Project Name and Sponsor Note: In most instances, the Project Sponsor is a Wyoming County Government. The Sponsor must initiate appropriate authorizing action – Authorizing Resolution – approved at a public meeting and signed by the sponsoring body. A sample copy of this resolution is included as Appendix A of this application. A copy of the Authorizing Resolution and/or reference to the meeting minutes should be included with this application. If the Project application is approved by the Wyoming Transportation Commission, the Project Sponsor agrees to enter into a Project agreement with WYDOT for funding and Project responsibilities. The law requires that you provide your Data Universal Numbering System (DUNS) number to WYDOT. This requirement means you need to be registered with DUNS and Bradstreet. Project Description Please give a brief, but concise description of the proposed Project. Since these CMAQ Projects emphasize improving air quality by addressing Transportation-induced source emission and reducing Ozone (O3) precursors, such as: Volatile Organic Compounds (VOC’s), Nitrogen Oxides (NO x), Carbon Monoxide (CO) and Particulate Matter (PM, aka dust); describe the proposed dust or compound suppressant technique, and current condition of the roadway. Include a description of any geographical or environmental features which may be sensitive and will be impacted by this Project i.e., a stream crossing or wetland intrusion to the work site. Please include a map of the general Project area. It is preferred, for reproduction purposes, that this map and other supporting documents are in standard letter size (8.5” x 11”) format. If available, attach photo(s) which illustrate current road conditions. Page 3 of 8 WYDOT is currently determining the most cost effective method to obtain air quality monitoring. Air Quality Monitoring is a requirement of this Project and arrangements for preProject and post-Project testing is the responsibility of the Project Sponsor. It is still the responsibility of the Project Sponsor to make arrangements for this Air Quality Monitoring to be completed. Please provide your anticipated start and completion dates for this Project. The work under this funding cycle would most likely start in the fall of 2013 or spring of 2014. Air quality monitoring is an eligible expense for reimbursement under the CMAQ Program. WYDOT will inform Project Sponsors in the event that other arrangements need to be made. Public Participation Effort An important part of applying for Federal Project funding is public involvement in the planning of the Project. This can be satisfied by the Sponsor by various means. Communication with the public can be accomplished by using broadcast media, public meetings, and printed articles. Whichever form of public participation effort is used, it should be documented and retained as a permanent record by the Sponsor and may be submitted as part of this application. These records must be made available to the public and must be available for inspection by federal, state and local representatives. A Public Interest Finding for force account work or soul source procurement should be included in your public participation effort. Briefly describe these efforts in the space below: 6. Planning and Preliminary Considerations Please describe the Project planning and road selection criteria prior to this application being submitted. Please include the following information in the spaces provided below: Page 4 of 8 1. Has the planning been formal or informal? 4. Does the Project conform to all local ordinances, rules and regulations? 2. Does the Project have positive approval of the community? 5. Will the County use its own forces for any chemical applications, or use qualified contractors? 3. Has the county used this type of suppressant in other Projects? Note: The intent of the CMAQ Program is for the Project Sponsor to competitively bid the Project to a qualified contractor. If the County uses its own workforce, a Public Interest Finding (PIF) must be sent to and approved by the WYDOT District Engineer for your respective area prior to beginning work. A sample of the information needed in a PIF is included as Appendix B of this application. 7. Real Property Acquisition The ownership of the Right-of-Way or easement, for a CMAQ Project must vest with the Sponsor. It is advised that the Right-of-Way for any Project be secured before the application for the Project is submitted. The location of the roadway may be assumed under the County Road System, yet encumbered in some way. The title to the property must not be encumbered with conditions or reservations which prohibit the requested dust abatement Project. If the there is any question as to ownership or title for the property is in question, a title search would be advisable. The Sponsor will be required to complete a WYDOT Right-of-Way Clearance Form, WYDOT Form LP2, prior to implementing the proposed CMAQ Project. A copy of WYDOT Form LP-2 is included as Appendix C with this application and must be in the Project file prior to the Sponsor receiving a Notice to Proceed. It is preferred that the Right-of-Way and Utilities Certificate be submitted with the application. Please answer the following question: What is the current status of the required Real Property and/or Right-of-Way for the Project? Is there any Real Property and/or Right-of-Way remaining to be acquired? If so, how much? Will any required Real Property and/or Right-of-Way be purchased with CMAQ funds? Page 5 of 8 8. Project Maintenance Project maintenance and perpetual care will be the responsibility of the Project Sponsor. Another party may do the actual physical maintenance, if an agreement is entered into between that party and the Project Sponsor. Should the public interest and ownership change in the future, the public maintenance responsibility can be passed along with the public title. (i.e.: County road ownership would be changed from County to City via annexation). Please state whether the Project sponsor will be responsible for the maintenance directly or whether an agreement for maintenance will be entered into with another party. A copy of this Memorandum of Understanding (MOU) must be on file in the Local Government Office and should be included with this application. 9. Environmental Considerations As part of the Project, the Sponsor must comply with all Federal and State environmental regulations. Projects involving construction or combined with a larger construction/reconstruction Project will require completion of an Environmental Field Review, prior to a Categorical Exclusion being issued. The Environmental Field Report must be submitted to WYDOT and a Categorical Exclusion must be issued by the Federal Highway Administration (FHWA) prior to construction. In addition, it may be necessary to contact the State Historic Preservation Office and the Corps of Engineers (Federal) for input and approval of the Project. (Note: planning only Projects are exempt from the Environmental Field Review Report) Does this proposed Project have any unusual environmental features associated with it? Are there any registered historic structures or sites involved with the Project? Are there any live watercourses or bodies of water being encountered? Note: if the proposed Project is to apply a chemical dust suppressant to reduce dust on a county road, the Project can be included in a Blanket Categorical Exclusion issued by WYDOT. To be included in WYDOT’s Blanket Categorical Exclusion, the Project must be conducted on an established, existing county road section and within the Right-of-Way. If however, the Project involves construction/reconstruction/re-alignment and/or combines other Federal, State and/or Local funding, the Sponsor will be required to complete an Environmental Field Review (as above) which will be submitted to WYDOT and forwarded to the Federal Highway Administration for their issuance of a Categorical Exclusion. Example of how this Environmental issue may be addressed in your application: This proposed Project is for application of Magnesium Chloride to act as dust suppressant on an existing and established County Road section, therefore we propose to have WYDOT include it in a WYDOT Blanket Categorical Exclusion for FY13 CMAQ Projects. Page 6 of 8 Please describe how the Sponsor proposes to address the Environmental Considerations (as per the highlighted paragraph above): 10. Will the Project design and contract bidding documents be produced by the Sponsor’s staff or by a consultant? If a consultant is used, the Brooks Act must be followed. The Project Sponsor is expected to have a process that is compliant with the Brooks Act. Guidelines for this policy are contained in Appendix “E” of the application. Who will review the Project design and contract bid documents for the Sponsor? Please name and provide the contact information for the person responsible for producing these documents. The Project Sponsor must submit these documents to WYDOT for review prior to advertising the Project for bids. Who will perform the construction management? Note: See Appendix D for “Project Timeline” for Notice to Proceed notification and other procedural timing for CMAQ Projects. Page 7 of 8 11. Project Budget Cost estimates should be incorporated in this budget to reflect the costs that are expected to be incurred in the Project. The budget will aid in the process of selection of any Project proposal for a CMAQ Project. The budget line items should not be understood to be absolute, as they may be changed later, if necessary, to reflect actual costs after the Project has begun. Also, please include a line item summary of the details of the proposed Project cost estimate to include charges for engineering, design, right-of-way, utilities and construction items. While other uses may be considered under the CMAQ guidelines, as administered by FHWA, the emphasis in the past has been on those counties impacted by this type of traffic. It is believed, with the limited amount of funding available within this program, the Selection Committee will continue to focus on these types of Projects this year and in the future. Please do not let this discourage you from applying for funding under the FY 2013/2014 CMAQ Program, as all eligible Projects will be considered for funding by the Selection Committee based on funds availability.
