Comes now
, and pursuant to Indiana Code §36-927-33, respectfully requests the Madison County Drainage Board to grant a reduction in the right-ofway/easement of the
legal drain serving the following
described real estate located in Madison County, Indiana:
That said petitioner requests that the 75 foot right-of-way/easement, be reduced from the 75
foot requirement to the distance of ________ feet from the top of the
bank of
the open ditch and consents that permanent structures may not be placed in the right-ofway/easement without the written consent of the Board, that temporary structures be placed upon or
over the right-of-way/easement with the written consent with the Board, but shall be removed
immediately by the Owner when so ordered by the Board, and that no trees, shrubs or woody
vegetation may be planted in the right-of-way/easement, without the written consent of the Board and
said trees and shrubs may be removed by the Board, if necessary, for the proper operation or
maintenance of the drain.
