MARKING SHOULDER POINT FOR SNOWPLOWING

Because of a widespread practice involving the indiscriminate placing of markers of various design along the traveled portion of the roads to protect lawns during the winter months and because this practice was, in many cases, hazardous to the public and/or a nuisance to the

Marquette County Road Commission, it was deemed necessary to develop a policy to deal with this matter.

Marking of the shoulder point will only be allowed by a perpetual permit lasting as long as that property owner who acquired the permit owns the property. (Miscellaneous activity permit –

$10.00 fee) and such marking shall be done according to the following conditions: a.

MARKER TYPE – all markers shall be at least six (6) feet in length. Wooden and plastic markers not exceeding two (2) inches in diameter shall be the only type markers allowed. Any other markers not meeting the above specification can only be place if approved by the Road Commission. b.

GROUND PENETRATION – all markers shall be anchored at least one (1) foot into the ground. c.

LOCATION – a marker shall not be placed closer than two (2) feet from the edge of the pavement or the established shoulder point, whichever is the greater distance from the edge of the pavement. Areas that have curb may be marked at the back of curb. d.

DURATION – The permit is in affect as long as the property own who obtained the permit still owns the property. However, markers shall not be placed prior to October

1 or remain in place past May 1 of any year.

By marking the property the property owner is accepting the liability associated with the markers, and placing markers.

The issuance of a permit to install marker, in no way implies, that the Marquette County Road

Commission accepts any liability for damage to markers or lawns on the road right-of-way as the result of winter maintenance operations. This policy is simply a good faith gesture designed to provide a means to assist winter maintenance staff in performing their duties and hopefully minimize damage to lawns. All costs for repairing lawns within the road right-of-way shall be the responsibility of the property owner.
