PURCHASE OF LAND OPPOSITE MOUSWALD PRIMARY SCHOOL
I. Purpose of Report
Approval for the acquisition of land is sought.
2.
Background
2.1
Dumfries & Galloway Council own Mouswald Primary School to the north west
of Mouswald.
2.2
Over the past year problems have emerged with adjoining landowners who
share the access road with the primary school.
2.3 Concerns have been raised over parents using the access road to drop off
and pick up children. This has caused problems of congestion and noise and some
damage to boundary walls. The access road has restricted visibility and poor sight
lines.
3.
Policy
The Council’s acquisition policy is as follows:
approval for acquisition must be obtained from Asset Management Committee
acquisition can only be justified when all options and associated costs have
been established
acquisition values will be established by negotiation but compulsory purchase
will be used where necessary to achieve value for money
a project team representing all interests will be formed to ensure a coordinated and sensitive approach when dealing with vendors
acquisition is delegated to the Operations Manager Property Services where
parameters of location, function and funding have been specified and fulfilled

Proposal
4.1 An area of farmland located next to the road verge opposite the primary
school has been identified extending to 247m2 which can be formed into a car park
and pick up/drop off point (Appendix 1). This will reduce the amount of traffic using
the access road to mostly service vehicles.
Provisional agreement has been reached with the landowner to purchase the

land for the sum of f 3,500. The Estate Management Service Leader is of the opinion
that this represents value for money.

Consultation
5.1
The Corporate Director for Education & Community Services has been
consulted and is in agreement with the terms of the report.

Recommendation
Members are asked to agree to purchase approximately 247sq metres of land
opposite Mouswald Primary School for the purpose of delivering primary
education at a negotiated price of €3,500. Other terms and conditions to be
agreed by the Operations Manager Property Services.
