SIGNIFICANT OR UNUSUAL EXCLUSIONS OR LIMITATIONS (BY SECTION)
SECTION 1
The most we will pay for property damage is £20,000,000 for any one claim or claims arising out of one
incident. The most we will pay for costs and expenses arising from property damage is £5,000,000 for any one
claim or claims arising out of one incident.
SECTION 2
You must pay an amount towards any claim that you may make under Section 2 of the insurance. This amount
is called the ‘excess’. More than one excess may apply to a claim, but details of all excesses, including
windscreen, will be shown in Section 2 of the insurance or in the policy schedule.
There is a £400 limit for audio, visual, communication, guidance or tracking equipment which is not the
manufacturer's standard fitted equipment (less any excess you must pay).
New car replacement applies to vehicles less than one year old that are damaged so that repairs will cost more
than 50% of the manufacturer’s Recommended Retail Price.
If your vehicle is damaged while a young or inexperienced person (including you) is driving you will have to pay
the following excesses (on top of the other amount that you must pay).

Loss of or damage to your vehicle or its contents by theft or attempted theft or an unauthorised person taking
and driving it will not be covered if it has been left unlocked, left with the keys in it, left with the windows, roof
panel or the roof open (in the case of a convertible vehicle) or reasonable precautions have not been taken to
protect it.
SECTION 5
There is a £500 limit (per person) on Medical expenses.
SECTION 6
Personal belongings cover applies up to a limit of £100 for personal belongings in or on your car or commercial
vehicle and up to the limit shown on your schedule for personal belongings in or on your motorhome. Cover
will not apply to money, goods or samples connected with your work, property insured under any other
contract or property that was not reasonably protected.
SECTION 7
Personal Accident benefits are only given to the policyholder and their husband, wife or civil partner (while
under 70 years of age), and are restricted to accidents resulting from travelling in, or getting into or out of,
private motor vehicles. The limits to the amounts that we will pay are as follows.

Some important facts about the Motor Legal Expenses Insurance Policy are summarised
below. This summary does not describe all of the terms and conditions of the policy, so you
will need to take time to read the insurance policy wording to make sure that you
understand the cover that it provides. All references below to the cover provided are
contained within the full policy word- ing. Please note that a full policy wording is available
for your inspection upon request.
The policy is designed to cover the cost of professional fees charged by a solicitor following
a specific occurrence, provided that cover for that occurrence is detailed within the policy
wording and is not specifically excluded within the policy Schedule issued.

Personal Injury
Professional fees resulting from the death of or personal injury to an
Insured Person.

your Insured Vehicle.
Motoring Criminal Prosecution
Defending a criminal prosecution brought against You as a result of a
driving offence where Your driving licence is at risk of being revoked
or suspended.
Any claim arising from a stress or psychological related condition.
Subject to there being reasonable prospects of success in defending
the prosecution.
Any Professional Fees relating to an allegation that the Insured
Person was driving under the influence of alcohol or drugs.

Significant And Unusual Exclusions Or Limitations
The policy will exclude claims where the incident falls outside of the scope of cover provided
by the policy wording or where this is subject to a specific exclusion or limitation. Please
refer to the policy wording for full details. The most significant or unusual exclusions or

If you can convince us that there are sensible prospects of being successful in your
claim and that it is reasonable for Professional Fees to be paid we will take over the
claim on your behalf appoint a specialist of our choice to act on your behalf.
We may limit the Professional Fees that we will pay under the policy where we
consider it is unlikely a reasonable settlement of the claim will be obtained, the
potential settlement amount of the claim is disproportionate compared with the time
and expense incurred in pursuing or defending the claim or where there are
insufficient prospects of obtaining recovery of any sums claimed.
Where it may cost us more to handle a claim than the amount in dispute we may at
our option pay to you the amount in dispute which will then constitute the end of the
claim under the policy.
If Legal Proceedings have been agreed by us you may at that stage decide to
nominate and use your own solicitor or indeed, you may wish to continue to use our
own specialists. If you decide to nominate your own Professional we must agree this
in advance and you will be responsible for any Professional Fees in excess of those
which our own specialists would normally charge us (Details are available upon
request).
At conclusion of the claim if you are awarded any costs (not your damages), these
must be paid to us.
Please note that if you should engage the services of a Professional prior to making
contact with us any costs that you incur are not covered by this Insurance.
This is a policy where you must notify us during the period of insurance and within
180 days of any circumstances which may give rise to any claim under the policy.
Failure to do so could mean that we decline to pay a claim for your professional fees.
The jurisdiction and territorial limits of the policy is England, Scotland and Wales.
In the event that you make a claim under this policy which you subsequently
discontinue due to your own disinclination to proceed, any legal costs incurred to
date will become your own responsibility and will be required to be repaid to the
insurer.
Duration Of The Contract
The cover provided by the policy is normally for a twelve month period. Where this is
altered, it will be clearly shown within the quotation provided and policy schedule
subsequently issued.
Cancellation
We wish you to be happy with the cover provided by your policy. However you have the
right to cancel the policy within 14 days of receiving the policy documents without giving
reason. If you chose to cancel, we will refund your premium after first (at our discretion)
charging for the cover provided from the date of commencement of the contract until the
date of cancellation and any helpline costs incurred.
The helpline can provide general advice only and cannot assist with
complex legal matters which may require the review of documentation
and is not intended to replace the services of a solicitor.
Claims Address
The person insured by the policy should report immediately (and in accordance with the
policy terms and conditions during the period of insurance and no later than 180 days after
the occurrence) any incident which may give rise to a claim under the policy. Failure to do
so could mean that we decline to pay a claim under the policy. The telephone number for
the reporting of a claim is contained within the policy schedule. A claim form will be
dispatched for completion by the Insured Person and should be returned to the address
shown below. If you wish to make a claim in writing, this must be made in person by the
Insured Person seeking cover under the policy issued.
Please note that we will not enter into dialogue or correspond with anyone other than the
Insured Person or the Insured Person’s personal representatives (following death or serious
incapacity) in relation to the notification and subsequent handling of a claim.

Complaints Procedure
In the event of a complaint arising under this Insurance, you should in the first instance

If it is not possible to reach an agreement, you may have the right to make an appeal to the
Financial Ombudsman Service. This applies if you are insured in a business capacity and
have an annual turnover of less than €2 million and fewer than ten staff. You may contact

Compensation scheme
Ageas Insurance Ltd is covered by the Financial Services Compensation Scheme (FSCS).
You may be entitled to compensation from the scheme, if it cannot meet its obligations. This
depends on the type of business and the circumstances of the claim. Most insurance
contracts are covered for 90% of the claim with no upper limit. You can get more

PERIOD OF INSURANCE
The insurance offered is a 12-month contract, which may be renewed each year. Renewal will be subject to the
terms and conditions that apply at the time of renewal.
CANCELLATION
You may cancel the insurance at any time by sending us written notice and returning the certificate(s) of
insurance. The charges that will apply are detailed in the General conditions section of the insurance
document.
Your right to change your mind
As long as your vehicle(s) have not been written off as a result of a claim under the insurance, you may cancel
the insurance, without giving reason, by sending us written notice and returning the certificate(s) of insurance
within 14 days of it starting or (if later) within 14 days of you receiving the insurance documents. We will make
a charge equal to the period of cover you have had, but this charge will be subject to a minimum amount of
£25 plus Insurance Premium Tax (IPT).
HOW TO CLAIM
If a claim or possible claim occurs you must report it to us as soon as possible. Please phone our 24-hour
helpline on 0800 0356327.
COMPLAINTS
If you have any cause to complain about your insurance, or us, please contact the intermediary who
administers your insurance on our behalf. If your intermediary cannot resolve your complaint, you should
write to the Chief Executive of ERS at Library House, New Road, Brentwood, Essex, CM14 4GD. When you do
this, quote your insurance document number as it will help us to deal with your complaint promptly.
After this action, if you are not satisfied with the way your complaint has been handled, you may ask the
Policyholder & Market Assistance department at Lloyd’s to review your case. The address is Policyholder &
Market Assistance, Lloyd’s Market Services, One Lime Street, London EC3M 7HA.
If you remain dissatisfied after contacting Lloyd’s, you can then refer your case to the Financial Ombudsman
Service (FOS). The address is The Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London
E14 9SR.
This procedure does not affect your right to take legal action if necessary.
FINANCIAL SERVICES COMPENSATION SCHEME (FSCS)
If ERS is unable to meet its liabilities under this insurance, you may be entitled to compensation from the FSCS.
A claim is protected for 90% without any upper limit. For compulsory types of insurance the claim will be met
in full. You can get further information about the compensation scheme arrangements from the FSCS.

LANGUAGE AND LAW APPLYING TO THE INSURANCE
This insurance is written in English and all communications about it will be in English. Unless we have agreed
otherwise with you, English law will apply to this insurance.
