‫جيب آأن يضمن مقدم العطاء الاصناف الىت قام بتوريدها ملدة س نة واحدةمن اترخي الاس تالم والقبول الفين وعليه اإجراء آأية‬
‫تعديالت الإصالح آأي خلل آأو قصور نتيجة عيب يف ا ألهجزة خالل مدة الضامن وذكل بنفقات وتاكليف عيل حسابه وال يشمل‬
‫ذكل العيوب الناش ئة عن سوء الاس تخدام‪ .‬كام جيب عيل مقديم العروض حتديد تاكليف عقد الصيانة الس نوي وذكل بعد فرتة‬
‫الضامن اجملانية‪.‬‬
‫‪ -7‬الغرامات واجلزاءات وخمالفة رشوط العقد‬
‫ملعهد حبوث الالكرتونيات احلق يف توقيع غرامات التأأخري اإذا تأأخر مقدم العطاء يف التوريد وذكل طبقا ملا يقيض به القانون رمق ‪98‬‬
‫لس نة ‪ 8889‬بشأأن املناقصات واملزايدات والحئته التنفيذية وتعديالته‪.‬‬
‫يلزتم مقدم العطاء بتنفيذ الأعامل املنوط هبا عيل الوجه الأمكل وفقا ل ألصول الفنية واملواصفات وىف حاةل خمالفة ذكل يكون من حق‬
‫املعهد فسخ العقد دون آأي اإنذار آأو تنبيه آأو حمك قضايئ آأو تنفيذ الأعامل عيل حساب مقدم العطاء بعد مصادرة التأأمني الهنايئ‬
‫وما يكون مس تحقا هل‪.‬‬
‫وللمعهد احلق يف فسخ التعاقد او تنفيذه عىل حساب الرشكة املتعاقدة اذا اخلت بأأي رشط من رشوطه ويكون الفسخ او التنفيذ‬
‫عىل حساب املتعاقد (مقدم العطاء) بقرار من السلطة اخملتصة ويعلن املتعاقد بكتاب موىص عليه بعمل الوصول عىل عنوانه املبني‬
‫ابلعقد‬
