Lawn Maintenance Agreement
Part I—Lawn Maintenance Considerations
A. Mowing, Edging ( If applicable) and String Trimming: Diversified Ecological will mow turf areas up to 42 times per
year or as needed according to seasonal growth or recent treatments applied. Mowing shall be with a rotary mower.
Mower blades will be sharp at all times to provide a quality cut. Mowing height will be according to grass type and
variety not preference. Diversified Ecological will mulch clippings into the lawn whenever conditions allow as long as
no readily visible clumps remain on the grass surface 24 hours after mowing. Otherwise, Diversified Ecological will
distribute clumps of grass by mechanical blowing or by collecting and removing them upon request.
A. Diversified Ecological will string trim tree rings, plant beds and all buildings, sidewalks, fences, driveways, parking
lots, and other surfaced areas bordered by grass during each visit, walkways will be mechanically edged and maintained
as needed. Isolated trees and shrubs growing in lawn areas should require mulched areas around them (minimum 2-foot
diameter) to avoid bark injury from mowers and filament line trimmers and to reduce root competition from grass.
Establishment and maintenance of such mulched areas will be charged to the customer at a negotiated rate. Diversified
Ecological will clean all clippings from sidewalks, curbs, and roadways immediately after mowing and/or edging.
Diversified Ecological will not sweep, blow or otherwise dispose of clippings in sewer drains.
B. Lawn Fertilization: (if selected) Complete fertilizers shall be granular in composition and contain 30% to 50% or
more of the nitrogen in a slow- or controlled-release form. After fertilization, a minimum of inch of water must be
applied by the client and a regular watering schedule should be maintained. This service is optional and extra cost and
the fertilizers to be purchased by the customer.
Part II—Landscape Plant Maintenance Considerations: Trees, Shrubs, Ground Covers
A. (optional except in Full Care Package) Pruning: Shrubs will be pruned with hand shears and/or mechanical hedge
trimmers as needed to provide an informal shape, fullness and blooms. No pruning will be done during or immediately
following growth flushes, branches will be pruned just outside the branch collar, and pruning paint will not be applied.
Sucker growth will be removed by hand from the base of trees. No herbicides will be used for this purpose. It is
recommended that an ISA Certified Arborist be consulted and/or utilized for tree work. We do not do any work on trees
over 12’ in height.
B. Mulching: (Optional except in Full Care Package ONLY.) All mulched areas will be replenished/rejuvenated once a
year during March and April or at start of services if started mid season using compatible mulch. Mulch should be
maintained at a depth of 3 inches. Replenishment of mulch will be an additional cost.
Part III—Considerations for Optional Services
A. Annual Flowers: Replacement of existing annuals will be done as requested. Replacement of dead or injured plants
due to contractor negligence will be done without cost to client if applicable. Replacement of stolen, vandalized or
damaged flowers will be charged to the client at a rate of cost of plants plus cost of labor.
(optional) Annuals and perennial bedding plants - Diversified Ecological will be responsible for weed control in these
areas if applicable.

B. Other Services Available: (Priced per job by Diversified Ecological): • Landscape additions/renovations/transplanting.

Part IV— Considerations for Insurance, Licenses, Permits and Liability
Diversified Ecological Sales & Services, Inc. will carry liability insurance as required by law and require same of any
sub-contractors and provide proof of same to the client on request.
Situations which the Contractor may deem are not his/her responsibility:
1. Death or decline of plant materials due to improper selection, placement, planting or maintenance done before the
time of this contract.
2. Damage due to improper irrigation, components existing at the time of contract execution.
3. Exposed cables/wires or sprinkler components/lines normally found below the lawn’s surface.
4. Flooding, storm, wind, fire or cold damages.
5. Disease or damage to lawns or landscape plants caused by excessive irrigation or lack of water due to inoperative
irrigation components provided he/she reported these to client, or irrigation restrictions imposed by the Water Management
District or civil authorities.
6. Damage caused by or to any item hidden in the landscape and not clearly guarded or marked.
7. Damage due to vandalism.
Part V—Property Description, Services Provided, Terms, Conditions and Charges (for possible inclusion) Service
agreement Outline
Maintenance will begin within 1 week of acceptance and will be performed on any day Monday thru Saturday between
the hours of 8am and 6pm. Diversified Ecological employees will do their best to keep noise to a minimum and respect
yours and your neighbors’ property at all times
All service agreements are automatically renewed from year to year unless otherwise cancelled by the client.
All work will be done in accordance of this agreement and will be performed by Diversified Ecological Sales &
Services, Inc. on a regular basis, All lawn maintenance work is subject to a Spring clean-up and Fall closing fee which
is due at the start up and close of the season unless included in your plan. I.E., leaf removal, mulch installation and roof
clearing.
All prices are subject to increase no more than 10% per year on any year over year agreement
Basic Lawn Maintenance: 42 cuts per year unless stated otherwise, as the season requires.
Includes: Cut & String Trim only, no chemicals included. All clippings and debris are bagged and left on site for
garbage pick up. All lawns will be mulched whenever possible. Prices are based on 42 cuts per year (except in the case
of heavy weather) with only 1-2 cuts per month during the winter season.
Full Lawn Maintenance: 42 cuts per year unless stated otherwise, as the season requires. Includes: Cut, String Trim,
Lawn edge maintenance and, ornamental plant bed weed control. All clippings and debris are bagged and left on site for
garbage pick up. All lawns will be mulched whenever possible. Prices are based on 42 cuts per year (except in the case
of heavy weather) with only 1-2 cuts per month during the winter season.
This agreement will remain in effect until Diversified Ecological Sales & Services, Inc. is notified in writing of intent
to cancel service. A minimum of 30 days notice is required, accounts must be paid in full prior to cancellation date.

Payment policy & Cancellations/Terminations
This agreement may be cancelled without penalty or obligation within (3) business days of the “accepted” date
below.
Payment for lawn maintenance service will be billed at the first of the month and due on the 15th of the month. We
accept checks made payable to DESS or online payments with a credit or debit card at http://www.DESSOrlando.com
Payments made beyond the 20th day of the month will be charged a $15.00 late payment fee, returned checks will
subject the account to a $40.00 returned check fee. Accounts left unpaid for one full billing period may be suspended
and subject to cancellation, only in this case will a collection & termination fee of $175.00 be imposed to that account,
once cancelled all unpaid accounts will have 30 days to pay in full any account “past due” balance along with the full
remaining balance of the agreement as quoted. Diversified Ecological may terminate or transfer this contract without
notice for any reason and without consequence.
