager (TIM). 53.5 – Forest Products Removal Permit and Cash Receipt, Permit Form FS-2400-1 Region Two Policy regarding personal use fuelwood is found in FSM 2430.3, R2 Supplement. The Fuelwood Permit, as shown in Exhibit 2, shall be used on the Grand Mesa, Uncompahgre, and Gunnison National Forests for the sale of personal use fuelwood. All conditions of the permit shall be printed on the front and back of the Fuelwood Permit. Permits shall terminate on December 31 of the year issued. Permits are non-replaceable if lost, stolen, destroyed, etc., and non-extendable. Operation of power saws must be in compliance with the Rocky Mountain Fire Order listed under FSM 5331.01a, R-2 Supplement. Fuelwood gathering will be permitted in designated areas only. All or portions of the Grand Mesa, Uncompahgre, and Gunnison National Forests may be designated for fuelwood gathering; closures will be the exception. This permit is valid for a maximum of ½ cord. Permit is valid on lands administered by the agency whose shield is not crossed off. Permit is only valid on National Forest or BLM Field Offices as shown on the reverse side. Permit must be VALIDATED by completely removing the specific month and day of fuelwood removal from each permit, sign and securely attaching permit to the back of the load in a clearly visible location before any wood is transported. 2. The Permittee is authorized to cut and remove fuelwood by compliance with all conditions stated on this permit and any accompanying conditions. This permit and any accompanying conditions must be in possession during fuelwood cutting. 3. This permit is nontransferable. Payment for this permit is non-refundable. This permit will expire on the date indicated regardless of whether fuelwood is removed. 4. This is a PERSONAL USE permit. Each household is allowed to purchase up to ten (10) cords of fuelwood per year under this permit system. Cutting and removing fuelwood off of BLM or FS lands for other individuals for profit or gain is considered providing a service and is prohibited. Persons wishing to cut and/or sell fuelwood commercially must contact the BLM or Forest Service for proper permits. 5. Permittee authorizes BLM and/or Forest Service personnel or any law enforcement officer to conduct inspections during cutting or transportation of fuelwood to ensure compliance with all conditions of this permit. Violation of any of the conditions of this permit is punishable under Titles 36 and 43 of the Code of Federal Regulations and is subject to fines and jail time. The BLM/Forest Service reserves the right to unilaterally revoke this permit for Permittee’s noncompliance with its conditions or when revocation is in the public’s interest. 6. DO NOT block or leave slash on roads, shoulders or in ditches. 11. DO NOT damage vegetation, riparian areas, the forest floor, or road surfaces. Use of heavy equipment (such as tractors, bulldozers, skidders, etc.) is prohibited. DO NOT drive off roads in areas closed to motorized travel and do not drive on closed roads. Note that weather conditions may cause roads to be closed. 12. Permittee shall remove trash and litter resulting from Permittee’s activities. 13. Permittee shall prevent and suppress forest fires, pay the United States for any unnecessary damage resulting from Permittee’s activities, and repair all damage to roads, trails, fences, ditches, and telephone lines resulting from Permittee’s activities under this permit. 14. Chainsaws used must be equipped with a spark arrestor device properly installed, maintained, and in effective working order. Designate fuelwood areas that provide convenient access and fuelwood gathering opportunities for the typical personal use customer. The Forest Supervisor will be responsible for: 1. Coordinating the fuelwood program for the Grand Mesa, Uncompahgre, and Gunnison National Forests with the adjacent National Forests and Bureau of Land Management. 2. Preparing collection plans as appropriate for rate distribution of KV, BD, SSF, and road maintenance. One plan will be prepared for the Forest and signed by the Forest Supervisor unless otherwise prepared for a specific project. 3. Taking the lead role in ordering fuelwood permits in order to have the program operationally ready as soon as possible after January 1. A single, consolidated Forest Fuelwood Permit order will be submitted by the Supervisor's Office. A different colored fluorescent Fuelwood Permit will be issued for each calendar year. 4. Auditing fuelwood records at the end of the sale period and periodically during the sale period. The District Ranger will be responsible for: 1. Information that may be pertinent and necessary may be included, such as safety considerations, fire prevention messages, Forest Travel Management information, and location and telephone numbers of offices. The map is only intended as a general guide to the fuelwood cutting area. The map(s) must be legible and easily copied for the public. For clarity, do not include fuelwood permit requirements on the map. The map(s) must not be larger than 8 1/2" X 11", so it may require several sheets to cover the district. If an area is lettered or numbered, show the corresponding information by the same letter or number on the information sheet. See Exhibit 3 for an example. An information sheet may be attached to the map showing any accompanying conditions as well as general information that applies to an area. (The block on the permit must be checked when accompanying conditions apply.) The information sheet should also show road conditions (if accessible only by 4-wheel drive, so state) and distance from a well-known feature such as a highway or town. During the fuelwood season, notify the Forest Supervisor and Ranger District Offices immediately of any changes in the map or information sheet to prevent confusion. 2. Completing on-the-ground signing. ON-THE-GROUND SIGNING IS THE PRIMARY INDICATION OF THE OPEN AND/OR CLOSED FUELWOOD CUTTING AREA. 3. Ensuring the areas open to fuelwood gathering are not in conflict with Forest Travel Management Regulations. 4. Providing the number of Fuelwood Permits anticipated for the upcoming fuelwood season to the Forest Supervisor by November 1. 5. Providing any suggested changes in the Grand Mesa, Uncompahgre, and Gunnison National Forests fuelwood program. 6. Properly displaying and announcing the regulations, conditions, and guidelines for public purchase of fuelwood at each office. Permits shall be made available in Forest Service offices during time periods determined by the appropriate District Ranger. 7. Coordinating the program with local law enforcement agencies. 8. Inspecting fuelwood gatherers for clearly visible validated Fuelwood Permits and compliance with all pertinent Code of Federal Regulations (CFR's). 9. Submitting KV, BD or SSF plans for District-specific projects for Forest Supervisor review and approval. 10. Issuing appropriate news releases to fully inform the public of where, when and how they can secure fuelwood. The release should contain the type of material, whether green or dead, Fuelwood Permit procurement arrangements and Fuelwood Permit requirements (as appropriate). The permit system is designed to be in compliance with Colorado law HB 1248 concerning transportation of forest products. The permit must be in possession during fuelwood cutting and gathering, and must be validated and securely affixed to the back of the load for each ½ cord, or portion thereof, and be clearly visible prior to transporting. (Any timber removed from the National Forest System lands without a permit is considered theft of Government property and must be handled in accordance with FSH 5332.2 and 36 CFR 261.6.) The Fuelwood Permit must be validated by: Punching out the month and day printed along the edge of the permit using a punch, nail, pencil, etc.; and Signing the permit before fuelwood is transported. The Fuelwood Permit shall consist of ½ cord cards. Each Fuelwood Permit shall have a unique number. The purpose of the permit is to account for the number of loads removed and whether authorization was received for removal. The Fuelwood Permit is printed on radiant fluorescent bristol PT10 paper; the color is to be changed annually. When properly placed on the rear of a fuelwood load, the radiant color is highly visible at a distance to identify loads and indicate compliance. Each permit represents ½ cord of fuelwood. A cord of wood is 128 cubic feet. It is usually expressed as the wood occupying a space of 4 feet X 4 feet X 8 feet. To find out how much wood a vehicle will hold, measure the length, width, and the expected height of the load in the cargo area. Multiply the measurements together, divide by 128, and this will be the amount of cords. General examples of load combinations follow: Most full size pickups will hold ½ cord of fuelwood. In this instance, at least one permit per load shall be used. If the purchaser uses a trailer, a permit shall be placed on fuelwood in the trailer. If the wood is hauled in a pickup with an additional load in a towed trailer, the Fuelwood Permit(s) shall reflect the total amount of wood transported (rounded up to the next half cord). In the case of an oversized vehicle such as a two-ton stake truck, adequate permits must be used to approximate the number of ½ cord units being hauled (rounded up to the next half cord). Upon purchase of a permit, the permittee shall be provided the following: Fuelwood Permits corresponding to the quantity of ½ cords purchased, a map showing the areas open to or restricted from fuelwood gathering, and GMUG SUPPLEMENT 2409.18-2500-1 EFFECTIVE DATE: November 15, 2005 DURATION: Effective until superseded or removed 2409.18_50 Page 16 of 19 FSH 2409.18 – TIMBER SALE PREPARATION HANDBOOK CHAPTER 50 – FINAL PACKAGE PREPARATION, REVIEW, APPRAISAL AND OFFERING – GATE 4 an information sheet showing any accompanying conditions and general information that applies to an area. Signs shall be posted on all roads entering the Forest indicating a permit is required for removal of forest products. Entrances and exits of designated fuelwood areas shall be clearly signed. Timber sale log decks and other wood products may be posted with a cardboard or metal sign stating "Unauthorized Removal of this Wood Prohibited Under Penalty of Law" (metal sign available through GSA). Timber sale areas shall be posted, showing no fuelwood cutting or removal. Timber shall be designated as follows: 1. All standing dead and down timber within designated fuelwood areas may be sold, except those marked to be retained for wildlife or other purposes. 2. Where green timber is to be designated for fuelwood, the marking or designation shall be by one of the following methods: a. Trees to be cut are to be marked with a spot of paint at diameter breast height (d.b.h.) and below stump height (any color of paint except orange). Color of paint shall be specified on the fuelwood map or information sheet. b. "Leave" trees are to be marked with orange paint at d.b.h. and below stump height. c. Stands of timber may be designated for cutting by marking the boundary trees with orange paint. d. Green oak may be designated for cutting by showing that area on a fuelwood map. Trees infested with insects, or diseased trees, may be sold for fuelwood. However the permittee should be notified that the State of Colorado has approved specific locations to where insect infested trees may be hauled. It is the responsibility of the permittee to maintain compliance with the Pest Control Act which states, "The Colorado Department of Agriculture Pest Control Act, Chapter 6, Article 10, of May 1, 1972, amended 1978, makes it unlawful to possess or transport into or within the State of Colorado all or any part of trees currently infested with mountain pine beetles." The fuelwood program is authorized to be prepared and administered with benefiting funds, i.e. fuel management, wildlife habitat improvement, TSI, etc. (See FSM 2435 for SSF authority.) BD (Brush Disposal) funds from timber sale contracts may be collected and used to prepare timber sale residue for fuelwood gathering as long as this is the most economical method to accomplish the treatment identified in the approved BD Plan. Benefiting appropriated funds (except road construction) may be used to construct or reconstruct nonsystem roads to access fuelwood cutting areas. KV (SAI) and BD monies may be used to close and rehabilitate nonsystem roads when closure is not the responsibility of the purchaser and meet KV and BD requirements. (See FSH 6509.11k, Chapter 10, for specific authorizations.) They will be transferred to each District selling Fuelwood Permits using an AD-107. The District's Accountable Property Officer shall transfer the needed supply of permits for the season to each Forest Officer. Forest Officers shall not transfer any of their supply to another Forest Officer unless an official transfer is executed. Current year permits shall be accounted for and secured. Qualified Forest Officers, who are often also Collection Officers (FSM 6530), can sell Fuelwood Permits utilizing established procedures for the cash register sales. Money from the sale of these permits must be remitted to lockbox. The submission of funds must be in a timely manner using a Bill for Collection (generated by TIM) in compliance with FSH 6509.14, Collection Officer Handbook. The Bill for Collection is the receipt for permits sold. The number of permits sold for the period should be clearly marked on the Bill for Collection. Standard procedures for destruction of accountable property shall be used. Unused permits shall be accounted for and destroyed using an AD-112 at the end of the calendar year by the issuing units in accordance with FSM 6400 Personal Property Management. 53.51 – Payments and Other Collections Applicable methods of payment are disclosed in Washington Office direction. This permit will be handled over the counter and be considered as a cash register sale. Established procedures for cash register sales shall be used (FSM 2431.31c). The minimum charge for permits is $20.00 per transaction. Permits may be sold in ½ cord increments as long as the total transaction meets or exceeds the minimum charge. Payment for Fuelwood Permits is non-refundable. Examples of calculating minimum charge: Assume $10.00 per cord if 5.0 cords requested: $10.00/cord X 5.0 cords = $50.00 total sale value if 1.0 cord requested: $10.00/cord X 1.0 cords = $10.00; $20.00 total sale value Each HOUSEHOLD is allowed a MAXIMUM of ten (10) cords of fuelwood per calendar year obtained under this program. (A household is defined as a person or persons residing at the same address.) See FSM 2435 for exceptions. Available revenue between minimum rate and the standard rate may be used for distribution under an approved KV (SAI), Salvage Sale Fund (SSF), or Brush Disposal (BD) plan and road maintenance subject to the following restrictions: 1. The revenue is not needed to meet the collection amounts identified in approved SSF and SAI plans, or 2. There is a site-specific plan on file that displays commensurate use and basis for road maintenance collection and/or there is an approved site-specific BD plan. Until revoked by a newer Forest Collection Plan or modified by a Forest Supervisor approved District Plan, the allocation rate on the GMUG will be $0.25/cord to NFF and $9.75/cord to SSF. 53.53 – Use of Permit Form FS-2400-1 To Summarize Permits Fuelwood Permits will be batched to summarize and report total volume and value through Timber Information Manager (TIM) in accordance with Washington Office direction. 54.1 – Performance Bonds in Timber Sales Penal Sum of Performance Bond. Performance bonds computed as a percent of bid value for sales having low appraised values, or unusually high resource values may be insufficient to cover potential damages resulting from the purchaser's failure to satisfactorily complete contractual obligations. An alternative method shall be used to compute a minimum value of the bond. The minimum amount of the bond shall be determined as a percentage of advertised stumpage value and comparing it to the estimated cost of significant potential work remaining at the end of the average operating season. The larger of the two calculations is used for the minimum performance bond.
