an authorized representative of the Company, agrees that if CableLabs incorporates this ECR in whole or in part into the relevant Specification,
all intellectual property in the ECR shall be licensed royalty free, and without confidentiality, under the terms of the "Data Over Cable Service
Interface Specifications License Agreement" ("Contribution Agreement"). CableLabs may disclose the content of this ECR to CableLabs'
members and such others as is necessary for the development of CableLabs' specifications. Questions about the Authors' licensing of

DETAILED DESCRIPTION OF PROBLEM:
There is some ambiguity between the MULPI spec and the PHY spec regarding the assignment of excluded
subcarriers for OFDMA channels. The PHY spec section 7.2.5.3 specifies lower and upper subcarriers that cannot
be used for the active spectrum. The MULPI spec states that all subcarriers not specified in the UCD as unused or
excluded are to be used as part of the minislot mapping. This leaves some ambiguity as to whether or not the UCD
needs to include the lower and upper subcarriers in PHY 7.2.5.3. To avoid potential interoperability issues between
CMs and CMTSes, this ECR requires the CMTS to include the upper and lower subcarriers in the exclusions
specified as part of the UCD.
Similarly, there is some ambiguity between the MULPI spec and the PHY spec regarding the assignment of
excluded subcarriers for OFDM channels. The PHY spec section 7.2.5.1 specifies lower and upper subcarriers that

the lower and upper subcarriers in PHY 7.2.5.1. To avoid potential interoperability issues between CMs and
