now but may still be repealed by an act of Congress (depending
on the progress of DPWH BOC legislative work);
2. IRR of PD 1096/ NBC; revised by the BoC
and NBCRC

April 2005 and took effect 02 May 2005; future revisions still possible
depending on the outcome of the repeal effort on the basic law;

for completion by the BoC and NBCRC;
4. Additional IRR Guidelines and Building and
Material Standards; other executive issuances that may
still follow depending on need assessment by the BoC & NBCRC;

2a.What was done to the National Building
Code (NBC)? Is it still “the Law”?
1. The present NBC was promulgated 19 March 1977 as PD 1096
by President FM; its various Implementing Rules and Regulations (IRRs)
2.
were issued by the MPWTC until 16 July 1979; in 1992, only the IRR section
on Permit Fees were amended;
In the year 2000, the DPWH re-organized the Board of Consultants (BoC)
composed of representatives of accredited professional organizations (APOs)
and reconstituted the Building Research and Development Staff (BRDS) into
the NBC Review Committee (NBCRC);
3. the BoC was headed by a past UAP President (Angel Lazaro, Jr.)
and 36 other member-professionals took part in the 3-year effort to
revise only the IRR, which was signed by the DPWH Secretary on 03 Nov
2004, published April 2005 and which took effect 02 May 2005;
4. as of 2005, PD 1096 (NBC) is still the only law on buildings as
it was neither amended nor repealed;

What
will
come
next
and
when?
1. With the 02 May 2005 effectivity date of the 2005 Revised
IRR, the following may now take place:
a. possible DPWH issuance of general information
materials for the public; members of APOs like the UAP and the
PICE may have their members trained in dissemination work and will
be asked to help disseminate information on the IRR; and
b. issuance of the manual of procedure for use by the
Building Officials tasked to enforce the 2005 R-IRR; and
2. sometime in 2006, crafting of the bill (the “Building Law”)
that shall fully repeal PD 1096 (NBC) and fully assimilate the
Revised IRR of 2005, should be completed; however, this new
legislative effort may extend to 2007 and beyond;

3. What are the general features of the 2005
Revised IRR that may be of interest to Professionals?
1. The 2005 Revised IRR applies particularly to all new
structures located in new developments, i.e., along new road
rights-of-way (RROWs), new subdivision or estate developments,
particularly reclamation areas; rules on foot-printing and
setbacks may be somewhat relaxed for new construction within
built-up areas or for renovation/ rehabilitation projects;
2. The Revised IRR integrates general design and physical
planning concerns, particularly on the matter of the development
and usage of RROWs and ROWs and their collective effect on the
determination of building bulk inside properties facing RROWs;
3. The building permit shall become a general permit to be first
supported by ancillary or accessory permits; and
4. Architectural & Structural Permits are types of ancillary permits.

What do the terms carrying capacity, development
control and development potential actually mean (under
the 2005 Revised IRR of the NBC/ PD 1096)?
Carrying Capacity of Lot – the optimized extent of physical development that may be
introduced into the lot without causing undue damage, effects or hardship on the end-users
of the proposed development or on neighboring occupants, entities, properties, lands,
developments or the environment (whether man-made or natural) and with the proposed
building/structure capable of being supported by existing utility, transportation and service
systems or by proposed expansions/upgrading of such systems within the immediate future;
Development Control (for Lots and Buildings/ Structures) – a set of inter-acting
regulations concerning the physical utilization of a lot and likewise governing the
planning/design of spaces and/or the use/occupancy of a building/structure to be introduced
(or already existing) on a lot; development controls help determine in detail the development
potential and/or the carrying capacity of all lots and/or of proposed developments on lots;
and
Development Potential of Lot – the maximum extent of physical development that may be
introduced into the lot, i.e., the erection of the proposed buildings/ structures, after full
compliance with the applicable regulations that need to be satisfied, specifically those found
in the Code, i.e., the PNBC.

condominium uses (R-5);
3. Rule VII, Sec. 705 - 707 : prescribes Allowable Maximum Total Gross Floor
Areas (TGFAs), which is the product of the Building Height Limit (BHL), i.e.,

15.Caveat
To prevent illegal rule insertions in the printed version of
the 2005 Revised IRR (which happened so many times in the past to
previous editions of the NBC IRR), the following steps should be
taken:
a) the DPWH must be the only and solely designated
copyright holder to the 2005 Revised IRR;
b) the only official source of the document (in either hard or
soft versions) should be the DPWH; and
c) the only official publisher should be the National Printing
Office (NPO) located along EDSA in Quezon City (between East Ave.
& Quezon Blvd.), i.e., not the National Bookstore!
