This Privacy Policy discloses the privacy practices for XYZ Pvt. Ltd.[*], which includes www.[*].com, websites contained within or otherwise available through external hyperlinks within such websites, certain mobile versions and apps of the foregoing, and associated social media outlets (collectively, the "Site"). XYZ Pvt. Ltd [*],(herein after referred to as "Binj”), registered under the Companies Act, the provider of the Site, is committed to protecting the user’s privacy online. By using and/or browsing this Site, you (hereinafter referred to as “User”) agrees to this Privacy Policy, the Terms of Use and all applicable laws governing its use. Please read the following document to learn as to, what information Binj collects from the User and how the collected information is used. The User is advised to check this page periodically for updates, as the User’s continued use of this Site signifies his / her acceptance of any changed terms. Binj reserves the right to revise this Privacy Policy at any time and without notice. Any such revision will be effective immediately upon its posting on this Site.

Please note that by submitting data (personal or otherwise) manually or in electronic form to Binj and/or by using the Site, the User gives his / her consent that all data (personal or otherwise) submitted on each occasion may be processed by, and/or shared with Binj and its affiliates and related companies, in the manner and for the purposes described in this Privacy Policy.

Information collection and use

Binj collects two types of information about the Site Users: Personally Identifiable Information and Non-Personally Identifiable Information.

Personally Identifiable Information: Personally Identifiable Information is information that identifies a specific User. When the User engages in certain activities on or off the Site, such as creating an account, signing in to User account, submitting content and/or posting User Content, entering a contest sponsored by Binj or its partners, filling out a survey, posting a review, sending Binj or its partners feedback, requesting information about Binj’s services, posting a video or signing up for special offers from third parties etc, through the Site (collectively,

"Identification Activities"), Binj may ask the User to provide certain information about himself / herself. It is optional for the User to engage in an Identification Activity. If the User elects to engage in an Identification Activity, Binj may ask User to provide Binj with certain personal information about himself / herself, such as User’s first and last name, mailing address (including zip code), email address, telephone number, date of birth and Binj.com[*] account information.

When the User makes reservations or purchases services, Binj may also ask User to provide Binj with User’s credit card number, expiration date and authentication codes or related information.

Binj may also know User’s location if the User access’s the Site. Depending on the activity, some of the information asked to be provided is identified as mandatory and some is identified as voluntary. If the User does not provide the mandatory information for a particular activity that requires it, the User will not be permitted to engage in that particular activity. Binj may collect, use and store Personally Identifiable Information, including credit card information, to provide services to the User, make the log-in and checkout process easier, administer contests, help User track User’s past research and orders, enhance the operation of the Site, improve Binj’s

marketing and promotional efforts to User’s tastes and location, customize future service interests, analyze Site use, improve Binj’s service offerings.

If the User provides User Content, such as an email to Binj’s customer service or response to a restaurant survey, Binj may use the User comments and feedback to tell others about Binj’s services, and may post the User comments in Binj’s marketing materials or on Binj’s Site. In connection with such User Content Binj may also display partial information such as first name, initial of last name, city and state of the User. Such partial information is not considered

Personally Identifiable Information.

In addition, if the User uses the Site to send information to another person, Binj may store User’s personal information, and the personal information of any recipient. Binj may use that other person’s contact information to allow the recipient to access the information requested to be sent by the User. Binj may also use Personally Identifiable Information to troubleshoot, resolve disputes, accomplish administrative tasks, contact User, enforce Agreements with User, including Site Terms of Use and this Privacy Policy, comply with applicable law, and cooperate with law enforcement activities.

Non-Personally Identifiable Information: Non-Personally Identifiable Information is information that does not identify a specific User. This type of information may include things like the Uniform Resource Locator ("URL") of the website, User visited before coming to the

Site, the URL of the website User visits after leaving the Site, the type of browser User is using and User’s Internet Protocol ("IP") address. Binj, and/or its authorized Third Party Service

Providers and Advertisers, may automatically collect this information when the User visits the

Site through the use of electronic tools like Cookies and Web beacons or Pixel tags.

Non-Personally Identifiable Information is used by Binj to troubleshoot, administer the Site, analyze trends, gather demographic information, comply with applicable law, and cooperate with law enforcement activities. This information may be shared by Binj with its authorized Third

Party Service Providers and Advertisers to measure the overall effectiveness of our online advertising, content, and programming.

Mobile Information

The User may submit personal information via User’s cell phone, smart phone, or tablet. If the

User’s uses any location-enabled products, the User may be sending Binj location information.

Binj does not store or use this information other than to provide the service requested by the

User, under this Agreement.

For example, a mobile product may use GPS data to find a nearby restaurant as requested by the

User. Location-enabled features are opt-in and the User acknowledges its control over his / her participation in such services and can turn these services off at any time.

Web-enabled mobile applications may use cookies or web beacons and other methods to customize the User’s browsing experience. Binj may use mobile device IDs (the unique identifier assigned to a device by the manufacturer), instead of cookies, to recognize the User. This may be

done by Binj in order to store User preferences and track User’s use of the Applications. Unlike cookies, device IDs cannot be deleted.

Binj may use a variety of new technologies and social media options to communicate and interact with consumers. These websites and mobile applications include popular social networking and media sites, such as, Twitter and Facebook. Use of third party social networking websites, such as, Twitter and Facebook, are governed by the privacy practices of those websites.

Binj does not capture or store User’s login information or any other personally identifiable information for Twitter, Facebook, and other social networks, however, session information or cookies may be stored on User wireless phone, by their websites.

Use of Information Collected

Binj will not rent or sell the information to any unaffiliated third parties in any way not described in this statement, or authorize any of Binj third party partners to sell or rent any such personal information. Binj gathers personal information when voluntarily submitted to Binj by the User as discussed within this statement. Binj does not authorize third parties unaffiliated with Binj to make independent use of User’s information for their own purposes, such as for direct marketing.

Additionally, Binj may share the User’s information with Binj’s affiliates, franchisees, licensees, lenders, investors, restaurants and/or third party providers.

Binj may share the information with restaurants (hereinafter “

Affiliated Restaurants”) whose information is made available through this Site, in order to help them provide User with better service.

Binj may share User information with Marketing Partners.

From time to time Binj may establish a business relationship with third parties. These are known as our "Marketing

Partners". Binj may share User’s Personally Identifiable Information with its Marketing

Partners to enable them to contact the User regarding products, services, and special offers that may be of interest to the User.

Binj may share User information with Authorized Third Party Service Providers . Binj may provide some of its services and through third parties. These "Third Party Service

Providers" perform functions on Binj’s behalf, like sending out and distributing Binj’s administrative and promotional emails. Binj may also collect personal information from individuals and companies ("Affiliates") with whom Binj has business relationships and may have to also share their information with Service Providers to accomplish our administrative tasks. For example, when User orders a service, Binj may release User’s credit card information to the card-issuing bank to confirm payment for the service and, if applicable, release User address to the delivery service to deliver the service.

 Binj may share User’s information in a Business Transfer: In the event of Binj’s merger with, or Binj is acquired by another company. If this occurs, the successor company would acquire the information Binj maintains, including Personally Identifiable

Information. However, Personally Identifiable Information would remain subject to this

Privacy Policy. Binj may share User’s information for Binj’s Protection and the

Protection of others.

Binj may also disclose Personally Identifiable Information when Binj has reason to believe, that release is appropriate to comply with the law or a court order; enforce or apply this Privacy Policy, Terms of Use or other agreements; or protect the rights, property or safety of the Site, its Users or others.

Binj may contact the User, in order to comply or cooperate with a legal request. For this purpose, Binj will use the email address provided to Binj by the User. All communications sent by Binj at such email address shall be deemed to have been communicated to User.

Mobile information sharing

Binj does not share any collected information with Third parties with the following exceptions:

Binj may provide some personal data to third-party partners that are providing services essential to User’s mobile user experience.

All requests are sent through User’s mobile network provider and User’s network provider may have access to it. The User may consult the network provider's privacy policies for additional information.

Certain mobile products and services and manufacturers allow the User to interact and share User’s information with others. For example, the User may want to Tweet or post to his / her Facebook page content from Binj’s mobile application. The User may consult his / her mobile device manufacturer, or mobile product or application developer's privacy policies for additional information.

 Ad companies may use device IDs to track User’s use of the Applications, track the number of ads displayed, measure ad performance and display ads that are more relevant to User. Analytics companies may use device IDs to track information about usage of the

Binj generally follows accepted industry standards to protect the personal information submitted to it, both during transmission and once received by it. However, no method of transmission over the Internet or via mobile device, or method of electronic storage, is 100% secure. Therefore, while Binj strives to use commercially acceptable means to protect User’s personal information,

Binj cannot guarantee its absolute security.

Cookies

When the User views the Site, Binjr may store information on User’s computer called a

"Cookie". A Cookie helps Binj to tailor its Site to match User preferences and interests. Most

Internet Browsers allow the User to erase, block or give a warning before a Cookie is stored. The

User will be able to visit most of the areas on Sites without a cookie being stored.

Binj may occasionally provide links to third party websites on the Site. These links are provided to further information and enjoyment of User’s web experience from the Site. These websites may use their own cookies or solicit personally identifiable information from the

Data Retention and Account Termination / opt-out

The User can at any time choose to close his / her account by visiting his / her profile settings page on the Site. Binj will remove User’s public posts from view and/or dissociate them from

User’s account profile, but Binj may retain information about the User for the purposes authorized under this Privacy Policy unless prohibited by law. For example, Binj may retain information to prevent, investigate, or identify possible wrongdoing in connection with the

Service or to comply with legal obligations.

Age restrictions

We donot intent to target our Services to children under the age of thirteen (13) years as the child privacy laws prohibits collection of personal information of children who are under the age of

13. If the User provides us with personal information, the User represents that he / she is at least

13 years old. Binj does not knowingly request, solicit or collect personal information from any person known to be under the age of 13.

If the User becomes aware that a child has provided Binj with personal information without parental consent, please immediately contact Binj at [*]. If Binj becomes aware that a child under 13 has provided Binj with personal information without parental consent, Binj will take steps to remove such information and terminate the child's account.

Disputes and Jurisdiction

This Agreement will be governed by and construed in accordance with Laws of India, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Delhi. However the Parties agree that before approaching the courts the Parties shall refer the dispute to the sole arbitrator Mr.__________ (Name of the Legal Director / VP of the

Company) for resolution of dispute in accordance with Arbitration and Conciliation Act, 1996.
