Minutes of the 2013 Annual General Meeting
Held Friday November 15, 2013
At the Fraternal Order of Eagles, 1104 West 2100 South, Salt Lake City, UT










Tony Jacketta (ECR 182) called the meeting to order at 7 pm.
Tony introduced Tom Gorman (ECR 71) as the Association Secretary.
Minutes of the 2012 Annual General Meeting were distributed, Dan Butler (ECR 208)
motioned to approve the 2012 minutes, Grant Johnson (ECR 100) seconded the motion,
the 2012 meeting minutes were approved.
Due to the secretary position being vacant the 2012 meeting minutes were never
distributed, they will be included in the email/mailing of the 2013 meeting minutes.
Tony Jacketta (ECR 182) asked if there were any new lot owners in attendance. Jeff &
Linda Osgood (ECR 171), Mike McIntyre (ECR 158), A. J. Vigil (ECR 187), and Ryan
Conway (ECR 141) were recognized and welcomed.
Sam Fleming (ECR 165) read the 2013 Income and Expenditures. It was voted on by the
body with a motion to approve made by Ray Connolly (ECR 130) and seconded by Les
Christensen (ECR 39). Copies are included in this year’s meeting minutes mailing.
Sam Fleming (ECR 165) explained ECR expenses and that the roads need more gravel.
Typically the association budgets $20,000 for annual road work. When property owners
don’t pay their road assessment timely and the assessment is not collected until Summit
County includes the assessment on the property tax, income for that year is low. Sam
commented that we need to budget more money for gravel and also that we’re
required to have every lot identified with signage. Sam concluded with a statement we
have two choices, leave the road assessment schedule the same ($125 minimum) and
don’t allow for extra gravel, or increase the road assessment to $150 minimum to allow
for more gravel, “T” post & signage for all lots.
Much debate ensued and Ray Connolly (ECR 130) pointed out that the road assessment
fee schedule was changed in 2012 however it was not enforced. Ray motioned leaving
the road assessment schedule as is and enforcing the late fees. Lee Evans (ECR 190)
seconded the motion; the motion to leave the road assessment schedule as is was
approved.
Ray Connolly (ECR 130) explained to all in attendance how Summit County collects the
road assessment when lot owners fail to pay it throughout the year and eventually the
monies are given to the association, but it is a slow process.
Sam Fleming (ECR 165) read the proposed Operating Budget for 2014. The Income &
Expenditures were voted on with a motion to accept by Ray Connolly (ECR 130) and
seconded by Dick Marshall (ECR 172). The motion to approve the 2014 budget was
approved. Sam explained income versus expenses shouldn’t change too much for 2014
and he estimates we will maintain our reserve funds at or about $30,000.



Grant Johnson (ECR 100) questioned why the association would pay for lot signage
when the bylaws require lot owners to mark and identify their lot (s). Sam explained the
cost should be minimal and the signs would be uniform in size and layout. Dan Dimick
(ECR 61) commented he would be interested in helping make the signs.
Sam Fleming thanked Tony & Karen Jacketta for hosting the 2013 work party on 22 June
2013, as well as the pot luck dinner held that evening. Tony commented it was a good
time for all. As usual we would love to have more lot owner’s show-up for the annual
work party. We (ALL LOT OWNERS) are required by the state to spray for thistle to keep
it under control. Sam commented that about 20 people or so sprayed about 90% of the
spray. Discussion was brought up about the possibility of charging lot owners a fee if
they do not contribute to the spraying of thistle. The topic of charging lot owners a fee
for not spraying did not get a motion and no decision was made.
Thanks were given to Ivan Dickson (ECR 44) for taking care of mixing the spray and
having it available for lot owners to use.

The 2014 work party is scheduled for 21 June 2014; meet at 9:00
AM near Ivan Dickson’s lot (ECR 44). Bring spray equipment,
(possibly shovels, rakes, and chainsaws, depending on how ECR
fares over the winter). A reminder notice will be sent out.

The meeting was opened for general discussion:
o Dan Butler (ECR 208) commented that the Friday before the general deer hunt
he passed some folks in a small car and a truck with a trailer who had stopped to
put the truck into 4 wheel drive. As he passed them, all 4 people flipped him off.
The next day he found the people and knows what lot they were associated
with.
o Also during the general deer hunt Fred Benson (ECR 24) had a run-in with the
same crowd, they threatened to kick someone’s ass on his lot if they were not
allowed to hunt it.
o This type of behavior is unacceptable. These individuals
were not lot owners at ECR; they were guest of a lot
owner.
o Many members commented on the problem of people not reading or just
disregarding no trespassing signs.
o Chuck Hadley (ECR 10) asked if we could get a list of lot owner’s names and
contact info. Tom Gorman (ECR 71) stated he’s working on putting one together
and will distribute it electronically to those he has an email address for. Others
wanting a copy can send Tom $5.00 and a hard copy will be mailed.
o Ray Connolly (ECR 130) commented the Summit County web site has the lot
owners listed. He also asked if the association could ask the DNR to possibly





show a stronger presence during the general deer hunt. Sam explained there are
only 2 DNR officers and they’re spread pretty thin.
o Mike King (ECR 42) has created a web site; echocreekranches.com that shows
maps, lot owners, pictures, and could help with identifying property lines. The
site is not officially sponsored by ECR and it cost him $100.00 per year to
maintain. If you like the site and are so inclined to do so, he is accepting
donations to offset the yearly costs.
o Jerry Carlston (ECR 108) handed out laws for shooting near structures. Very
interesting reading. Look at Title 76 Utah Criminal Code, Chapter 10, Section
508. In a nutshell, you must have written permission from the property owner
to discharge a weapon anywhere within 600 feet from any structure.
o Jim May (ECR 148) commented we need to look out for each other at ECR; if you
see someone you don’t recognize on another’s property, question them, get
their name, license plate number. If they aren’t cooperative take a picture or
video and alert the Summit County Sherriff (435) 336-3500.
o Dan Butler (ECR 208) commented that we as land owners know the layout of the
land, where cabins and trailers are located, guests may not, so inform any guest
you bring in.
o Ben & Ellen Adams (ECR 68) stated be responsible for your guests.
o Sam Fleming reiterated the point, be responsible for your guests, let’s look out
for each other. You’re responsible for people’s actions you allow on ECR.
o Frantz Scott (ECR 62) explained the benefit of using a GPS to locate property
lines.
Barbara Christensen (ECR 39) discussed the fire program and is working with Mike King
(ECR 42) to get the plan uploaded on echocreekranches.com. She has blank forms for
recording hours worked in the red mailbox just through the tunnel. Anything we as lot
owners do to reduce the fire potential on our lots (clearing dead fall, cutting trees,
creating a 25’ fire break around our structures) can be logged and reported through
these forms. Once filled-in please put them back in the red mailbox. She can collect
work accomplished for the past 3 years.
Ray Connolly (ECR 130) commented the fire this past summer at Rockport should be a
wake-up call to all of us.
Sam Fleming (ECR 165) stated if the area is considered non-defendable the fire
department will not come in on a fire.
A general comment was made by the board of trustee’s that the board is responsible for
roads, road maintenance, culverts and such, they will not/cannot get involved in
property disputes.
Tony Jacketta (ECR 182) opened up the floor for nominations of trustee’s for 2014. Les
Christensen (ECR 39) motioned to keep the same members, Rod Frazier (ECR 110)
seconded the motion, motion carried.





Tony Jacketta (ECR 182) discussed the 100’ easement the association has from the
roads; it’s not specifically 50’ to either side but can at times be a variation.
Tony Jacketta (ECR 182) adjourned the meeting at 8:30 PM.
52 lots at ECR were represented at the meeting, thanks for the good turn-out.
As a reminder lock boxes are not allowed on the gates during hunting seasons Sept. 1st
to Jan. 31st as stated in the By-laws.

Road assessments have changed:
$125.00 per lot if payment is received by March 31st
$200.00 per Lot if payment is received by June 30th
$250.00 per Lot after July 1st and no later than August 31st
If not paid by August 31st it is payable with your annual Summit County Taxes due by 30
November.
Your road assessment should be mailed to the Echo Creek Ranches Secretary (address
below). All questions regarding road assessments should be directed to him. Please
make out one check payable to “Echo Creek Ranches” for the full amount of the
assessment with your Lot number(s) noted on your check.
