• In class we said that a Tort is a wrongful act that results in injury to another's person, property, reputation, or the like, and for which the injured party is entitled to compensation. You have been selected to help me design a tort data base that will help other students learn about torts.

Your Task: You will be assigned either a tort or a significant tort case from the list below.

• Find a definition dealing with that tort.

• Find a current article dealing with that tort from the newspaper or the internet.

• After you find the article you must –

1. Identify the parties involved.

2. The charges against the defendant.

3. Facts of the Case

4. Possible defenses.

5. Possible punishments

6. Explain group verdict of the case based on the facts of case.

7. A reference section.

• ***Finally organize all your information into a presentation. Presentation must contain either a PowerPoint or a Poster. Each presentation should have either a song or a poem dealing with the tort that was broken. ***

• Be creative when designing your projects. You can work in groups of three or as individuals.

Daniel R. Nelson ; Suffered a motorcycle accident and received more injury and suffering while being treated by physician

Lorraine C. Novich-Welter.

Lorraine C. Novich-Welter claims that she exercised the highest standard of care and did nothing wrong.

While in rehabilitation, his arms, legs, and chest were secured because the doctors believed his movement would remove a tracheotomy tube.

One morning a Novich-

Welter went in to find him dying with a tracheotomy tube removed and in a vegetable state because the nurse took too long to call an emergency team.

The jury found Lorraine C. Novich-Welter

Negligent in the care of Daniel R. Nelson and awarded Nelson $1 million for past and future pain, suffering, and disability,

$994,716 in medical health care expenses,

$50,000 to Nelson’s wife for loss of consortium, $65,000 to Nelson’s son for lack of society and companionship.

Nelson is now confined to a wheelchair due to injuries caused because of Lorraine C.

Novich-Welter.

Definition

• Battery: an offensive touching or use of force on a person without the person's consent.

Current Case

• A 13-year-old boy ran through a garage to escape his family's slaughter at the hands of his father, who then took his own life on their front lawn.

• On May,4 th 2009 Troy Ryan

Bellar killed his wife and their 5 month and 8 year old sons, before killing himself in front of their home in Lakeland,

Florida.

The Good Side

• While this was happening Their 13-year old son escaped several bullets to escape the shooting of his father. He exited through the garage to safely enter his neighbors house until police came.

Outcome

• There was no suicidal note left to explain why the father would commit such a crime.

Though the son explained the his mother was trying to escape his fathers rage with his little brothers which led to the gun shots.
