Cigarette was not used/ invented during Holy Prophet’s (P.B.U.H) time. Can we apply

Part (I)
Contract Act, 1872
1. Ahmed offered his car for sale to his colleague Zahid through e-mail for R.10, 00000/- on
1st May 2012. Zahid replied through e-mail on 2nd May 2012 that “he is ready to buy that
car for Rs.9, 50,000/-” when Zahid consulted his family,
He was advised that Rs.10, 00000/- was a good price for that car. On that advice, Zahid
immediately made a call to Ahmed saying “He accepts the price of Rs. 10, 00000/-”
Ahmed refused to cell the car to Zahid and Replied “He has changed his mind” Zahid is
unhappy with the refusal as he has accepted the same price as proposed by Ahmed. Zahid
wants to sue Ahmed for Breach of contract. Advice Zahid about his right.
(The answer should not exceed 100 words)
2. All contracts are agreement but all agreements are not contracts. Discuss with reference
to the essentials of a valid contract.
3. Define free consent. What are the factors which affect the free consent?
4. What is meant by unlawful consideration and object? What is there effect in the process
of formation of contract?
5. “Agreement which ceases to be enforceable by Law becomes void when it ceases to be
enforceable” Discuss with reference to the provisions regarding subsequent possibility of
performance of contract.
6. There are certain relations where parties can enforce their rights even without a formal
contract. Discuss in light of relevant provision of Contract Act.
7. Define indemnity and guarantee. When surety is discharged from liability?
8. Define agency. What are the rights and duties of an agent?
