100% Smokefree Restaurants: Municipalities with ordinances or regulations that do not allow smoking in attached bars or
separately ventilated rooms and do not have size exemptions.
States with Partial Preemption of Local Restaurant Laws as of July 1, 2006: Illinois - Statewide preemption law applies
to all counties other than Cook County and to restaurants and bars in non-home rule municipalities. Pennsylvania - Statewide
preemption law applies to all municipalities except for cities of the second class.
Note: Montana’s statewide preemption law will expire September 1, 2009, when the bars and casinos portion phases in.
