PROTEST
Claimant: The person who fills the protest and asks for the legality of a machine.
Defendant: The person in charge of the machine suspected. (Can be the driver)
Officials: Circuit Pro Tour direction
Protest forms are available from the Circuit Pro Tour Officials.
To be valid, a protest shall be requested no more than 30 minutes after the end of the
class race. The protest must mention the specific requested part to inspect (can be a
general protest) and must clearly identify the vehicle involved. The protest must be
signed by the claimant prior submitting it to the Technical Director or the Race Director.
The protest will be accepted and processed only if the deposit above the protest, in cash
money. The protest may be rejected before any move by the Circuit Pro Tour officials if
it is deemed non-compliant or not conform. The cash deposit will be restituted to the
claimant and the protest will be closed.
If the protest is accepted by the Circuit Pro Tour officials, the request couldn’t be
cancelled until the judgment. The deposit will be kept by the officials until the final
judgment. Two different types of request can be made in a protest:
1. A deposit of $ 100.00 will be charged to claimants who wish to contest the
legality of an outside part on the machine. A part is judged outside when no
disassembly or dismantling is required.
2. A deposit of $ 500.00 will be charged to claimants who wish to contest the
legality of an internal component or to contest the general legality of the machine.
The following components are included in this inspection: the internal
components, external, aesthetic, electrical, electronic, mechanical and running.
Two different judgments can be made after the official inspection:
1. If an ATV is recognized as correct (legal, conform) by the Circuit Pro Tour
Technical Director, the deposit will be returned, less inspection and
administration fees, to the owner of the ATV (defendant). The claimant will lose
his deposit.
2. If an ATV is found not conform (illegal) by the Circuit Pro Tour Technical
Director, the person in charge of the vehicle must correct the situation (the
illegality) immediately. The machine and its driver will be disqualified. In addition,
all points of the day will be removed at (x) driver(s) who used the ATV illegal. The
deposit will be given to the person who filed the protest (claimant), without the
inspection and administration fees.
Please note that an official judgment is final.
