USERS’ LICENSE FOR COMPUTING CODES PROVIDED BY
METEO-FRANCE
Considering that METEO-FRANCE is the legal author or co-author of the following
intellectual property rights (the “Codes”) : SURFEX. and that METEO-FRANCE has agreed
to place at the disposal of the scientific community and for the exclusive aim of research
within the framework of the Project …………, the codes of the aforementioned package :

METEO-FRANCE, represented by P. BOUGEAULT, Head of CNRM, 42 avenue
Gustave Coriolis - 31057 TOULOUSE CEDEX FRANCE, hereinafter referred to as
METEO-FRANCE or “Licensor”
And
-
Laboratory XXX, represented by Mr. YYY,

hereinafter referred to as “Licensee” or “User”
METEO FRANCE and the licensee will hereinafter be referred collectively as the Parties or
individually as the Party.
The Parties have now convened the following :
Licensee acknowledge that the copyright and title to the Codes and any trademarks or service
marks relating thereto remain with Licensor and/or its suppliers and/or co-authors. Licensee
shall not have any right, title or interest in the Codes except as expressly set forth in this
Agreement.
1. METEO-FRANCE hereby grants to the User a non-exclusive license to use the Codes
under the conditions hereunder, for exclusive purposes of the laboratory ……………,
hereinafter referred to as “ the Licensee”
2. The User agrees not to transfer whole or part of the aforementioned Codes, nor to grant
user sublicenses to laboratories not taking part in the Project and which have not been granted
user license by METEO-FRANCE. The User shall not assign or sublicense the Codes or
license to any person or legal entity.
3. The User commits it-self to use the aforementioned Codes for the only purpose of scientific
issues defined by the specifications of the Project ……….. In particular the User shall not
build or develop non scientific applications, in particular for profit making purposes.
4. The User agrees to:


Quote the name of the SURFEX Software, as well as the name of at least one
scientific article published by the authors of this software in all publications, reports
and other documents presenting results obtained with the help of the software.
Send to the CNRM (CNRM/AGT), for information purposes, a copy of the above
mentioned documents.
5.The present License is valid for three years. At the end of each year, a short information
concerning the usage of the Codes will be asked to the User ; the User commits to answer to
this short survey. At the end of this 3 years period, the User commits to erase the Codes.
6. In the event of non-observance of whole or part of clauses 2, 3, 4, 5, METEO-FRANCE
reserves the right to remove access to the code with one month notice. In this event, the User
shall erase the Codes which it holds in accordance with the terms of the present license.
7. The Licensee agrees that METEO-FRANCE may take any reasonable measures that are
necessary, either directly, or through a delegate duly designated at the time of the transfer to
insure the correct use of its intellectual property rights.
8. Mr YYY, representing the laboratory XXX, promises to fulfill these commitments, and to
make them respect by the whole staff of the laboratory.
