Safety Compliance Policy
__________________ is committed to providing an accident-free workplace. In order to help assure that
this commitment is kept, the company has established the following Safety Compliance Policy.
Policy Statement
Any employee who knowingly violates, supervisor or manager who has knowledge of and allows the
occurrence or continuation of a violation of the _____________ Company safety program, rules,
procedures or policies which results, or could result, in death or personal injury, shall be subject to
disciplinary action in accordance with this policy. The terms “knowingly” and/or “knowledge” are
defined as having information of facts and/or events that could have prevented the unsafe act or condition
from occurring.
NOTHING IN THIS POLICY SHOULD BE CONSTRUED TO ALWAYS REQUIRE PROGRESSIVE
DISCIPLINE IN EVERY SITUATION. THE COMPANY RESERVES THE RIGHT TO
IMMEDIATELY TERMINATE ANY OF ITS EMPLOYEES FOR VIOLATIONS OF THE COMPANY
SAFETY POLICY, RULES AND/OR PROCEDURES.
_____________________ shall decide whether a violation has occurred and the appropriate disciplinary
action to be taken. When the supervisory level personnel violates company policy, a higher level member
of management will perform the investigation and determine the appropriate disciplinary action to be
taken.
The _________________ is responsible to see that this policy is implemented and immediate corrective
action is taken on all identified violations.
Safety Violation Definition
A safety violation exists when there is a probability that actions, practices, methods or operations result or
could result in death or physical harm to any person.
A safety violation could also be identified when an employee exhibits a history of being involved in or
contributing to an accident(s) that results or could result in death or physical harm/injury.
Such a violation tends to establish that the employee has failed to comply with safe work practices and/or
that the employee cannot perform the essential functions of their position without presenting a direct
threat to their own health and a safety and/or health and safety of others.
A violation will also exist when an employee fails to provide notice of an injury or accident (that may or
may not result in physical damage or injury) to their supervisor within (suggested 24-48 hours) from
when an employee knows or reasonably should know that an accident or injury has occurred.
Violation Identification
Identification of safety violations will occur as the result of:

Observation by any level supervisor or management personnel.
Brentwood Services Loss Control




Facility safety inspections.
Facility safety audits conducted by safety committee or others authorized to inspect facility in
behalf of the Company.
Accidents where death or occupational injury results or could result.
OSHA compliance inspections.
Disciplinary Action
Disciplinary action will be administered by management and may include, depending on the specific
incident, verbal warnings, a written safety reminder and/or termination.
Prompt disciplinary action will be taken as soon as practical following the identification of safety
violations. However, any employee charged with a violation of the company safety program to which
this Safety Compliance Policy is applicable, shall be given opportunity to explain their conduct to their
supervisor and management prior to the Company imposing discipline on that employee under this policy.
First and Second Occurrence of Safety Violation
The employee will:


Be issued a verbal warning documented by an employee safety reminder notice, which will be
made part of the employee’s personnel record. (NOTE: The employee may be terminated or a
written reminder notice issued depending on the severity of the safety violation.)
Receive a review of the applicable safety requirements.
Third Occurrence of Safety Violation
The employee will:



Be issued a written safety reminder notice signed by the employee and copy made part of the
employee’s personnel record.
Receive a review of the applicable safety requirements.
Receive an additional safety training and counseling session.
Fourth Occurrence of Safety Violation
The employee will be immediately terminated and a separation report completed showing termination for
violation of safety policy.
Employees terminated for a safety violation will not be eligible for rehire for one (1) year.
Warning Notice Expiration
The record of employee safety reminders shall expire in one (1) year from the date of each violation.
