COMPLAINT CHECKLIST ☐Your request and proof that the district received it. ☐Statement of Facts: names, dates, and sequence of events ☐Federal Regulations violated/noncompliance ☐Your Remedy ☐Evidence: your dated written request, emails, IEP/504, report cards, communication to and from school, diagnosis from doctor, etc anything to support your allegations, NOT YOUR FEELINGS…FACTS ☐List your evidence on a separate sheet ☐Sign and Date your complaint ☐Send copy of complaint to State(as instructed on complaint form), District and OSEP ☐Keep a copy for your records to track the 60 days ☐Wait for the findings FYI: THERE ARE NO GUARANTEES THAT YOU WILL WIN IN THIS PROCESS HOWEVER THE MORE FACTS, THE MORE DOCUMENTS THAT ARE PROVIDED AND THE MORE REGULATIONS THAT ARE INCLUDED TO SUPPORT YOUR ALLEGATIONS THE BETTER YOUR CHANCES. YOU CAN INCLUDE AS MANY VIOLATIONS OF NONCOMPLIANCE AS YOU WISH, BUT BE CAREFUL THE MORE COMPLEX THE LEAST LIKELY THE INVESTIGATOR WILL COVER ALL OF YOUR COMPLAINT. KEEP YOUR COMPLAINT CLEAR AND CONCISE AND IN SEQUENTIAL ORDER OF EVENTS. FROM THIS DAY FORWARD YOU MAKE ALL OF YOUR REQUESTS IN WRITING AND FORCE THE DISTRICT TO DO THE SAME. IF THEY CALL YOU, LET IT GO TO VOICE MAIL. IF THEY LEAVE A MESSAGE IT CAN BE USED AS EVIDENCE BECAUSE THEY ARE INFORMED THAT THEY ARE LEAVING A MESSAGE. THEN RESPOND TO THAT MESSAGE IN WRITING. IF THE DISTRICT REFUSES TO PUT SOMETHING IN WRITING, NO PROBLEM YOU DO IT. IT SHOULD LOOK SOMETHING LIKE THIS: “Dear whoever, pursuant to our conversation earlier today in which we discussed yada yada yada, you stated that…… I disagree and this is what I want from the district as I stated to you during our conversation….” ALWAYS CYA(COVER YOUR ASS) AND THE BEST WAY TO DO THAT IS IN WRITING. EVEN TEXT MESSAGING CAN BE USED AS EVIDENCE IN YOUR COMPLAINT.
