PREQUALIFICATION REQUIRED Notice is hereby given that the MENLO PARK FIRE PROTECTION DISTRICT (the “DISTRICT”) has determined that all bidders on the construction of Fire Station 6 (the “Project”) to be undertaken by the DISTRICT must be prequalified prior to submitting a bid on that Project in compliance with Resolution #1812-2015. It is mandatory that all Contractors who intend to submit a bid for the Project, fully complete the prequalification form, provide all materials requested herein, and be approved by the DISTRICT to be on the final qualified bidders list. No bid will be considered from a Contractor that has failed to comply with these requirements. If two or more business entities submit a bid as part of a Joint Venture, or expect to submit a bid as part of a Joint Venture, each entity within the Joint Venture must be separately qualified to bid. The last date to submit a fully completed prequalification form is 01/12/2016 at 3:00 PM. Contractors are encouraged to submit prequalification packages as soon as possible, so that they may be notified of omissions of information to be remedied or of their pre-qualification status well in advance of the bid advertisement for this project. The Project includes demolition of the existing Fire Station and other buildings located at 700 Oak Grove Avenue, Menlo Park and the construction of a new two story Fire Station, Engine Display building and the relocation of a carriage house. The DISTRICT will maintain operations at this location throughout construction. This is an essential service building which will require full time ongoing inspection. The Inspector of Record shall verify that materials onsite are per approved submittals and installations are per the plans and specifications. This level of inspection is in addition to the required City and Fire District inspections. Part 1 is a Contractor Responsibility Questionnaire. Part 2 concerns the bidder’s past public contracting experience on similar projects. Part 3 concerns the Contractor’s qualifications. Part 4 concerns the proposed superintendent on the project. The DISTRICT will score the information provided in Parts 1-4 in accordance with the DISTRICT’S objective scoring criteria. Answers to questions contained in the attached form are mandatory. Contractor also agrees to provide all supplementary information requested, including, but not limited to the following: current bonding capacity, notarized statement from surety, and the most recent reviewed or audited financial statements with accompanying notes and supplemental information. A bidder that does not achieve a passing score will be deemed not qualified for purposes of this Project. The DISTRICT may refuse to grant qualification where the requested information and materials are not provided, or not provided by the designated date. The closing time for bids will not be changed in order to accommodate supplementation of incomplete submissions, or late submissions. Each prequalification package must be signed under penalty of perjury in the manner designated at the end of the form, by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the DISTRICT and provide updated accurate information in writing, under penalty of perjury. The DISTRICT will use the information contained in the prequalification package to determine whether, pursuant to applicable law, a bidder is deemed qualified for purposes of this Project. The information contained in the prequalification form is provided under oath. False information provided in a Prequalification Package or the omission of relevant information therefrom may, in itself, be sufficient to support a determination that a bidder is not qualified. The DISTRICT reserves the right to check other sources available. The DISTRICT’S decision regarding bidder qualification will be based on objective evaluation criteria. While it is the intent of the Prequalification Form and documents required therewith to assist the DISTRICT in determining bidder responsibility prior to bid and to aid the DISTRICT in selecting the lowest responsible bidder, neither the fact of pre-qualification, nor any prequalification rating, will preclude the DISTRICT from a post-bid consideration and determination of whether a bidder has the quality, fitness, capacity and experience to satisfactorily perform the proposed work, and has demonstrated the requisite trustworthiness. The DISTRICT reserves the right to adjust, increase, limit, suspend, or rescind the prequalification rating based on subsequently learned information. Contractors whose rating changes in a manner sufficient to disqualify them will be notified and given an opportunity for a hearing consistent with the procedures described below for appealing a pre-qualification rating. The DISTRICT reserves the right to waive minor irregularities and omissions in the information contained in the prequalification package submitted, to make all final determinations, and to determine at any time that the prequalification procedures will not be applied to a specific future public works project. The DISTRICT reserves the right to reject all pre-qualification responses. The DISTRICT reserves the right to re-submit a pre-qualification questionnaire if the DISTRICT elects to reject all pre-qualification responses. The DISTRICT will provide notice to each responding entity in the event it elects to reject all pre-qualification responses. Where a timely and completed Prequalification Package results in a rating below that necessary to qualify, an appeal can be made. An appeal may be made by the bidder by delivering a notice to the DISTRICT of its appeal of the decision with respect to its qualification rating, no later than two working days after the notice of a finding. Upon request of the Contractor, the DISTRICT will provide notification to the Contractor in writing of the basis for the disqualification and any supporting evidence that has been received from others or adduced as a result of investigation. The Contractor shall be given the opportunity to rebut any evidence used as a basis for disqualification and to present evidence to the DISTRICT as to why the Contractor should be found qualified. If the Contractor chooses not to avail itself of this process, the proposed qualification rating may be adopted without further proceedings. Without a timely appeal, the bidder waives any and all rights to challenge the decision of the DISTRICT, whether by administrative process, judicial process or any other legal process or proceeding. The Fire Chief or his/her designee shall make the final determination concerning appeals based upon the facts set forth in the notice. It is the intention of the DISTRICT that project schedules and deadlines will not be delayed or postponed to allow for completion of an appeal process. The pre-qualification packages submitted by Contractors are not public records and are not open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed to third parties for purpose of verification, or investigation of substantial allegations, or in the appeal hearing. State law requires that the names of contractors applying for pre-qualification status shall be public records subject to disclosure, and basic Contractor identification information will be used for that purpose. Each Contractor that completes this questionnaire may request that the DISTRICT use the completed questionnaire for consideration of the Contractor for bids on future DISTRICT projects for up to one year after submission of the completed questionnaire.
