Subject: Unsafe School Choice Option

This letter is in response to the changes to the Gun Free Safety Act which is required of all districts receiving federal funding. Failure to submit this report will risk the interruption of Federal funds. The GFSA report has been changed to include incidents regarding the Unsafe School Choice Option.

Please review the changes to this attached report which includes six questions.

It is my suggestion that if you have not adopted a local policy regarding Unsafe School

Choice Option to please put this on your agenda for the July, 2006 Board meeting. When your board approves the policy, I would then ask you to complete the GFSA report and send it to me if you want Region 9 to submit it for you.

I have attached a sample policy for the Unsafe School Choice Option for you to review.

If this sample policy meets your approval, then please feel free to use it as a model and make any needed adjustments.

I have some suggestions for you to consider that are not part of the USCO policy but they relate to its implementation.

1.

Please check to see if your TASB policy includes it and have your school attorney review your policy before the board approval

2.

Parental notification regarding the status of the school and the offer to transfer students may be made simultaneously.

3.

If the District does not have another school for the student to transfer then the district is encouraged to explore other appropriate options such as an agreement with a neighboring district to accept transfer students.

4.

The district should allow transferring to a safe school that is making adequate yearly progress (AYP), and has not been identified as being in school improvement, corrective action, or restructuring.
